Untenable president, repay your loans, Gratuitous Alienation

HMRC have confirmed their actions today leave open “potential investigation and pursuit of possible claims against those responsible for the company’s financial affairs in recent years”.

Chances are, HMRC will investigate the actions of SFA president, Campbell Ogilvie, more thoroughly than the investigation carried out by the Association which allowed their chief executive, Stewart Regan, to tell the media that:

“We are all aware of businesses being run where you have one owner and operator running the club and a number of directors sitting below. The way this process has been managed, a lot of this correspondence was done much higher up the chain than Campbell Ogilvie.”

Stewart (if I can be familiar), you’re better than this.  Try reading this story one page ahead, figure out where this one is going and start acting accordingly.  Of course, President What-school-did-you-go-to then told Scotland on Sunday:

“I might have signed some documents from time to time”.

Mr Regan had better make sure he knows what Mr Ogilvie signed, and I recommend he doesn’t relay exclusively on Mr Ogilvie’s memory.

Untenable

“Those responsible for the company’s financial affairs in recent years” includes Mr Ogilvie throughout his period as a director of Rangers.  His position has been untenable for months and his continuing presence at the top of the Scottish FA only further contaminates those who claim otherwise.

The former directors of Rangers will not be the only ones alarmed at this development, recipients of EBTs (including the directors, who will have a second matter to consider) have reason to be concerned.

Not only do Her Majesty’s officers want any potential wrongdoing investigated, they also want their money.

Rangers EBTs were a loan.  HMRC will tell recipients of this loan that their side letters (you better believe they’ll all find those side letters now) are not worth the paper they’re written on.  If the money was indeed a loan, a demand for repayment will be made.  If this is disputed, you can expect to hear the phrase Gratuitous Alienation to enter the lexicon soon.  Gratuitous Alienation is the Scots legal term describing when property (or cash) is transferred to another party without any, or adequate, consideration.

I hear HMRC have all their ducks lined up for this one.

Internecine strife doesn’t begin to describe how things will end up.

In amongst the euphoria it seems that a much publicly maligned man who loved his club that much that he walked away must be sitting back with mixed emotions and wondering where it all went wrong. In amongst all the lies and deceit and hubris he came across as an honest man who tried to keep his club honest. It was he, in 2002, that opened the can of worms that brought the forces of the crown crashing down on Rangers FC in 2012. A decade has passed with him in cultural exile. I’m not too sure if he will be happy with what has happened but – sure as hell is hot for the damned – the warnings of Hugh Adams back in 2002 have now been unequivocally vindicated.

     

     

    Maybe now the MSM will stop ridiculing him and pay due credence to what he said about the dual contracts. Remember, he never hid and he named names, he all but called Sir David Murray out as Lucifer and he did it both in the press and on camera.

     

     

    I wonder if the MSM still think he is just a confused old man with a grudge.

     

     

    Not many will give you a thought today Mr. Adams but tomorrow countless thousands will with they’d listened to you all those yesterdays.

    HMRC will now look after RFC (deceased). Our focus must now be on Newclub, let the taxman now take care of the remains.

     

     

    We need to pressure the footy guys now ( SFA/SPL ).

     

     

    Double contracts during past 12 years ( at least).

     

    No to Newclub skipping past 30 other Scottish senior clubs into SPL.

     

    Removal of honours from old club for period 2000-2012 (at least).

     

    No compromise on integrity of a game and competition I love, football.

    Today we have to thank Sir Minty who turned down Alistair Donald ( ex CEO of Accenture ) planned £40m investment in RFC. Instead he said no and 6 months he handed it to the shyster Craig whyte ( as Alistair Johnstone emailed Dermot).

     

     

    Why did Sir Minty turn down a serious business dude for a shyster ….HMRC will have figured that one out. Minty as he will be known as shortly will need to find a good lawyer.

    To satisfy the other clubs that Newco represent no risk, Newco would have to reveal to all the clubs their business plan, their income and expenditure projections and the SFA would have to conduct a licencing exercise to inform the SPL of any risk they are contemplating taking and the SPL would be foolish not to ask for a full licence report so it is by no means a given that Newco, who cannot be granted a licence by the SFA, will be voted into the SPL.
