SPFL review but know to expect further challenges

The new SPFL board yesterday agreed that some sort of review should take place into the debacle which saw Rangers collapse into liquidation. While this is welcome as far as it goes, its scope will necessarily be bound by what the SPFL previously agreed to bind itself to.  This was clear from the off, which I alluded to at the time.

If you contractually agree to limit your future actions for all purposes, you tie your own hands. This is where the SPFL are now and it is the reason we must look beyond them. The actions of those who tied their own hands are just as important as matters pertaining to the integrity of Scottish football’s competitions (the Scottish Cup and SFL League Cup, as well as the SPL).

The SPFL are not the only ones who are looking into this matter. They know to expect challenges during the course of the next two months.

    This whole scenario is a disgrace.

     

     

    It is a disgrace from Murray, from Rangers, from Duff and Phelps, from Whyte, from Green, from the SFA, from the SPFL and from all the clubs — and I mean all the clubs — in that it has been allowed to happen and they have been unable to do anything about it or have chosen to do nothing about it — take your pick.

     

     

    The last 5 years have been spent more or less saying “let’s get into the fight!” or “Let’s ask some really awkward questions and stop all the fannying about and seek answers!”

     

     

    At first we had to persuade the board that we were not crazy troublemakers as I honestly think that is how e were perceived.

     

     

    Then maybe we were guys who had a point but who were overzealous maybe.

     

     

    Of course court cases had to pan out elsewhere but the wee tax case and the 5 admitted ones were always fair game but no one ever wanted to talk about them or ask the awkward questions.

     

     

    Today, I believe but can’t promise, that Celtic get it and know what they have to do.

     

     

    That opinion was available before the Whyte trial and I am certain of that.

     

     

    I also know that during that trial SFA officers were being asked “Are you watching this? Do you hear what is being aid in evidence? Do you agree now there has to be a review?”

     

     

    Check out Regan’s quotes after the trial where he says that he still thinks that Whyte is guilty and will chase him for £250k — he could no longer collect that money and if anyone gave him legal advice that he could then this is bollocks.

     

     

    HOWEVER, he then ends with the strange statement that if the SFA were somehow misled as to licences and licence applications then that would be anoter matter that needs to be considered.

     

     

    The Giannina case says that if you didn’t submit all the info in your licence applications then you should have been deemed never to have applied. If you never applied you never had the capacity to play.

     

     

    You cannot fine or enforce an embargo on an unlicensed club.

     

     

    Did I enjoy writing that? Yes damn tootin I did!

     

     

    Get into the bloody fight! Who knows if we will lose or win but the old lawyers test is do we have a case to take to court?

     

     

    By Christ, we have a case! We have a bloody huge case and I would love to see some hard nosed bar steward get in there and legally set about their procedures and their rules while all the while remaining cold, professional, incisive, and clinical in the process.

     

     

    We can do that, by god can we do that.

    I have followed your lead and only attend league and Euro games in Celtic Park. I attended 10 away league games last season, but will not go to away games again. I will never set foot Hampden or Ibrox ever again.

     

    I hope this is not my last season buying a season ticket, but fear it may be.

  12. How the Celtic board react to today’s statement will be telling.

     

    The timing of announcement on a day when we have a big game seems suspect.

     

    Today’s mood is different from the climate of 2012.

     

    I have long said that the game no longer resembles a sport.

     

    There are many other forms of entertainment that can replace football in the new social media climate.

     

    The people that run football from fifa down are arrogant to a fault and their view that this is the way it has always been and assumption that a captive audience will always exist will lead to the games slow demise.

     

    The impact of technology is enormous both in unemployment and deflecting reality.

     

    My daughter graduated law school 3 years ago and has a good job but 60% of her classmates have not got a job in the legal profession.This number will grow in the future as technology continues to impact the profession.

     

    The folly to me is parents still sending kids to college at huge expense to study for professions that may be obsolete in the technology driven future.

     

    Some colleges have been proactive in adjusting courses to be relevant to future demands but most have stuck to the well worn mantra of it has always been this way so we will continue.

     

    The long term future of football is not bright while the present incumbents show no inclination to make it an actual sport.

    In London the Supreme Court rules that application fees to Employment Tribunals are illegal and unconstitutional, preventing workers accessing justice. The ruling has immediate effect. The £32 million in fees will have to be repaid. That is the good news.

     

    The bad news though is, Supreme Court decisions do not apply to Glasgow.

    Please correct me if I have the following wrong on this particular issue – side letters

     

     

    – The Huns did not declare the use of side letters to the SFA

     

    – These acts are contrary to relevant SFA rules

     

    – The Huns agreed they were in breach of the rules

     

    – These acts have therefore contravened the relevant rules and is punishable by a 3 point deduction in all games that are applicable

     

    – On the deduction of these points the Huns would not have won any of the championships where these side letters were an issue

     

     

    To summarise:

     

     

    If all of the above is accurate then not only are the Huns guilty of knowingly breaking the rules (cheating) they are also guilty of wilful deception and financially benefitting from these nefarious acts to the detriment of my shareholding and my Club.

     

     

    In my view, then I, along with all the other Celtic shareholders have been defrauded as a consequence of this infraction.

     

     

    I welcome your views on my take on things and how we proceed from here

  16. A statement from Celtic will be forthcoming. I dearly hope that it is a strong and comprehensive response to the SPFL statement.

     

     

    I don’t think it will be issued today, and I’m fine with that – match day and all. However, the statement needs to be by the end of this week. The heat needs to be turned up now, and there are no more verdicts and court cases pending. All the information that needs to be available for action to be taken is now available.

     

     

    Right, now that I have resigned myself to waiting for the Celtic statement, I’ll just focus on tonight’s match. It’ll be tough, but I am hoping for at least a 2-0 to take to Norway.

    Today is a good example of how you can get a lawyer to justify anything by using legalese.

     

     

     

    But ultimately this isn’t a legal issue (who, precisely, is going to sue and on what grounds?): its a sporting one. The SC settled the legality, now the question is whether the SPFL imposes the same punishment (a 0-3 defeat) it uses in other cases of incorrectly registered players.

     

     

     

    The Olympics, the Italian FA, and other sporting bodies have no problem adjusting past records when new information comes to light. How odd that Scottish authorities seem incapable of doing the same thing.

     

     

     

    What I said earlier.They were found guilty by Supreme Court.SPFL,sentence them with sporting punishments.No more legalities required.

  20. Have to say, this whole debacle has exposed what a weak sports and business press we have in Scotland.

     

     

    Juicy story after story, scoop after scoop. The football equivalent of Watergate. Someone could really have made a name for themselves here.

  22. I have never advocated withdrawing financial support from Celtic since the mid 90’s when it was a question of existential importance.

     

     

    I still doubt the wisdom of it at this moment. However I do intend to write to the club to say that I will be doing just that if they do not act very very clearly on the prevailing injustice at play in the Scottish game.

     

     

    My letter will change nada. But a campaign by as many supporters of as many clubs as possible might.

     

     

    Petitions are grand but an avalanche of letters or postcards has much more impact.

     

     

    It’s now or never folks.

  27. Not posted for a good while but looking at the discussion on QC legal opinions was interesting. Those that know me also know that I am a solicitor by trade. I instruct QCs to provide legal opinions or to give advice on a reasonably regular basis. There are QC’s that I instruct when I want to know the right answer and there are different QC’s that I instruct when I want to get the answer that I want hear………just saying.

     

     

    Also, as has been said by others, there are generally two QC’s on either side of a case. At least one is nearly always wrong.
