Untenable president, repay your loans, Gratuitous Alienation

HMRC have confirmed their actions today leave open “potential investigation and pursuit of possible claims against those responsible for the company’s financial affairs in recent years”.

Chances are, HMRC will investigate the actions of SFA president, Campbell Ogilvie, more thoroughly than the investigation carried out by the Association which allowed their chief executive, Stewart Regan, to tell the media that:

“We are all aware of businesses being run where you have one owner and operator running the club and a number of directors sitting below. The way this process has been managed, a lot of this correspondence was done much higher up the chain than Campbell Ogilvie.”

Stewart (if I can be familiar), you’re better than this.  Try reading this story one page ahead, figure out where this one is going and start acting accordingly.  Of course, President What-school-did-you-go-to then told Scotland on Sunday:

“I might have signed some documents from time to time”.

Mr Regan had better make sure he knows what Mr Ogilvie signed, and I recommend he doesn’t relay exclusively on Mr Ogilvie’s memory.

Untenable

“Those responsible for the company’s financial affairs in recent years” includes Mr Ogilvie throughout his period as a director of Rangers.  His position has been untenable for months and his continuing presence at the top of the Scottish FA only further contaminates those who claim otherwise.

The former directors of Rangers will not be the only ones alarmed at this development, recipients of EBTs (including the directors, who will have a second matter to consider) have reason to be concerned.

Not only do Her Majesty’s officers want any potential wrongdoing investigated, they also want their money.

Rangers EBTs were a loan.  HMRC will tell recipients of this loan that their side letters (you better believe they’ll all find those side letters now) are not worth the paper they’re written on.  If the money was indeed a loan, a demand for repayment will be made.  If this is disputed, you can expect to hear the phrase Gratuitous Alienation to enter the lexicon soon.  Gratuitous Alienation is the Scots legal term describing when property (or cash) is transferred to another party without any, or adequate, consideration.

I hear HMRC have all their ducks lined up for this one.

Internecine strife doesn’t begin to describe how things will end up.

    Earlier,after I heard the news and had a quick jump about the blogs, I went out with my lovely wife and celebrated.

     

    If I still smoked I’d have had a cigar. If I still drank I’d’ve been intae it.

     

    Instead we went and bought the dvd of “Game of Thrones”,had a lovely meal in a nice wee restaurant,and went to see ‘Prometheus’ in 3D. Then we came home and….

     

    Anyway,what a day in my wee life. One of the best. Much more to come,but in the meantime,I’ll savour this one.

  4. I sincerely hope Thatcher is in pain and her death is prolonged and awful. Karma is a bitch and we all will have to pay for our actions in one way or another. I would never do anything to harm any old woman, but am just glad that there is some justice in the world, and that that oul bitch is now receiving a good dose of it.

    Of course, this goes to the heart of our justice system, but greater understanding might create fewer criminals.

  11. Been reading back on all kindsa stuff re. today 12/05/2012(!),and a wee fact that even the most optimistic,in denial hun ignores. Even IF some kinda tainted-forever no-shame ‘newco’ is raised,zombie-like,they still have to apply to join the SFL if their masonic angels in the SPL don’t fly to their aid.

     

    There are no more ‘givens’ for that lot…the days of ‘entitlement’ are gone.

     

    They are gone. They may not be back at all. Now THERE’s a thought!

  14. Am obviously glad that HMRC have ensured that the huns have expired, however really don’t understand the following from them:

     

     

    HMRC also revealed it was not contesting Mr Green’s purchase of the club and was not interested in forcing a fire sale of assets such as Ibrox and Murray Park as “the intention is not to wipe Rangers off the face of the map”.

     

     

    Why are they not contesting this sale ? It seems obvious to me that this is a sale of the assets of the company at a level significantly below the actual market value ! Why therefore are HMRC not trying to maximise their return ? and can the other creditors (e.g. Ticketus) not do something to stop this sale also ? Surely the best option for the creditors would be to remain in administration until all the players could be sold (realising somewhere in the region of GBP 10 million) and then sell off the other assets to the highest bidder ?

     

     

    Would love to hear from someone with experience of liquidation as to how this sale to Green can be considered to be in the best interests of the creditors – it is afterall the creditors who are meant to be of paramount importance in the whole administration process. Surely this cannott be allowed to happen ??

    The newco would have to request a transfer of Rangers’ share in the SPL. The SPL will then vote on whether to admit the newco to the top-flight. The SPL rules require eight of its member clubs to vote in favour of a share to be transfered to another company or club. This would require seven other SPL clubs to vote in favour of transfering the oldco’s share to the newco, since Rangers will have a vote.

     

     

    How is it conceivable that a non-entity can have a vote?

    Is it just the clubs that vote?

     

    Why does one need a vote? Isnt it against the rules?

     

    Doesnt Celtic participating in the Vote even for a “No” legitimize the vote?

     

    Why are the huns allowed to vote? Isnt that a conflict of interest.

     

    So say it comes down to it.

     

    Celtic, Hibs, Hearts, Aberdeen, Ross County vote No (5)

     

    Motherwell, Kilmarnock, St.Mirren, ICT, St. Johnstone, Newhuns vot yes (6)

    Why trust what the BBC say about some newco getting a vote, it’s not like they or the rest of the MSM have been right and on the ballthese last 3 years. For a start which newco, and which new incarnation of rAngers will get the vote. Utter tosh, IMHO.
