Fit & Proper test opens Pandora’s Box

1470

I hear the SFA had asked for clarification on Craig Whyte’s alleged disqualification as a director, without getting confirmation one way or another, since the issue was initially brought to their attention by the landmark BBC documentary, Rangers: The Inside Story.  Rangers disclosure to the Plus Exchange (where the club’s shares are traded) on Wednesday that this specific BBC allegation was correct, was the information the SFA needed before they were in a position to act and apply a Fit and Proper Person (FPP) test to Whyte.

Dramatic though it sounds, failing a FPP test, in itself, is only likely to cause superficial damage to a club or its owner.  An owner would need to resign as a director but he could allow the other directors to continue running the business, or he could appoint a proxy to take control of the business, which is often the way controllers run football clubs anyway.

What is of more interest, however, are matters likely to be disclosed as part of the SFA investigation.  The Association would require Mr Whyte to explain what he did to be barred from holding a directorship for seven years, something the BBC lawyers would be able to question Whyte on in the witness box, should he actually sue, instead of repeatedly threatening to do so.

Of most interest to the SFA will be Rangers financial submission for their Uefa licence, which enabled the club to be nominated as Scotland’s participants in this season’s Champions League.  A condition of participation in Uefa competitions is that no debts to tax authorities due on 31 December the preceding year remains unpaid on 31 March.

In September HM Revenue and Customs gained permission from the court to freeze £2.3m of Rangers money in connection with an unpaid tax bill.  The principle element of this bill has not been disputed by Rangers.  The SFA will now be keen to establish if any part of this bill was in connection to taxes due in prior to 31 December 2010.  If it was, Celtic were entitled to be Scotland’s Champions League representatives, when overcoming the likes of Malmo stood between them and a £15m pay-day.

This is a legal minefield for the SFA chief exec, Stewart Regan, who has my sympathy. Things are about to become interesting.

While we are on the subject of that £2.3m tax bill, HM Revenue and Customs are due to get their hands on the cash after Friday next week, the last day Rangers are able to dispute the debt. If Rangers enter administration prior to that date, the cash would revert to the administrator and the club’s secured creditors would be entitled to it.

    up the celts!

  2. Gordon Strachan as an Aberdeen player played in the image of his manager’s philosophy.

That was to get in the face of your opponent and undermine the ref’s authority at every turn.

Fergie learnt that at Ibrox and took it to Pittodrie and Old Trafford.

I’ve heard all the Hibs stuff before but I can assure you big Billy was quite specific on this. He went into some detail about the Strachan/Shirra swap deal and how Aberdeen had won a watch.

  4. Wee Mariella may well be CQN-daft, but there’s no way she’s on the ole E-lites.

I reckon she goes out to the van in her slippers for 40 regal every night.

In other news, I see from that Spartak Moscow photo that even wee Aiden’s got tattoos now. In the way that it used to be impossible to become a police sergeant in Glasgow without a moustache, are tats now compulsory for professional footballers? I predict that by the weekend Dylan McGeouch will have a back like Max Cady.

  5. We had a very good side in the early ’80’s but Aberdeen had an even better one and the Arabs were not a bad side too.

Rangers were whipping boys in the “Greig must stay, Jock Wallace 2” pre-Beast era

Who knows what would have happened if Rapid had not cheated us?

Even you are getting confused. This was in his second last season following a 1-0 defeat to Motherwell. Shameful from some in my opinion but that’s the way a substansial proportion felt.

We did win the league that season, which I’m sure you can remember.

Ok it’s taken us a bit to get there but I actually agree with you.

As Johan Mjalby recently said regarding dressing room bust ups “are players are too nice for that”.

Scott Brown does provide that dig and bit of attitude we have been sorely lacking in the last few years.

It was galling to watch time and time again as we were bullied off the pitch by rangers. Never contesting leg breaking fouls on team mates, just ‘taking it on the chin’.

That’s what made ‘The Broony’ so special. That moment, goal and celebration, epitomised the complete Scott Brown.

Aberdeen did have a good side, it’s worth noting though that Billy McNeill left Aberdeen when they finished 2nd in the league behind the huns, to take the Celtic job. Ferguson inherited a very good side at Aberdeen, people often forget that in their rush to acclaim him as the greatest manager ever.

And then when you got there ole Eurochamps wouldn’t let you in for wearin’ the wrong kind of shoes.

And another thing about that Aberdeen side.

We went cross-country back then to have a nice wee day out, sleep it off on the bus back, and hope we would get revenge back at Parkhead.

And when we did,it was fantastic!

Because they were expected to win-AT PARKHEAD!

Both teams fought themselves to attrition at that time,to the extent that a 14-man squad of navvies won the title in 83!

Thanks to a last-minute toe-poke from Dave Narey to make it 3-2………….

  13. Bournesouprecipe – not vertically, no.

The other great thing about those games , apart from the tension they created, was the huge visiting support that used to come down.

A semi- moribund Aberdeen is not good for Scottish football.

Celtic even with a two goal lead, we still don’t feel safe.

Whatever happened to the killer second goal.

2-0 was often considered a dangerous lead.

1-0 and it was still game on.

3-0 and a bit of comfort.

2-0 and what do you do? Sit tight or go for a third?

If the oppo got one back, then they have a momentum and doubt enters the equation.

Anyone remember the incident (in a LCF I think) when BFDJ did a Lafferty to get big Rougvie red carded?

The fat man seems to have a memory lapse, this incident started the ill will between Sheepies and Huns, well before Neil Simpson got hounded out the game.

Hmmm. – remember it well when they were well nigh unbeatable even at the all singing all dancing Gazebo.

Their away support were always the best, and well behaved too.

  19. I remember a Celtic-Aberdeen at Parkhead where Charlie Nicholas took the kick-off, rolling the ball to his fellow striker. Neale Cooper came striding forward like a big bag of Rowies and booted the Canonball kid in the knee. The game couldn’t have been more than 3 seconds old, not even enough time for Brian Scott to slip into his latex gloves.

  20. Cardiffbhoy

you make a good point. 5 of Billy McNeil’s team at Aberdeen played in the Cup Winners Cup final in Gothenburg.

For the record they were Miller, McLeish, Rougvie, Gordon Strachan and Mark McGhee.

Aberdeen were a fine side and I would be happy to see a return of the early eighties when we were challenged for trophies by Aberdeen and Dundee Utd with the Huns as also rans.

Anyway back in the real world lets hope we hump utd on sunday to keep the good run going!

Was Stewart Regan in office when this decision was made ???

  22. CelticFirst 13.38

That is far too simplistic a comparison.

What the Celtic board would have to take into consideration is not only the loss of two home games against The Darnel.

They would also have to consider what the effect would be on league sponsorship, shirt sponsorship, overall TV revenues from SPL matches?

Would attendances drop after Celtic have won two or three titles because of the lack of competition?

Would out Euro standing drop because other clubs consistently get knocked out in qualifying rounds?

Would we have to enter Cl qualifiers in early June?

Would we ever beat any of the seeded sides we would come up against, and actually be able to get the £15m from the CL?

Would Scottish football die,and with it Celtic ,if there is no serious level of competition?

That is what we are gambling with here.

I say lets get out of the SPL ,irrespective of what happens to the Darnel.

  23. Starting reading back but really had to jump ahead and post before getting through every page.

This WGS thingy, detesting him for something he done on a football pitch is just plain ridiculous.DETEST?Is that not something that should be reserved for the vile members of society like child killers or warmongers?

I suggest if you detest someone for something they done on a football field then you are in need of help.Hate is a negative emotion and will do no good to anyone in the long run, check out the average hun if any evidence required.

Apart from that the whole debate is jading.
