Rangers administrators have today gone to the Court of Session in an attempt to overturn the recent disciplinary action imposed on the club by the SFA. Paul Clark said:
“The Club started proceedings at the Court of Session today in an attempt to challenge the imposition by an SFA Judicial Panel of a player signing embargo.
“The process will continue at the court on Tuesday and it is the Club’s position that the Judicial Panel did not have the powers to impose such a sanction.
“The Club and the administrators are grateful for the support of the Rangers Fighting Fund on this matter.”
It is prohibited by Fifa for a club to take its association to the civil courts. Fifa rules dictate that the national association must expel any club which takes this action. In December last year the international body threatened to expel the Swiss FA from world football unless it set a deadline to expel Sion after the club took action in its local civil court.
This action can surely only be to provoke the SFA into bringing this sorry saga to an end by kicking them out of the game before Duff and Phelps are forced to padlock the doors due to their own failures.
Unfortunately, President What-school-did-you-go-to is still in residence at the SFA, so it’s unlikely that we will see any clear action from Hampden to calm supporters of other clubs or the Scotland national team.

The outcome will simply be more SPL-like wriggling to avoid punishing them as harshly as they deserve.

So we have a situation here where either the signing embargo stands, or the SFA agree with court ruling and have to apply the most appropriate sanction, whcih would be explusion. However if they do that FIFA may expel the national and club sides from UEFA and FIFA competition, since the SFA have allowed civil courts to rule over football matters.

Someone posted the other day that there is roughly a three-week period between a business (in this case Rangers In Administration) finding out the result of a tax appeal and the information going into the public domain.
This business today, Green’s failure to meet the CVA deadline for 6 June, and hints that he is about to ‘walk away’, along the sudden lack of media spin over the takeover during the past week makes me think the Huns have been given the bad news.
Maybe we’ll all know the result in 10 to 14 days. Either way they are history.

However, the SFA articles of association include a clause that a judicial panel can implement any sanctions they deem appropriate.
Rangers last week lost an SFA appeal against the punishment, which was handed down over their failure to pay £13million in tax last season.
The disrepute charge was one of five offences Rangers were found guilty of in relation to their financial affairs and the appointment as chairman of Craig Whyte, who was deemed unfit for a role in football by an SFA-commissioned independent inquiry over his previous disqualification as a director.
The initial three-man judicial panel, which also fined Rangers a total of £160,000, was chaired by a QC and the appeal panel chairman was serving judge Lord Carloway.
The appeal verdict stated: “Although the appellate tribunal has listened carefully to the representations from Rangers FC about the practical effects of the additional sanction, it has concluded that this sanction was proportionate to the breach, dissuasive to others and effective in the context of serious misconduct, bringing the game into disrepute.”
If the administrators have been in this with Whyte- as they are the only ones who result to benefit from liquidation- from the start then surely they have to make it look like they are on the side of the hordes…the hordes have been calling for “a war with the SFA” since the ban was announced- surely they are only playing to their audience. Green obviously pushed for this but I doubt Duff & Duffer put up much resistance. It serves two purposes: 1) makes it look like they are fighting the horde corner.
2) Virtually assures extinction day.

“We note Rangers FC’s initiation of proceedings at the Court of Session in relation to the sanctions imposed by an independent Judicial Panel, which were subsequently upheld by an Appellate Tribunal chaired by Lord Carloway.
“With Mr Regan, SFA CEO currently on the lash in Budapest with his mates, it would be inappropriate to comment further until he sobers up and realises what’s happening over here.”

Aye. It’s been a case of ‘after you Claude’ by everyone involved. But D&P have now decided to up the stakes considerably.
Surely to Ghod, Ogilvie will be forced to act. When I heard it mentioned this morning that thems were thinking of taking matters to the Court of Session my only thought was that the administrators have seen this as their “get out” clause. All and any opprobrium would then be directed by their follow followers at the SFA.

Just looking at the calendar – has this been engineered to create cash-flow or sweeten the CVA pot?
29th May – CoS = court hearing mid-June earliest?
30th May – SPL Members vote = suspended again (pending court action)?
1st June – transfer window opens = fire-sale of players?
6th June – original proposed CVA date = now deferred.
Could this be a move to enhance the ‘pence’ in the £1 payout to get the CVA through and force the SPL to vote for them at re-scheduled meeting (mid-June?) and give them time to subsequently withdraw the CoS action?
