The Juninho EBT

I see several “fans’ groups” are engaged on the subject of our old friend, Juninho, who played around 13 games for Celtic eight years ago and benefited from an Employee Benefit Trust before and during his time at the club.

Can you believe this is where their focus is?

As Sir David Murray and a gaggle of his former directors will tell you, there is nothing illegal in EBTs, it’s the undeclared second contracts the football authorities have a problem with. Juninho’s EBT was not subject to any contract or side letter whatsoever. Moreover, our then chairman, Brian Quinn, regarded EBTs with suspicion and instructed the club to declare Juninho’s to the Revenue. Celtic even paid tax on money paid to the EBT.

The SFA and SPL, and every journalist in Scotland interested in getting a story right, are fully aware of the facts.

I suppose running with this beats looking at links between Green and Whyte. Keep up the good work, guys!

And for the record, stripping titles is not the ultimate sanction, not by the length of Argyle St.

    Whilst I see our alleged “use” of EBTs as entirely different from the practises at the Dead Parrot FC, is it not undeclared payments for footballing activities that they have a problem with regardless of whether contracted or not? E.g. if we paid Juninho monies via an EBT that were neither detailed in his contract nor in the paperwork filed with the SFA then we would be in breach of the rule?

     

     

    Given the SFA / SPL wrote to each club to request info on payments made via EBTs and can compare this to the papers filed with them at the time for the period in question I can only assume we have no case to answer or we would have heard about it by now but to me your article is too carefully worded and not unambiguous enough to put out the fire some are trying to start.

    IMO I don’t see why not. The SPL investigation is into the registration of players, the FTT is to declare on the Tax bill issued to Rangers and subsequently appealed by them

    Yes.

     

     

    So there are two issues here:

     

     

    1) Tax compliance – Celtic complied with the law of the land. HMRC argue that Rangers allegedly didn’t. Hence the court cases.

     

     

    2) The rules of football. Since Celtic were careful to pay tax on Juninho’s EBT I can’t imagine why they’d want to hide the payments from the SFA.

That game against Aberdeen marked the first game where the EBT scheme that is the subject of the ‘Big Tax Case’ interfered with the Scottish Premier League.

     

    Harper McLeod should take a look at Nerlinger’s contract filed with the SFA. Next they should obtain Nerlinger’s contract documents and payment history from Rangers FC (IA)’s administrators. Comparing the contract to the payment history alone will expose payments of well in excess of £1 million that are not listed on his SFA-registered contract. There is your prima facie case, Mr. Doncaster. There is no need to investigate any further to demonstrate that Rangers have a case to answer and that an independent inquiry is required.

     

     

    The above was posted by RTC in an article in May. It is specific and it is accusatory. Murray should come out and be as specific in a denial.

     

     

    However, he won’t . Partly because he won’t take questions, and partly because when the FTT report, the Internet Bampots and the legal tribunal will be perfectly aligned.

    If it’s based on facts, the facts could only have come from Celtic.

    As I’ve said, if Celtic were to comment on every rumour or chinese whisper, then it would set a precedent which could come back to haunt them.
