Green, Whyte, Sevco 5088 and the St Mirren link

After 11 months of innuendo and unanswered questions the Sun today publish confirmation that Charles Green was a frontman for Craig Whyte.  The news will be a bombshell to many but few in the Celtic online community will be surprised.

The Sun today report that Craig Whyte and partner, Aiden Earley, are majority shareholders in Sevco 5088 Ltd, the company which bought Ibrox, Murray Park and other assets from Rangers’ administrators’ Duff and Phelps.

They also claim Charles Green subsequently transferred Sevco 5088’s assets into Sevco Scotland Ltd, which Whyte said was done without his permission.  Green was given considerable opportunity to respond to the claims but despite pages of comment does not deny the central claim that Whyte and Earley were majority shareholders in the company which purchased assets from Duff and Phelps.  The rest of the story amounts to little more than gratuitous detail.

Where does this leave things?

Whyte’s QC has started legal action, seeking control of Ibrox and other assets.

Duff and Phelps (presumably unknowingly) discretely sold Rangers assets to the man who appointed them and who is currently subject to an investigation into the collapse of the club.  Rangers’ liquidators, BDO, can cancel the sale of assets and claim them for creditors if they believe it was not conducted in an appropriate manner – and this is anything but appropriate.

When Sevco 5088 Ltd was negotiating with the SFA Green assured the SFA that Whyte was not part of his consortium.  This was a condition of the Newco being granted associate membership.  The SFA are now duty bound to investigate (although with president Campbell Ogilvie in place make no assumptions here).

What has any of this to do with St Mirren, you may ask?

St Mirren chairman, Stewart Gilmour, appears to have made a pact with Charles Green, who I hear has given Green his assurance that he will vote against league reconstruction plans, which the SPL are due to vote on 15 April.

Questions like who owns Ibrox, whether the Newco is a legitimate associate membership of the SFA, whether BDO will declare the sale to Sevco 5088 void, in the event this circus makes it to next season, whether anyone will buy tickets to the shambles, all remain unanswered….

…but Stewart Gilmour is making plans with Charles Green.  St Mirren fans should be outraged.  Mr Gilmour should be careful who he does deals with.[calameo code=0003901714557cf2d2048 lang=en page=134 hidelinks=1 width=100% height=500]

    Surely Mr Green has admitted that he fronted Sevco for the whyte knight, in the full knowledge that he himself couldn’t.

     

     

    A. Because as a Director of Rfcia he would be heavily conflicted and have arduous limitations on his bid.

     

     

    B. He had a sine die ban from Scottish Football and could not knowingly be part of a consortium to licence a football club.

     

     

    The fact that the planned Cva failed should not exclude bdo looking at the asset sale.

     

     

    And more importantly the sfa to reexamine their fit an proper person test.

     

     

    Surely as Mr Green has openly admitted to this sham Cva attempt, this investigation should be a matter of course.

  6. Whyte will go after his assets ; green should be in discussion with his solicitors before the serious fraud squad pay him a visit. This will end in the courts. I would not like to be one of those institutional investors duped by Green.

     

     

    However from a football standpoint the SFA Committed to ensure the new Rangers were clean. Remember the SFA were trying to force through a solution to put Greens club back in the SPL. Ogilvie and the SFA are complicit in Greens deception. With a nod and a wink Ogilvie has given them a licence and tried to help them up.

     

     

    The SFA will never investigate Rangers/ Sevco properly while Campbell Ogilvie is President. He is too heavily conflicted from EBTs to granting licences.

     

     

    Scottish Fooball needs a clean out from top to bottom with one structure; one executive committee and a transparent, trustful leader who commands respect. That cannot be Ogilvie ;his deceitful behaviour in legislating for a club based at Ibrox all his life is not credible. Turnbull Hutton could be a leader or even go outside football and bring in a respected scots person who could provide the direction to the Executive Committee.

     

     

    Ogilvie is a cancer at the heart of Scottish football.

    The SFA will do what it says on the tin i.e SFA and our game goes to hell in a handcart.

     

     

    What for? To put supporters sheckles into Charles Green or Craig Whytes pocket.

     

     

    Suspension of a licence for Therangers to operate next season has to be the SFA response until BDO sort out who owns what.

     

     

    This is to the benefit of all supporters including The Rangers fans whom I am beginning to feel sorry for now.

     

     

    The reconstruction vote has to proceed on the basis of what is good for Scottish football not what benefits the spivs in control at Ibrox, whoever they are.

    In April 2012, the SFA’s Judicial Panel published their Reasons for Decision on the matter of the conduct of Rangers and its Directors in the preceding year.

     

     

    Amongst other matters, the Panel found that the club had deliberately concealed the fact that Craig Whyte had been banned from holding the role of director, and thus failed the SFA’s ‘fit and proper’ criteria for football club directors.

     

     

    The Judicial Panel walloped Rangers with fines and a transfer embargo.

     

     

    The Judicial Panel also found that Craig Whyte: “…had brought the game of Association Football in Scotland into disrepute of the most serious kind, and that in doing so he had demonstrated a contempt for the sport and its participants, not least those with affinities to Rangers FC, it considered him unfit to be associated or involved with the sport in any way. It accordingly excluded him for life from participation in Association Football in Scotland.”

     

     

    Following this decision, Rangers were consigned to be liquidated and Charles Green’s Sevco consortium of investors purchased the assets and intellectual properties of the club from the Administrators. There followed an extended period of negotiation between Sevco and the Scottish Football authorities that ultimately created the basis for Sevco to field a team called ‘Rangers’ in senior football in Scotland, with participation at entry level of the Scottish Football League, together with a ‘transfer’ of Rangers’ SFA membership to Sevco, and a blind eye turned to the governance and financial requirements of Club Licensing.

     

     

    Less than a year on, we are led to believe, by his own admission, that Charles Green was in fact operating, in purchasing the club’s assets, as an Agent for Craig Whyte, so recently banned sine die from any participation in the Game at any level.

     

     

    As if we needed any further lessons, this is what happens when individuals and organisations are permitted to operate outside of the rules, with the sanction of the rule makers and rule keepers.

     

     

    I have no idea how this will turn out, but I am quite sure that this is simply the latest episode in a shameful soap opera that has many seasons yet to run.

     

     

    The SFA is empowered by its Memorandum of Association, which describes its purposes and the primary responsibilites of its office bearers, as follows:

     

     

    “To promote, foster, and develop, in all its branches…, the game of Association football, and to take all such steps as may be deemed necessary or advisable …for protecting it from abuses.”

     

     

    The SFA is thus compelled to act on these latest revelations. Suspending the membership of Sevco, and thus containing the damage and risk to the Game at large, may be the only reasonable action in the circumstances.

     

     

    I’ll away and hold my breath. Not.

    I have no pity for sevco fans. Their ill deserved superiority complex for many years. Their bury their heads in the sand attitude to everything that went on. Their bullying and threatening of anyone who said anything against oldco/ newco. Their threatening of staff in book stores for stocking Downfall. Their We are the people still the same club 55 and counting bullshit even though all facts prove differently.

     

    Some of my gers mates who were very liberal and always had a laugh after old firm games have become almost feral in the defence of the indefensible. Thanks to bluster from green and msm. Remember we are all jealous/ obsessed.

     

     

    No sympathy at all.
