Can History be bought, sold or transferred?

637

I was speaking to someone with only a notional interest in football last week who complained about football fans logic on several fronts including the notion of History.

I was asked, “What does it matter if a Rangers Newco playing at Ibrox being supported by the same people have an intangible claim to what happened in the past?

“Their memories remain, they cannot relive the past, what matters most is the future.”

Only a non-football fan could think like this, of course.  History is the context for whatever happens today, without it, the game is diminished, but we are now in a fascinating debate.  In practical terms, Rangers history could become quite a burden with the next few weeks.

The SPL are currently undertaking an inquiry into alleged illegal registration of players at Rangers during the 13 years before Craig Whyte rescued the club from the old board.  Hundreds of football matches could have been played, many trophies ‘won’ with footballers ineligible to play.

If these allegations are proven, games involving ineligible players will be marked as 3-0 defeats.  So much for the history, but what about the punishment?

Our friends at STV suggest that the SPL hold the view that the transfer of a league share from a liquidated company to a Newco would inherit historical rights from the liquidated party’s past.  For Rangers Newco, this would include penalties for around 500 games played by Rangers FC with invalidly registered footballers.

The tariff of which could sink even the healthiest balance sheet.

But still, if liquidated, Rangers FC, founded around 1872 and incorporated in 1899 would cease.  Newco can play wherever they like, it would be a new club.  The law would protect it from misdeeds of the old company while any assets, such as the badge design, film archive or historic Arsenal shares could be purchased by any third party, including Newco.  And before you bid, owning the badge design does not make you Rangers any more than if you acquired Rangers SPL share.

We’ve been told you can buy and sell history in recent weeks which is clearly nonsense but in finding a path through this subject you need to ask what is in the power of each and any organisation or group to affirm.

The SPL can transfer a share in the league and, in conjunction with the SFA, player registrations.  Both can also impose outstanding disciplinary measures.

Duff and Phelps can sell the badge design independent of the league share.

Craig Whyte can sell the stadium independent of all of the above.

No one can sell, buy or transfer 140 years of history, which is why football fans recoil at suggestions of a Newco replacing their team.

Would just like to opine that, the game in this country is going to die!

The huns/SFA/SPL/MSM/Government will kill the game but, I think that the Celtic directors are sitting on our ticket out of here, hence the silence.

I mean, there is NO way back from this! IMO!

I think the ENTIRE senior game in this country will die as a result of the, Biggest Football Scandal in history.

There will be a period of mourning and then, the Celtic hierarchy will reveal their hand….a invitaton to join the English League. At which level, I’m not too sure but, purely in the interests of public safety ie: the Celtic hierarchy couldn’t apply to join on our own but, it would be different if we were, invited and, I think that is where all this is going :o)))

Rangers can’t do walking away from the SPL

By Mark Hateley on Apr 13, 12 08:06 AM in rangers

IF RANGERS were an ordinary outfit without any class or dignity they would stick two fingers up to the SPL and head for the foot of the Third Division.

However, this has always been more than a club. It is an institution a way of life. Traditions are maintained that Scotland can obviously ill afford to be without.

There must be a strong temptation among the bidders vying for the club to conclude a deal and manufacture a siege mentality.

They would be wrong to do so but who could blame them? After all, with liquidation on the cards the SPL and SFA have done little to support its biggest member.

The SPL’s latest raft of hastily penned legislation means if the Ibrox club start next season as a newco they face two years with a 10-point deduction.

Also a loss of revenue for three seasons that could amount to almost £6million for the club.

The timing of the announcement has delayed the plans of administrator Duff and Phelps to select a preferred bidder and the timing is deliberate sabotage.

And as a result, Ally McCoist’s planning for the new season has been disrupted even further as at least another month is added to the time scale for him to select a squad for next seasons SPL assault

The proposed new rules are far too severe, although Rangers should not escape Scot-free.

A 10-point penalty for two years I can just about accept such a sever punishment give to Rangers will not go unnoticed and should help creditors come to terms with the good offer that will be coming their way

But more crippling points deductions and the withdrawal of 75 per cent of SPL funding smacks me as just too punitive.

Rangers have rightly been deducted points for entering into administration and will be penalised again if they are forced to liquidate all together.

But who at the SFA failed to conduct due diligence on the change of ownership of one of their oldest members?

What is Campbell Ogilivie playing at ? Does he think that this his EBT pay off was somehow illegitimate and if possibly found guilty all will be forgiven if we are all found guilty ?

    I don’t think so.

Rangers are rightly being taken to task for Craig Whytes woeful financial mismanagement but who is taking responsibility for the SFA’s role?

It has to be the head of the organisation.

But the worst request any new owner could make would be for demotion to the Third Division.

Rangers fans may have to write off title success for the next few years but they can blood their kids and fashion a new team in the SPL rather than at pitiful places such as Annan and Albion Rovers.

Supporters are going to have to suck up a lot of pain in the next couple of seasons as the club struggles.

Rangers can’t be transformed overnight yet in the fashion of Chelsea or Manchester City because new investors won’t have access to the billions of Roman Abramovich and his likes.

But they’ll hopefully have a wealth of integrity and decency and dignity and honesty which seems to be in short supply right now.

Of course its PR guff its from UEFA

2010 SFA-CEO Gordon Smith, President George Peat, Vice President Campbell Ogilvie, all three men could have sang the sash backwards they knew it that well, SFA 2012 we have Campbell Ogilvie president and Allan McRae (cove Rangers) vice president

Yeah the SFA can be relied on……………………..

  13. Protests should be organised against NewCo vy all 4 of the clubs contesting this weekends Cup semi’s at Hampden.

4 of Scotland’s biggest clubs will meet at the home of Scottish football. This is a chance to make this protest nationwide and possibly global. It’s a chance for all clubs to stick together and show their disgust at the new proposals.

I’m not sure what can be done but I would suggest complete silence when the teams emerge or the whole crowd turning their back on the play for a certain minute of the match.

It’s a massive opportunity to get the message out there. All clubs fans I have spoken to do NOT want them back in the SPL with any penalty. Even most Rangers fans I speak to think they should go down the leagues if there is a NewCo.

Salmond has cut his own throat this year with his sucking up to Rangers on the HMRC issue and the new football laws which penalise Rangers fans more than anyone because of their song choices. His party will suffer huge losses. No Tim I know is voting for his party even though some did last time (no idea why?).

Labour will romp it in Scotland at the next elections.

Interested to see what our old friend Mr Galloway will say in parliament if Rangers are given some kind of HMRC deal or an easy route back to the SPL. He could be the Ace in the pack. No way he will sit in the Commons and not make a noise about that. Potentially tens of millions in tax unpaid and wars, poverty and unemployment to pay for? I look forward to him giving the Tories and Lib Dems a roasting. He may not be everyone’s cup of tea but the man is a monster in debates.

Salmond has no influence on HMRC or the career prospects of those civil servants of HMRC that reside in the hands of Westminster politicians.

    Those that do

Mundell (Tory), O’donhoe and Blair (Labour) are the men who should be investigated for pressure on HMRC, what treasury ministers has Mundell been at?
