Raith call out SFA plans for Appellate Tribunal

You wonder if Ally McCoist rues the day he called for the public outing of members of the SFA Judicial Panel which imposed a player registration ban on his club.  One judge, one journalist and one football club, Raith Rovers, were soon outed.  Crossing the Fifers was a mistake.

Raith Rovers are now pointing out the same facts we have discussed here for months:

“We are also concerned that there has not as yet been an opportunity for clubs to receive legal advice from the SFL and/or debate the potential consequences on the smooth running of our league in the event that the Courts are asked to annull/strike down any of the corporate transactions that have led to the current position of Sevco Scotland Ltd as owners of certain assets of the Rangers oldco.

“Indeed, the position as regards the potential sanctions to be applied by the Scottish FA via its Appellate Tribunal has also still to be bottomed out.”

In short, Sevco’s ownership of Ibrox may be nullified by the courts and the SFA will be forced to subvert judicial oversight if it wants to guarantee Sevco participate in football next season.

While these concerns were only expressed online, the SFA were able to ignore the issue, but with Raith Rovers asking the questions Mr Regan will have to look SFL clubs in the eye and tell them what he’s going to do with Lord Carloway.

Lurgan 53

Dwyer O’Hagan, or Lurgan 53 as he was known here, passed away on Wednesday after an illness stretching back to last year.  Dwyer enjoyed our triumphs and defeats on the blog for many years and will be sadly missed by us all.  Our condolences to his family and friends.

    1A club’s entitlement to take part in a domestic league championship shall depend principally on sporting merit. A club shall qualify for a domestic league championship by remaining in a certain division or by being promoted or relegated to another at the end of a season.

     

     

    2 In addition to qualification on sporting merit, a club’s participation in a domestic league championship may be subject to other criteria within the scope of the licensing procedure, whereby the emphasis is on sporting, infrastructural, administrative, legal and financial considerations. Licensing decisions must be able to be examined by the Member’s body of appeal.

     

     

    3 Altering the legal form or company structure of a club to facilitate its qualification on sporting merit and/or its receipt of a licence for a domestic league championship, to the detriment of the integrity of a sports competition, is prohibited. This includes, for example, changing the headquarters, changing the name or transferring stakeholdings between different clubs. Prohibitive decisions must be able to be examined by the Member’s body of appeal.

     

     

    4 Each Member is responsible for deciding national issues, which may not be delegated to the Leagues. Each Confederation is responsible for deciding issues involving more than one Association concerning its own territory. FIFA is responsible for deciding international issues involving more than one Confederation.

    Still in the sunny USofA, could we get as many people as possible to pass this information on to the SFL clubs and fans organisations, to get their chairmen to contact the SFL?SFA Chief Exec and ask them to clarify these points and the points raised by TH from Raith, before the meeting date and if further points of clarification are needed then these can be requested before vote taken.

     

    As well as trying to contact FIFA/UEFA direct to get a decision from them.

  7. SFL clubs won’t be given a vote on whether Sevco are given a place in the First Division!

     

     

    The SFL clubs will only be voting on whether or not to admit Sevco into the Third Division after which the board of the SFL, led by Airdrie’s Jim Ballantyne, will then negotiate a deal with the SFA and SPL to promote Sevco into the First Division without kicking a ball.

     

     

    News of the SFL plan has been leeked to the BBC and Alex Thomson of Channel 4 news and is bound to enrage a number of SFL clubs who have been outspoken in their defence of sporting integrity.

     

     

    With the SPL voting against inviting Sevco to replace Rangers it means that Ballantyne and friends will be able to negotiate a series of measures for the SFL with the bargaining tool of Sevco joining the SPL in 12 months time.

     

     

    According to the memo sent to Thomson: “Notice is hereby given that a Special General Meeting of The Scottish Football League will be held within the Bell/Baird Suite on the fifth floor of Hampden Park, Glasgow on Friday, 13th July, 2012 at 11.00 a.m. for the purpose of considering and, if thought fit, approving the following proposals:-

     

     

    (i) That the Scottish Football League Members agree to admit Sevco Scotland Limited as an Associate Member and agrees to permit Rangers F.C. to play in the League during Season 2012/13.

     

     

    (ii) That the Scottish Football League Members direct the Board of Management of The Scottish Football League (the “Board”) to provide that Rangers F.C. shall play in the Third Division of the Scottish Football League during Season 2012/13 unless the Board shall have to its satisfaction negotiated and reached agreement with The Scottish Premier League and The Scottish Football Association on a series of measures which the Board shall consider to be in the best interests of the game, how it is structured, how it is governed and how it is financed, whereupon the Board shall be authorised to provide that Rangers F.C. shall play in the First Division of the Scottish Football League during Season 2012/13.

     

     

    (iii) That the Scottish Football League Members in terms of Rule 12 approve the resignation of either Dundee F.C. or Dunfermline Athletic F.C., whichever shall be admitted to join the Scottish Premier League for Season 2012/13, such resignation to take effect as at the date of admission of such club to the Scottish Premier League, notwithstanding that the requisite notice under Rule 12 shall not have been given.Details of the series of measures referred to at (ii) above shall be made available to the Members in advance of the meeting and an opportunity for full discussion of those measures will be given prior to the proposals being put to the meeting.

     

     

    In accordance with the terms of SFL Rule 53, your club must send one representative to this meeting and I would be most grateful if you could advise me of the name of your representative by return.

     

     

    Partick Thistle and Hamilton Accies have already gone public in their view that the issue should be dealt with by the SFA.

     

     

    News that the clubs will be denied the chance to vote on whether Sevco are given a First Division place is likely to reinforce opposition to the plan and calls for the resignations of those involved in setting up Friday’s ‘vote’.

    I was a tad suspicious the other night watching FPLG on sevco tv. Interestingly he spoke of the Longmuir character, stating he could be trusted implicitly, absolutely no doubt about that etc etc….Today jabba while rubishing the gallant Turnbull Hutton, calling his opinion to be bilge, he also mentioned Longmuir as the only credible guy in this cabal (paraphrasing there but you get me drift). So FPLG and Jabba bigging up Longmuir, Hmmmm. Now we have seen the latest voting list for the Friday meeting, which we all know is a stitch up for sevco to be punted into sfl1; it is of course penned by Longmuir the Trustworthy and the Credible:)

    I recognise that there is a financial downside to there being no huns in the SPL and that is a factor that may influence the board.

  12. Just to remind everyone that the manky mob do not offically cease to exist until the liquidators are appointed (10th July?)

     

    My understanding is that, in the unlikely event of an oil tycoon wanting to loose upwards of £190 million, he could take them over and they could continue as RFC, albeit with penalties imposed!

     

    Being a half-empty glass kind of person, I won’t have my jelly, ice cream and a wee swally of Glenrothes Sinle Malt till that beautiful day draws to a close!

  17. I’m not sure what % of Celtic’s turnover it related to the rivalry with rangers but it will be high.

     

     

    TV, sponsorship and tickets sales will be affected.

     

     

    You can can buy a kids ST for £50 but add in the two derby games it becomes £122.

     

     

    Celtic needs evey fan that can afford it to buy a season ticket. You demanded No now it’s your turn to back the club.

    Imagine we all criticise the suggestion and it turns out the board are in favour.

    Thanks for the pointer to the Fifa document, but in it they state that if a club alters its legal status and enters a league ‘to the detriment of the sporting integrity of the competition’, then the member association’s appeal body decides on the matter. In this case that would be the SFA, Campbell Ogilvie and Stewart Regan.

    I see where you are coming from but the SFA have delegated the decison to the SFL and that is what 4 of 19 prohibits, so how do the SFA explain that?

     

     

    Then if its the SFA who shoulod decide how do they explain ignoring 1, 2 and 3?

     

     

    And if they are ignoring all aspects of FIFA rules and are able to do so with impunity what is the point of them?

     

     

    THE SFA could end this charade at a stroke under a number of rules. They have avoided doing so. The SFL clubs eg Raith Rovers are telling them it is the SFA’s job and point 4 of FIFA 19 tells the SFA its their job.

     

     

    If an association is not doing its job in applying FIFA statutes then FIFA have to get involved.

    Agreed, but based on recent goings on since Rangers went bust, how likely is that we’ll hear from FIFA/UEFA, other than to say they prefer to stay out of the affairs of member associations?

     

     

    More to the point, have Celtic plc given any indication as to what they intend to do if this obscene scenario comes to pass?

    Parachuting Sevco into the SPL did not work out too well. Planet B is Division 1 of the SFL. Planet C is Division 3 of the SFL. There is no Planet D.
