Ellis throws administration a legal curveball

1263

The very last thing anyone connected with Rangers wanted to read this morning is that Andrew Ellis, Craig Whyte’s former associate, is suing the Rangers owner for 24.9% of the club’s shares.  This puts a further legal impediment in the way of any potential transfer of shares or stadium assets from Whyte to a new party.  It remains to be seen if Ellis is in a position to legally enforce his claim however the veracity of his claim may be moot.

Prospective Rangers buyers do not have time to spend in court hearings and appeals before the start of the new season.  If a phoenix (or even a CVA) is to be put in place it is likely that those with a claim, any claim, will need to be satisfied.

This development comes a week after Whyte transferred the security over Ibrox he holds through Rangers FC Group Ltd to Liberty Corporate Ltd.

Legal issues over ownership of shares and assets aside, Rangers’ administrators still have to deal with creditors, in particular, HMRC, who will soon learn if their tax demand against the club has been upheld by the First Tier Tribunal, and Ticketus.  Duff and Phelps were denied the right to set aside the deal which Ticketus struck with Rangers to buy thousands of seasons tickets, leaving a path open for Ticketus to present a legal challenge to any deal which does not recognise their interests.

Chances of an early exit from administration appear to be diminishing by the day. Motherwell were in administration for four days short of two years between April 2002 and April 2004. If Rangers are not out of administration on the morning the new season kicks off they would start on minus 10 points.

  3. I stayed out of the great Twatter debate yesterday because I don’t used the damned thing. I’ve always though that while it may be useful for keeping up with celebrity gossip if that’s your bag, there is a real danger in trying to have a serious conversation in chunks of 140 characters or less.

Context is often important and when tweets are spread over the whole world there are plenty of people to analyse each and every word choice. Given the number of cases of folk being caught out by poorly worded tweets there is a clear case for caution, care or avoiding the damned thing altogether.

We see the refs in EPL making mistakes but they are generally of a much higher calibre than our bunch

I disagree on that one. The EPL refs have been of a very poor standard for a number of years. Witness Howard Webbs performance in the WC Final. He is one of the poorest referees around imo yet is considered ‘No 1’ at the FA. Look at the decisions that have favoured Man Utd in the last fortnight. They are as poor as their counterparts in the SPL

Uefa has confirmed the six-man team of Scottish officials for this summer’s Euro 2012 finals.

Craig Thomson was already named as one of the 12-strong team of referees for the tournament in Ukraine and Poland.

And he will be joined by assistant referees Alasdair Ross and Derek Rose.

Willie Collum and Euan Norris will be behind the goals as additional assistant referees, while Graham Chambers completes the line-up as standby assistant referee.

Do the refs in the EPL tend to favour one club at the expense of another club?

Witness the decisions that have gone in Man Utds favour this season and that answers the question

The FA + refs are terrified of Ferguson and do anything they can to stay on his good side

  15. The only reason i ask, Craig Thompson made a mistake in the Aberdeen game and he hasn’t had a high profile game in a while.

Collum gets all the big games now and he has made more mistakes than Thompson, we also made a complaint about Collum in final.

So Mr Richmond is 100% correct jobs for the boys.

  16. ” Norris will referee the semi-final between Celtic and Heart of Midlothian on the Sunday. The assistants are Willie Conquer and Graeme Leslie, with Stephen Finnie the fourth official.”

I know willie conquer very well. He makes no secret of his passion for hearts. A huge jambo.

I thought this couldnt happen! Or is that just in backward England??.?

    Not that I m inferring anything……

  17. What I’m trying to say is do you think this was the plan all along to get Collum more high profile games.

  18. greenjedi

They have to declare an interest. Its generally the team they support and also the town where they live so they don’t get get games involving either

All they do is follow the Young/Traynor model of saying they support a ‘lesser’ team like St Mirren/Airdrie. No way any of them want to miss out officiating at OT or Anfield

  19. EPL refs aren’t great from what I’ve seen of them. Too many of them seem to want to be the centre of attention rather than using the quiet controlling approach that the best refs use.

And the likes of Clattenberg and Webb are always making high profile mistakes. Anyone see the penalty Chelsea were given at Fulham the other night? Or the one that was later not given?

I agree vp they contribute nothing and seem even more frightened to make a decision than the assistants. It seems the more help the ref has the fewer he uses.

Surely that makes it almost certain rather than virtually impossible.

  24. Refs in the EPL. Would this happen in Scotland?

Wigan Athletic manager Roberto Martinez says referees’ chief Mike Riley has called him to apologise for mistakes made by officials during

    Saturday’s 2-1 defeat at Chelsea.

Both of the home side’s goals at Stamford Bridge appeared to be offside.

    After the game

Martinez branded some of the officiating “disgusting”,

but has since mellowed and praised Riley’s actions in contacting the club.

“It is a very honourable way to face mistakes,” Martinez said.

The Football Association have also confirmed the Spaniard will not face disciplinary action over his post-match comments.

A former top-flight referee, Riley now heads

    Professional Game Match Officials Limited,

an organisation that provides officials for the Premier League, as well as co-ordinating assessments of referees’ performances.

“Mike Riley told me that he understands that with the level of refereeing in this league [officials] should get those calls right,” the Spaniard revealed.

“We were unfortunate at the weekend and we’ve had a few bad calls over the season. There are many other clubs that have had them as well. It’s important that we don’t feel too aggrieved; that’s part of the game and we need to accept it.

“In many ways the luck is going to level out.
