Six Celtic fans

As six Celtic fans face the prospect of months in a Dutch jail if police evidence is preferred, take a look at this CCTV video from the Euro Pub in Dam Square:

This is no more than the strong bullying the vulnerable.  It is shocking and affected more than just Celtic fans, other innocent bystanders were picked on.

What can you do about it?  We’re looking for around 40 more bucketeers to collect before the Aberdeen game on Saturday for the legal defence of the six Celtic fans.  You’ll need to get to the stadium a bit early, bucket shaking will be required.  That’s all.

There is an interesting new post on TSFM on the Old Club vs New Club Rangers debate, it outlines the damage the SFA’s silence on this subject has done to Scottish Football, earlier in the week we had a debate on CQN vis~a~vis the SFA’s contribution, thought I’d put some meat on the bones of my argument.

     

     

    For me there is two parts to Rangers continuing as the same Club argument, 1, Company/Insolvency Law and 2. Association Football Rules and Regulations.

     

     

    Now for the purposes of Company and insolvency Law many learnered minds have opined on what constitutes a Club and whether that Club is or can be an entity seperate &/or distinct from the incorporated Football Club and can it be sold or transfered with other assets to a buyer, the fact that D&P believe they did this in Rangers case will give credence if not definitive validation that the Club was sold before the Company went into Liquidation.

     

     

    Though for me I believe the resolution of the continuation of a Football Club debate probably lies within the rules of Association Football, which interestley enough seem much clearer… the SFA Handbook of 2011/2012 documents these circumstances in the articles of association…

     

     

    Firstly what is a club? The definition of Club as defined in Article 13 of said Handbook.

     

     

    “club” means any club in membership of the SFA and any club in membership of an association in membership of UEFA and/or FIFA.

     

     

    So from the Rangers case perspective if they are members of the Scottish FA they are a Football Club.

     

     

    Secondly the transfer of a Football Club, Article 14 Prohibition on Transfer of membership deals with this.

     

     

    “14.1 It is not permissible for a member to transfer directly or indirectly it’s membership of the Scottish FA to another member or to any another entity, and any such transfer or attempt to effect such a transfer is prohibited, save as otherwise provided in this article 14. Any member desirous of transferring its membership to another entity within it’s own administrative group for the purpose of internal solvent reconstruction must apply to the Board for permission to effect such transfer, such consent not to be reasonably withheld or delayed. Any other application for transfer of membership will be reviewed by the Board, which will have complete discretion to reject or grant such application on such terms and conditions as the Board may think fit.”

     

     

    As we are not concerning ourselves in Rangers case with transfer of membership within it’s own administrative group (though many clubs do – up to and including Celtic) we are pretty much in the realms of….

    So from the Rangers case perspective, RFC Directors, D&P nor anybody else associated with that Company or Club can transfer Rangers membership Only the Board of the Scottish FA can if Rangers are a contiguous Football Club, their membership transfer was granted by the Board of the Scottish FA with whatever terms and conditions it felt fit, did this happen?

     

     

    All the Scottish FA have to do is confirm whether or not it granted permission for the transfer of membership.

     

     

    If they did it’s the same Club and further questions must be asked.

     

     

    If the Scottish FA didn’t grant permission for the membership transfer NewCo are a different Club.

     

     

    It all comes down to the SFA who need only answer a straight forward question – Did your Board grant permission for the Transfer of Rangers Football Club’s membership to SevCo?

     

     

    Simples.

    cited by UEFA as possible culprits.

    announced that six clubs involved in

     

    the 2013/14 UEFA club competitions

     

    have been referred to the CFCB

     

    adjudicatory chamber,” UEFA said in a

     

    statement, adding that a verdict is

     

    expected in all six cases before the end

     

    of the year.

     

    UEFA said the cases of a further 25

     

    clubs who had possibly been in breach

     

    of the rules had been closed.

     

    While the overall impact of the

     

    financial fair play rules continues to

     

    be hotly debated, UEFA has

     

    consistently pointed to a fall in

     

    outstanding debts as proof that the

     

    rules are benefiting the football

     

    business generally.

    Not certain ( I would have to check ) but I think the definitions in those rules were changed post the insolvency of Rangers PLC.

     

     

    Pretty sure that there has been an amendment which perpetuates the difference between a club and a company.

     

     

    Needs checking.

    It would have saved the SFA a lot of money in lawyers’ fees if they had just left the old rules as they were and simply insterted [Rangers/Sevco excepted] after each clause.

  12. If we made a European final in Amsterdam there would 100, 000 plus fans would travel without a ticket. They’d be entitled to do so and expect to be treated humanely. Rightly so. No fans would have gone to Amsterdam with any other intention than to have a party. That the Dutch police decided to carry out their business in a thuggish manner reflects badly only on them, and does not warrant any questioning of why many chose to go without a ticket.

     

     

    Whilst I could understand any of the convicted fans choosing not to return for trial, given the shambolic course of events in Holland yesterday, I truly hope they do return in order that witness statements and video footage can be witnessed and they can gain compensation and clear their names.

     

     

    Given what we have seen and heard from reliable witnesses so far, and that includes the ridiculous admission of police violence against our support, it is in the interests of ALL fans of all clubs that the truth outs in this case.

     

     

    In everything I have seen and heard so far, my only condemnation of any of the convicted is for the bhoy who threw the bottle. Whilst I can empathise with his panic at what was happening, he shouldn’t have launched the bottle.

     

     

    Maybe we should call in the mayor of Seville as a character witness…….

    I recall a fan of the former club say to me, ‘you lot just behave abroad in Europe to try and make us look bad’? You know he might have had a point in that I have seen some self policing when someone may have been getting a bit over excited and were reminded of their responsibility to preserve our name.

     

    So your point about Sky and the media reporting of any incident involving Celtic is very true. Any opportunity to deflect attention from their numerous shameful and disgraceful episodes and discredit our amazing reputation is grabbed with both hands.

     

    The Celtic family is a special family who need to stay together and strong.

    Yes the Dutch system is inquisitorial.

     

     

    Interestingly my brief research showed that the Dutch have hardened their laws significantly in recent years with a far harder view being taken on crime and a policy that allows far less tolerance of criminal behaviour than before.

    My favourite bit of wisdom from Duffield last night was the suggestion that with the passage of time the Liquidation of Oldco will be pretty much forgotten. It will be looked back on as a minor embarrassment, similar to their defeat by Berwick Rangers in 1967.

    I mean no criticism towards Celtic fans when I say that – maybe todays fans are just a tad

     

    too ‘happy-go-lucky’ for their own good ?

     

     

    I mean – in the days of the Jungle – the cops wouldn’t have come near them – except when they tried to attack the disabled section on Janefield Street in 1985 and, even then the cops were chased off the street by outraged supporters.

     

     

    Nowadays the fans are in the main – student types. imo

    You make a point that is of crucial importance for the future, starting with Barcelona.

     

     

    We cannot rely on the Scottish police or the Scottish media to help us in future away fixtures. As part of self-policing, we have to pick up all the intelligence ourselves and spread the word to the Celtic faithful.

     

     

    We have the resources because we have clever people everywhere. Every time the team goes to Europe, we have to ask ourselves what the visiting supporters need to know about staying safe and staying on the right side of the law. We need to find out and we need to pass the information on.

    A blow torch wouldn’t give these people a red neck.

     

    They follow a brand new club,

     

    – all debt written off,

     

    – generate £27M in a year,

     

    – spend all of it, in a year,

     

    – complain they were hard done by,

     

    – show no contrition for any wrongdoing or attempt to apologise

     

     

    They will never forget, there fans still see that they have been victimsed.

     

    They will remember what they want, Lawell, The SFA, all SPL clubs, Dundee Utd.Steven Naismith, all kicked them when they were down.

     

    They will remember that they started at the bottom and brag what a great achievment it was to rise again, in spite of everyone else, to the top of the SPL and Europe.

     

    They will ensure that everyone else remembers this also.

     

    They will forget they paid no tax to keep the club afloat, used EBT schemes to gain sporting advantage, were allowed entry to a league where they had no right to be.

     

     

    This will not be known as a minor embarrassment by Rangers it will be heralded by them and the MSM as the greatest achievement ever, and the rest of us will need to live with it!!!

    Believe you are correct I will double check, however the Handbook I used was issued in June 2011, the Handbook was reviewed and issued anew on July 2012.

     

     

    Rangers F C PLC’s assets were sold to SevCo in June 2012, so presumably the 2011 Handbook is the one that dictates the transfer process, however as we don’t know the date of the transfer or issuing of new membership to NewCo I can’t say definitively.

Commercial Brisbane was delighted (believe me when I say they were delighted) because the time of year Celtic came is recognised as a flat period in the commercial calendar. For a few nights before the game thousands of Celtic Supporters drank, sang, and danced, their fill. And not a single arrest that I am aware of, apart from of course CQN’s very own… MattE, who was caught doing the speed of light down the M1, he was let off with a warning and two bottles of Jacob’s Creek.
