Then there were two: Rod Petrie steps forward

Hibernian chairman, Rob Petrie, yesterday told BBC Radio Scotland “Integrity is beyond purchase”.  It’s incredible to think that we live in times where this is actually news.

It’s hard to imagine how anyone would go about arguing with Rod on this matter.  Kilmarnock chairman, Michael Johnston’s recent comment, “The [SPL] clubs are mindful of a sporting integrity aspect but the commercial benefits may outweigh that” offers the alternative view, but the logical conclusion of Petrie’s argument is stark.  If integrity of top clubs can be purchased, what about officials, referees and players with bookmaker friends?

We can assume Hibernian will join Celtic in voting against admitting a Newco directly into the SPL, should such a vote occur.  Five clubs in total are required to block such a proposal.  With Petrie declared against, would Romanov at Hearts vote for Newco?  His previous public pronouncements suggest he would relish the opportunity to take on one of the big Glasgow clubs.

Dundee United and Aberdeen are two other clubs under significant supporter pressure.  Both teams are also keen to change the 11-1 voting rule, which would be possible without a Newco.

Rangers, Kilmarnock, St Johnstone (through manager Steve Lomas) have all declared in favour of admitting a Newco, I expect Motherwell and St Mirren will do the same.  Ross County and Inverness may fancy adding Dundee into next season’s relegation fight instead of Newco but there has been no indication how either club would vote.

The 7th May vote was the best chance of getting Newco provisions voted through.  The more time clubs have to consider the decision the more susceptible they will be to supporter lobby.

I am of the view that SPL chief, Neil Doncaster, will not allow himself to become aware if Rangers have a prima facie case to answer as a result of the SPL inquiry into contractual arrangements until after a vote is taken.  Deadline for clubs to respond to the inquiry passed over five weeks ago. A simple check of submissions against SPL records is all that is required. Even if each clubs issued an all-clear, the inquiry should have reported.

Doncaster perhaps has no idea of the flood that will come his way soon and wash away all of these questions. His opportunity to act before events overtake him is limited.

  1. like the sound of the 19year old from rosenborg wee are sipposed to have bid for ! already 6 caps for norway and if my maths are correct 187 cm works out at 6,5 ! big bit of a boy then, looking strong in midfield with him and big victor , shouldnt be bossed around with those two playing.

    OK, promise that this the last time I beat this particular drum but there is nothing to stop them from limping along in administration for another ten months or so before having to go back to court for an extension…….

     

    Other than a lack of funds to continue trading of course…

     

    ‘The Bail Out Philosophy’ should take care of that…

     

    With a wee bit of help from the brotherhood…….

     

    Anyway, we’ll see eh!

    I have just finished talking to my brother (today) – a Rangers supporter for over 40 years and he has just told me that Motherwell were STILL in administration and only oficially declared themselves OUTof it a couple of months ago i.e. AFTER Rangers went into administration and COULDN’T play in Europe giving Motherwell an excellent chance of a CHAMPIONS LEAGUE spot ……. IS THIS TRUE?

     

    He also said that if Rangers weren’t in the SPL then 5 clubs would go OUT OF BUSINESS – namely Dunfermline ( now irrelevant due to relegation); Hearts; Dundee Utd; Inverness CT and Kilmarnock so all would vote for a Newco in the SPL.

    Answering my own question in 1897 Celtic paid ~£5M [in modern prices] to purchase the ground to build the stadium. Givne that the Club was barely 10 years old, and it’s core support was very much at the bottom of the Scottish pile in terms of earnings, this was an astonishing feat.

    I totally agree that this issue ought to be decided by the SFA’s Independent Tribunal system, applying the rules of the Game as applicable at the relevant moments in time. Asking 11 SPL clubs, the Trade Associaiton effectively, to stand as self-interested jury on the trial of their biggest business partner, is an abject failure of good governance.

     

     

    That said, if the SPL clubs were to Vote No to NewClub, NewClub would be consigned to the bottom of the SFL. As OldClub would be dead, excommunicating it post mortem and banning its former Directors is only difficult with regard to heavily conflicted Campbell.

     

     

    It is the wrong way to go about things, but the end could conceivably be the correct one.

    We have a potential group og buyers who are offering £x amount of money. The message to the creditors is that the offer is (1) better than van be achieved via liquidation / asset sale and (2) the best that the group are prepared to offer.

     

     

    It is (2) above that the creditors need to make a decision on, and they will always seek an informed decision.

     

     

    Our 2 biggest creditors are Ticketus and HMRC. For Ticketus, a decision on (2) is likely to be no more than a punt. but for HMRC, they will be desperate to know who the investors are. They will know or will have access to the investors wealth either directly (UK residents) or indirectly (non UK residents0. So if the investors are of high wealth, it is unlikely that HMRC will accept the first cash-pot offer in a CVA. And we don’t have time to go back in with offer #2!

     

     

    So the sfa should but out until it affects them, and that is only if and when any investors becomes a director and when or if any such director seeks an official post.

    In early 2008 it was revealed by the administrator, Wilson Field of Sheffield, that Gretna had creditors of nearly £4m and assets (Raydale Park) of less than £1m. HM Revenue and Customs was owed nearly £600,000 in total, and it was their threat to wind up the company that precipitated Gretna’s move into administration. On 8 May, the administrator set a deadline of 17 May for a buyer to be found, or the club would be liquidated.

     

    After that deadline passed without a buyer making a firm offer, all the remaining employees were made redundant, but it was reported that the club were still negotiating with an interested buyer. On 29 May, Gretna were relegated to the Third Division due to their financial struggles, with the Scottish Football League threatening expulsion should a takeover not be completed within a week. After a takeover bid fell through on 1 June, the administrators confirmed the following day that they would look to sell Raydale Park to someone who will use the site for something other than football.

     

    Gretna resigned from the Scottish Football League on 3 June. Near neighbours Annan Athletic won the vote to replace Gretna in the Scottish league. With no ground, staff, players or a competition to play in, the club’s dissolution was inevitable and the club was formally liquidated by the administrators on 8 August.

  22. These poor SPL clubs who insist they will go to the wall without Rangers should voluntarily relegate themselves to whichever lower league NewClub is put into. Here, they can continue to feast on their beloved motherclub.

     

     

    This would then allow other clubs who have lived within their means, without relying on Rangers, to then take their place in the SPL. :-)

    Following on from scepticism that the SPL Inquiry is so big that such an audit of 75 or so transactions would take many, many months, over to Government to show us how it’s done.

     

     

    The following link explains how DWP has carried out an audit on A4E’s delivery of the Mandatory Work Activity contract in the South East of England.

     

     

    The audit covered payments to THOUSANDS of people on the scheme since 2010.

     

     

    The Audit was initiated after DWP received an allegation of improper practice against the company EARLIER THIS YEAR.

     

     

    You know the SPL is unfit for purpose when they cnnot match the Quality Assurance performance of the DWP, no disrespect to the fine CQNers who provide so many of the DWP’s important services.

    We appear to be agreeing. Newclub, without a place in the SPL, needs to apply somewhere for a place to play. The only place is the SFL, unless they want to try some English backdoor thing.

    Pretty much as happened with teh Gretna situation, albeit no one ever suggested breaking every rule in the book to help them out. Gretna fans incidentally put together a NewClub and now play in one of the Amatuer leagues.

  27. Livingston have written to the Scottish Football Association warning they may take legal action if the governing body fails to act upon Rangers’ financial woes appropriately.

     

     

    STV understands the First Division club have outlined they would pursue up to £1.2m in lost revenue for their relegation to the Third Division in 2009 if the SPL side are not dealt with in a similar manner.

     

     

    The decision to demote Livingston, who were in administration but in the hands of prospective buyers, was made by the Scottish Football League prior to the start of the 2009/10 season.

     

     

    A failed appeal to the SFL was followed up by a submission to the Scottish FA, who ruled the punishment was fair and reasonable.

     

     

    The governing body’s judicial protocol was given a complete overhaul last year and insolvent clubs, as well as any appeals processes, are now handled in a different manner.

     

     

    Nonetheless, Livingston believe a precedent was set in the judgement and have now stated they are monitoring how the Scottish FA are handling the Rangers situation, as uncertainty over the future of the club continues.

     

     

    If prospective buyer Charles Green is unable to strike a deal with creditors to take the club forward via a CVA, it is possible the businessman will pursue a ‘newco’ route to ensure the club continues as part of a new company.

     

     

    The move, which would be unprecedented in Scottish football, would require Scottish FA approval to go through if the new company wished to inherit Rangers’ membership of the body and could be subject to further sanctions.

     

     

    Rangers have already been punished by both the Scottish Premier League and Scottish FA for being in administration, with the latter recently administering a 12-month registration embargo and fines reaching £160,000.

     

     

    Rangers’ appeal against the Scottish FA’s sanctions, which were described as to have “struck a balance which was relevant to the mischief and proportionate to the breach” will be held on Wednesday.

     

     

    The independent panel set up to consider the initial case against the club stated in their deliberations that “only match fixing in its various forms might be a more serious breach” than Rangers’ failure to pay tax contributions for employees, amongst other discrepancies.

     

     

    Termination of Rangers’ membership to play football in Scotland was also considered at the time, something which was ruled to be “too severe” a punishment.

     

     

    Both the Scottish FA and Livingston declined to comment on the letter.

    Could well be the clutching at straws – certainly NOT confused as he is the most INTELIGENT guy I know.

     

    He’s hinting that Murderwell never PROPERLY came out of administration and have, along with the SFA and SPL, known this for years but HAVE NOW as they can get the CL spot.

     

    Personally I think he’s trying to wind me up – but if there’s a chance he’s correct…… although he DIDN’T mention the LIVVI situation.

    I like Rogne and I like Mulgrew, but we’ll need to upgrade the Sieve to make headway in the ole ECL.
