Ellis throws administration a legal curveball

1263

The very last thing anyone connected with Rangers wanted to read this morning is that Andrew Ellis, Craig Whyte’s former associate, is suing the Rangers owner for 24.9% of the club’s shares.  This puts a further legal impediment in the way of any potential transfer of shares or stadium assets from Whyte to a new party.  It remains to be seen if Ellis is in a position to legally enforce his claim however the veracity of his claim may be moot.

Prospective Rangers buyers do not have time to spend in court hearings and appeals before the start of the new season.  If a phoenix (or even a CVA) is to be put in place it is likely that those with a claim, any claim, will need to be satisfied.

This development comes a week after Whyte transferred the security over Ibrox he holds through Rangers FC Group Ltd to Liberty Corporate Ltd.

Legal issues over ownership of shares and assets aside, Rangers’ administrators still have to deal with creditors, in particular, HMRC, who will soon learn if their tax demand against the club has been upheld by the First Tier Tribunal, and Ticketus.  Duff and Phelps were denied the right to set aside the deal which Ticketus struck with Rangers to buy thousands of seasons tickets, leaving a path open for Ticketus to present a legal challenge to any deal which does not recognise their interests.

Chances of an early exit from administration appear to be diminishing by the day. Motherwell were in administration for four days short of two years between April 2002 and April 2004. If Rangers are not out of administration on the morning the new season kicks off they would start on minus 10 points.

  1. The manipulation of a Newco Ragers into the SPL next season is at the back, if not the forefront of most Celtic fans minds, it consumes our thought process because it affects our perception of how we’ll feel towards Celtic.

  2. Some of the comments defending Joe O’Rourke are cringeworthy. This blog is beginning to sound like the equivalent of FollowFollow.

  3. James, I think that some rangers’ folk would WANT HMRC to liquidate them.

Then, the story will be, the big bad taxman did it…..

    And, phoenix……!

I’d prefer that HMRC took some money now, the 5 to 8 million a year at market interest rates. Rfcia would paying for….well, forever.

  6. I detest Rangers with every fibre in my body, but I simply cannot subscribe to the view that our worst fan is somehow better than their best fan. Edward Ursus, take a bow, you have consistently been a credit to CQN, and I would far rather share a pint with you than some of my fellow bloggers.

  7. Congratulations to Ross County. I am happy to see them take their place in the SPL. They won’t sit & defend that’s for sure, They have always been an attack minded Club. They will add more to the League than most of the bottom 6 who quite frankly have no ambition other than to survive relegation battles year in year out. I played against Ross County & Don Cowie many a time, They always had a great youth system in place. The kids are very dedicated & live for their football. Also the Highland derby with ICT will add to the SPL. Good luck to them! HH

Excellent post last evening, you truly understand what CQN stands for IMO, yet painting the bigger picture, in fact your bigger picture shows how narrowmnded we can be at times.

    Thanks for the outsight!

Have a great day one & all.

This talk of WBA being back in for Naismith

Looks to me as if the loss making of last month has awoken Duff & Duffer to the error in their sums when keeping overpaid players on the books .

It would not surprise me if it was D&D who got on the blower to WBA to see if a deal is still on the go ,will be interesting to see the fee paid when the dust settles (if we ever do).WBA increasing their offer (I doubt it )

Looks more like D&D desperately need money to keep the big house open as I believe they were £100,000 short in THEIR wages last month .

Funny how the Scottish press suddenly runs with a Naisey will be fit for the end of the season story ,Murrayesque IMO .

    hail hail

Morning all, on biz in Holland but watching BBC Breakfast, watch the national headlines advising on new health & safety rules being announced. Showing wee boys playing conkers and one of them has the hoops on. Hail hail wee

    man!

  18. Well Karma got me back for that wee joke there. Came out to discover I had a flat tyre. 20 minute mad dash for the train. And now sitting stationery just out of EK. Still, the sun is shining.

  19. A bit of nostalgia for a Wednesday morning! Looking through some weports from the Work Permit Appeal panel for footballers in 1999. Of note to see how in some cases the Panel’s experts were right, and in some woefully wrong.

So we start it with a quiz question – who was described by the work permit panel as “a high quality player with a commanding presence, a good passer of the ball who could play equally well with either foot”? He was also referred to as “a player of the highest calibre and would make a significant contribution to the Scottish game.”

You will need to read the piece to find out!

And can you guess who said that he had tried to sign a player when he was manager of PSV, but had been unable to compete with a certain team financially?

  20. I was reading the sun article and on main page it has the story about Richmond and the SFA but on the DR not 1 mention and what do the DR usually do when an ex ref comes out and criticises the SFA etc, they bring out the old the referees are getting death threats.

I just wanted to know if they ran with the Richmond headline or Collum receiving death threats.

  21. Celtic’s South Korean midfielder Ki Sung-Yueng says he won’t discuss a new deal with the Scottish champions until the end of the season. The 23-year-old, who joined the Hoops on a four-year deal in January 2010 from FC Seoul, has been linked with a host of clubs in recent times including Liverpool, Aston Villa and Blackburn. Ki has now revealed he’ll put contract talks on hold until the end of the 2011-12 season despite Celtic clinching the league title on the weekend with a 6-0 win at Kilmarnock. “I will wait until the end of the season before I talk about my contract,” Ki told The Scotsman. “Now does not seem the right time to discuss it – it’s important to end the season first.” Ki has made 39 appearances in all competitions this term for Celtic although his good form has tapered off in the second-half of the season. Celtic face Hearts in the Scottish Cup semifinals this weekend.

Teletext saying that Regan snapped at “Retiring referees who continually underperformed blaming others for their failings”- looks like he is using the attack is the best form of defence approach

Unfortunately some damning posts were placed on CQN yesterday against Joe O’Rourke for a misguided reply on twitter, judge and jury with an equally damning verdict came from some poster’s on CQN

Mr Regan is on a six figure salary as CEO of the SFA, his tweet acting as judge and jury on Charlie Richmond 20 year service to the referee association is to say the least unprofessional and not in keeping with his position, someone in authority should have a word with him

  24. Stairheedrammy on

Lion- Far from professional for Regan to announce this within a tweet, and not vague enough about who it related to to avoid possible legal action- yet another thing that could come back to bite him
