SPL could learn from Irish FA. SFA could learn from everyone

Before the SPL launch headlong into the process of ensuring Financial Fair Play they would do well to look over the water at the Irish Football Association (we’ll leave aside the fact that it’s the Irish FA who are on top of this situation there, but the league who are looking to tighten things up here, as the SFA await the next Any Other Business moment on a scheduled meeting).

Each month, every IFA club are required to complete a form which details information on whether wages, PAYE, NI and VAT have been paid.  It also asks if historic HMRC repayment plans have been maintained, whether lenders have indicated they will remove or not renew borrowing facilities and several other questions designed to flush out future problems.  Clubs, which are largely part-time with volunteer administrators, are also required to submit audited accounts.

Importantly, clubs must also authorise the IFA to inquire directly to HMRC to confirm details on the form are submitted accurately.

This single form, with authority to speak to HMRC, would have prevented Craig Whyte’s ‘business model’ from getting off the ground.

While the SPL should be applauded for tackling this issue their action must embarrass the moribund SFA.  Embarrassment might reach further heights when the SPL call SFA president, Campbell Ogilvie, to give evidence into their inquiry into Rangers’ alleged double contract practice.

  4. If ( and yes its a monumental if) they negotiate a CVA…even if that happened how long would it take them to get back on their feet?

     

     

    Even then: how far ahead would we be? Would there ever be a certain parity of power again?

     

     

    Despite that some defiantly delusional huns are talking as if they are still in a better position than us…we should be quaking in our champion elect boots at a stronger, fitter, invincible Sallys Army…

  8. Philvis, I think you and I may just agree on something!

     

     

    If rangers disclosed evidence of payments to players via EBTs to the SFA and SPL at time of registration, then all bets are off regarding stripping them of titles. They would be humped vis a vis the BTC mind you so I doubt very much they had lodged evidence of ALL payments made. The SPL clearly feels there’s merit in an investigation taking place.

     

     

    The post from FF above is, frankly, laughable. Insofar as Rangers have benefitted to the slightest degree by way of failing to disclose payments made to players to the tax authorities or the authorities, they have failed to adhere to the rules. If this was deliberate, it could also be fraud and would definitely be cheating. Cheating everybody else in the league by effectively paying players under the table. It would take some amount of skullduggery and sleight of hand for Rangers to keep any leagues they won if the SPL investigation discloses failure to properly register players. This is not to say I don’t put that level of skullduggery and sleight of hand(shakes) beyond the cabal!

     

     

    That the above is difficuly for FF’ers to understand says alot about them…

     

     

    Similarly, ND’s comments on Shortbread last night were laughable. The rules are clear that if Rangers are liquidated, their share in the league transfers to the team that otherwise would have been relegated (Dunf/Hibs), with Ross County etc taking Dunf/Hibs old share as the relegated club. There is in effect no relegation from SPL, Div 1, Div 2, and a space created at the bottom of Div 3 for A NEW CLUB. Probably, if newco can get itself together in time for joining the SFL at this stage (difficuly but not unlikely if D&P get their act together) they would have a far better proposal to put to the SFL than, say, Pollok Juniors. However, start at the bottom of the SFL they would have to do.

     

     

    Unless some almighty re-writing of the rule book takes place.

     

     

    I’m glad to see we’re up and lobbying against this, as the idea of them slipping out of this, re-forming as newco debt free and getting straight back in to the SPL is horrifiying to anyone with even a shred of an idea of what sporing integrity is supposed to be about. If this happens I will be done with the whole rotten edifice until we’re playing somewhere else.

  9. Craig Whyte gets set up as the villain, every one panics as this could be the end of the huns. Obviously this can’t happen so a cunning plan is hatched to allow the ‘fit and proper’ Paul Murray (up to his knees in EBT’s) and Dave King (geez 20 million) to waltz back in. Doncaster says ‘Its in the rules’. The SFA say ‘Eh, Whatever’. Spineless Chairmen shuffle their feet uncomfortably and Jabba says ‘I’m the daddy, I’ll decide how this plays out.’

     

     

    ‘The big hoose must stay open, that’s the bottom line.’ Is in danger of becoming the epitaph of Scottish Football because the way this is panning out, the rules and the integrity of Scottish football are so far down the list of priorities it is incredible.

  10. More to the point, re: registration of players, what the SFA/SPL knew at the time of registration is also of serious interest. The revolving door between Ibrox and Hampden might not seem like such a co-incidence.

    THE role of London lawyers Collyer Bristow and partner Gary Withey are likely to attract more attention as the events behind client Craig Whyte’s takeover of the Glasgow club -effectively with its own money – unravel.

     

     

    Withey was at the centre of the takeover negotiations with Sir David Murray. Funds were to go into and through a Collyer Bristow client account. Undertakings for £5m of future funding for the club appeared under Collyer Bristow letterheads.

     

     

    Gary and Craig seem to have become close once Pritchard Stockbrokers, where Whyte was a shareholder/backer and company secretary, acquired the private client business of brokers Wills & Co after it was effectively closed down by the Fundamentally Supine Authority in 2010. Withey acted for Wills. He had previously been observed socialising with Whyte at a PLUS Stock Exchange dinner in 2009, where Whyte was a Wills guest. Now the FSA has effectively shut down Pritchard.

     

     

    Whyte and Wills are not Collyer Bristow’s only colourful clients to attract attention. Danish conman Bjorn Stiedl was convicted of fraud on a Scottish pension fund in 2004, but not before he had been engaged in promoting failed film tax schemes with the aid of advice from Collyer Bristow.

     

     

    Also involved in the Balfron fraud was struck off lawyer Paul Baxendale-Walker, whose employee benefit trust tax scheme is at the centre of Rangers’ financial problems.

     

     

    Meanwhile, perhaps the FSA will direct itself to a statement in the Rangers shareholder circular last June announcing the Whyte purchase: “The information contained in this document for which they accept responsibility is in accordance with the facts and does not omit anything likely to affect the import of such information.”

     

     

    The club, rather than the directors, was last week fined £50,000 by PLUS for failing to disclose that Whyte had been disqualified as a director for seven years in 2000. But what about the funding for the takeover – provided by mortgaging future ticket revenue – and the £26.7m Whyte promised to provide for players and investment which has not materialised?

     

     

    No doubt Gary Withey and Collyer Bristow have complete explanations.
