SPL Commission, where are we?

We’ve not really discussed the enormous political and disciplinary matters hanging over Scottish football since before our Champions League campaign got underway but it moves to the fore today, as the SPL Commission, headed by Lord Nimmo Smith, sits to consider charges levelled by the league against former member, Rangers FC.  The Commission is expected to conclude by the end of this week.

Rangers are charged with improperly registering players by allowing footballers to enter into contractually binding agreements to receive money in connection with the game, directly or indirectly, without registering these agreements with the SPL or the SFA.

Playing an improperly registering footballer voids the result of a match, no matter how innocuous the registration impropriety is, as Spartans discovered 14 months ago to their cost.  They saw their Scottish Cup win over Culter overturned because a player’s registration form was dated only once, not twice as required.

As well as being awarded a 0-3 defeat, the improper registration of players will cost the offending club any prize money ‘won’ and will result in a disciplinary measure being imposed.  Spartans were fined £4000, approximately 20% of their annual income, and were suspended from the competition for 12 months.  A steep tariff for leaving a box on a form empty and fielding a player in one game of football.

Lots of speculation has centred on the so-called ‘stripping of titles’ but in the event the Commission upholds the charge the voiding of results will happen as a matter of consequence; it should not subject to speculation.  What is more interesting is the size of prize money the league would seek to reclaim, and redistribute, and any penalty imposed by the Commission.

SPL teams receive prize money based on their final league position, funded by the league’s TV deal, which for teams finishing in the top two positions is well in excess of £1m each year.  Any ‘stripping of titles’ is likely to be a headline grabber, but the repayment of prize money and disciplinary measures will be far more significant, for some.

Sir David Murray, who owned Rangers throughout the period of alleged improper registration of players, insists the club registered all contractually binding payments players received in connection with playing football.  SFA president, Campbell Ogilvie, was an executive director of Rangers for some of the period under investigation and may have been responsible for some registrations.

Charles Green rejected an offer to limit the consequences of the charge being upheld in return for his company (then called Sevco 5088 Ltd) acquiring the SFA membership vacated by Rangers.  We will soon discover if he is master of the Cunning Plan or an over-ambitious gambler.

I expect calls for SPL and SFA rules to be upheld without fear or favour to be met.

    Bit annoyed at the way things go on here, we have great result in europe an lenny and the bhoys are worldveaters and capable of anything.

     

     

    Bad performance and result and the players a getting called diddies and all sorts.

     

     

    The extremeists on here need to learn that we have young coaching staff and very young squad who will make loads more mistakes between now and end of season,some will effect us and some with abit of luck we will get through.

     

     

    Theres been alot of positives this season and alot more goodtimes to come.

    Some misunderstanding on my comments yesterday regarding Nimmo Smith’s brief.

     

     

    To be clear: He has been asked to consider Rangers’ use and alleged non-disclosure of ‘EBTs’ from the period November 2000 to May 2011, but because the relevant FIFA (and SFA) Registration Rules and the SPL’s own Rules changed periodically throughout that time, he requires to consider the use of EBTs against the rules that applied during 3 distinct periods:

     

     

    Nov 2000 to May 2002

     

    May 2002 to May 2005

     

    and May 2005 to May 2011

     

     

    FIFA introduced a new standard form of contract for all players worldwide in year 2000, and this form together with the associated rules have been amended a number of times since.

     

     

    While I do not have the relevant Rules from each organisation for each period of time to hand, clearly the rules developed and were amended over time, and what constitutes a breach today, may not have been a breach in say 2001.

     

     

    Moreover, the rules tying the eligibility of players to proper registration is not consistent across the 11 years of the enquiry. So for example, while non-disclosure of EBT arrangements may very well have broken the rules in say, 2003, and thus be liable to sanction, it does not necessarily follow that the player was ineligible to play.

     

     

    Nimmo Smith’s brief includes a specific allegation that players may have been ineligible to play as a consequence of non-disclosure of the payment arrangements from the period May 2005 onwards, indicating that the rules of registration were amended as of May 2005 to incude the issue of eligibility with regard to improper registration.

     

     

    The relevant wording in the SFA/FIFA rules being: “… a Registration Form will not be valid unless it is accompanied by the contract entered into between the club concerned and the player stating all the terms and conditions…”

     

     

    This is reflected in the SPL’s Rules as: “…A Club must, as a condition of Registration and for a Player to be eligible to Play in Official Matches, deliver the executed originals of all Contracts of Service and amendments and/or extensions to Contracts of Service and all other agreements providing for payment…”

     

     

    There are a number of other rulkes referencing similar or related issues.

     

     

    Prior to May 2005, while there was a requirement to lodge the documents in full, it appears likely that non-conformance did not automatically invalidate the players’ registration.

     

     

    Consquently, Rangers’ might very well be found to have breached registration rules from 2005 onwards, causing their players to be ineligible to play, and thus necessarily and automatically voiding the results of games in which ineligible players participated.

     

     

    However, had Rangers fielded the same player in the same circumstances in previous years, while they will have broken the relevant rules, the player may not have been specifically ineligible.

     

     

    Nimmo Smith then has been asked to determine the facts as they relate to 3 specific periods of time, apply the rules of that time, and come to a view on what if any breaches occured.

     

     

    If players were fielded ineligibly, it seems unlikely that there is any other option but to void the matches as a precedented consequence, but this will likely only apply to the period from May 2005.

     

     

    Thereafter, the issue of sanctions arises for these and prior breaches of rules, and over to LNS and his two pals to figure out what is appropriate from the range of sanctions available per the applicable rules.

     

     

    So, from May 2005, non disclosure invalidates the registration, meaning players are ineligible to play, causing voided results. Other sanctions as considered appropriate.

     

     

    Prior to 2005, whatever the applicable rules say, and whatever sanctions are provided for.

    THE young Hoops extended their lead at the top of the Under-20 Scottish Premier League table, with a 3-1 victory away to Kilmarnock.

     

     

    The home side opened the scoring with a penalty, but Tony Watt responded instantly with an equaliser at the opposite end. Paul George then put Celtic into the lead and Bahrudin Atajic added a third to seal the victory midway through the second half.

     

     

    Kilmarnock were reduced to 10 men in the closing stages when Chris Johnston saw red for a challenge on George. The Celtic goalscorer was unable to continue, but with three substitutions already made, the Hoops were forced to see out the match with 10 men.

     

     

    Watt was just one of the first-team players Stevie Frail and John Kennedy named in their starting XI. He started alongside Miku up front, with Dylan McGeouch slotting into central midfield.

     

     

    Despite this, it was Kilmarnock who took the lead in the 15th minute after being awarded a penalty for Michael Miller´s handball. Slater converted from the spot curling his effort around the outstretched Leo Fasan.

     

     

    But within seconds Celtic responded, with Watt twisting and turning away from his marker inside the opposite box. He fired low and levelled the game with a confident finish.

     

     

    Five minutes later though, the striker had less joy in front of goal, heading Miku´s cross wide of target despite the open net in front of him.

     

     

    Miku then provided another good cross just before the half-hour mark and this time it set up the goal which put Celtic into the lead. George charged in to meet the ball and slammed it home to make it 2-1.

     

     

    The Venezuelan striker then missed a chance of his own though, collecting the ball a yard from the empty net. He tried to control it before tapping it in, but instead sent it past the post.

     

     

    Killie´s Johnston had the opportunity to draw his side level shortly before the break but Fasan did well to catch the dangerous dipping effort and the Hoops went into the break with the advantage.

     

     

    Watt was replaced at half-time by John Herron before Lewis Kidd came on for Miku on the hour mark. And just seconds later Atajic almost extended Celtic´s lead, firing low from an acute angle. Anssi Jaakkola did well to collect the shot though.

     

     

    It was a quiet second half with not many chances at either end, but Atajic brought the game to life again on 76 minutes. Kilmarnock were sitting deep and making it difficult for the Hoops to break them down, but the striker latched on to Stuart Findlay´s long ball and perfectly chipped Jaakkola to extend Celtc´s lead to 3-1.

     

     

    Johnston´s challenge on George then saw him sent off eight minutes from the end. He went in side-footed and caught the midfielder´s knee. George was unable to continue, leaving his side also closing the match a man down.

     

     

    But it didn’t make a difference to final result as Celtic already had the points secure and the win sees them retain their place at the top of the league table.
