SFO, IPO, hell will freeze before SFA act


An appropriate course of action when you are the chairman or a non-executive director of a PLC when a fellow director and, until last week, chief executive, has been reported to the Serious Fraud Office for matters in connection with the company, would be to immediately contact the accuser asking for full and immediate disclosure of information which could materially affect investors and the company’s trading position.

The “compelling evidence that Messrs Green and Ahmad received a letter before claim in December 2012, having received previous correspondence, and chose to ignore it” sounds like a signed-for receipt.  If this was received before 22 December, the date of Rangers International FC PLC’s IPO, it is of critical importance that the board ask for sight of the evidence, irrespective of what Mr Green says about its existence.

This season’s Third Division has nine days to run and it would inconvenience many if these matters were brought to a head before then, but the duty of directors is clear; they cannot postpone attending to the interests of investors until after the football season.

Lawyers acting for RIFC PLC should politely request full disclosure from the other party, without delay.

Some in the SFA may be tempted to attempt another Grand Plan to prepare for and accommodate and almighty collapse at one club.  Grand Plans don’t work in these circumstances; the last one led to the current Lawyers at Dawn scenario.

We await the SFA acting in relation to RIFC PLC’s claim that Sevco 5088 Ltd, a company Craig Whyte is a registered director of, is part of their group.  This is in direct contradiction to an earlier representation made to the SFA, and breaks a condition of their membership of the Association.

Current SFA president, Campbell Ogilvie, is a former Rangers director.  My prediction is that hell will freeze over before he allows the SFA to act on this matter.  The SFA shall wilfully ignore its own rules.

    My first public statement today and I think it went very well. Having read the diary entries by Craig and Charles in the last two years, I opt for the tried and trusted routine.



    I start with the old ‘I’ll not pretend I’m a Rangers fan’ line to get the enablers onside. Add a few comments about magnificent fans and working hard to take the club forward.



    That should buy me a few weeks before I my next statement.

    the newco club had no audited accounts


    the newco club failed to inform the sfa that craig whyte was a director of newco


    the newco club are been investigated by the SFO



    whats the chance that when the audited accounts are due they are not complete?


    whats the chance that contractors are waiting on payment?


    whats the chance craig whyte still owns murray park and ibrox?



    the sfa are up to their neck in this scam imho


    they have bent and broken every rule to assist newco


    the sfa have ex club in liquidation directors in senior posistions

    I, too, wonder just what it will take for the SFA to act on this seemingly endless farce.



    It’s clear that RCO will only go if forced.



    So: how does (or can) the SFA get shot of an admittedly conflicted and probably out-of-his-depth president and/or chief exec?



    Would it take an EGM? If so, how does such a meeting get called?


    Is there an existing SFA board or committee which has the power to initiate proceedings?



    Is it possible for an individual member club to start proceedings?


    Could the SFA (or a board or committee thereof) initiate an enquiry (of substance) to examine this whole, sorry mess?



    Would it be possible for member clubs to band together to invite UEFA to take an active role in ‘helping’ a member association to sort itself out … ?

    There is a noticeable change in the mood music being slipped out of the ‘Brox since the Malcolm Murray ‘coup’.

    My political antennae are twitching and my fear is that there will be all sorts going on behind the scenes if that Record article is anyhting to go by.



    Newco and it’s new team in charge know fine well that they are bang to rights on the Sevco 5088 situation and that it is as clear a breach of their license conditions as you could ever hope to see.



    It’s an old saw in legal circles that if the facts are agin you, plead the law, if the law’s against youplead the facts and if both are agaisnt you, go and see the Grand High Wizard of the ludge and he’ll sort it.



    Dark deeds afoot, I think. Be ready for more of the ‘club and fans victim of one rogue trader” we’ve been punished enough’ malarkey.
