SPL dominoes might all fancy ditching HMRC debt

It’s difficult not to associate Hearts’ owner, Vladimir Romanov’s outburst on their club website yesterday with the current issue over Rangers finances, which could soon see the SPL, the SFA and the media take sides between Rangers and their creditors, in particular HM Revenue and Customs.

Romanov’s rant on the demise of the Scottish game was ignorable until he dragged in the “tax authorities” for blame.  As you and I know, the tax authorities don’t play favourites, they collect vat, income, corporation and other taxes in line with the law.

Hearts failed to pay player wages last month and Romanov now says, “there is no point is spending millions to watch someone else’s show”.  Most of Hearts debt is owed to Romanov’s own bank but if player wages are unpaid there is a good chance HMRC will also be outstanding, explaining the “tax authorities” reference.

If a new football club playing at Ibrox is ushered into the SPL with a points tally calculated from the position of a defunct Rangers you can expect a gold-rush of clubs ready to flush their debts to the country, and history, away.

Well done to STV who yesterday revealed the actual decision making process which would be put in place to judge an application to join the league midseason or at any other time.  The SPL board, by simple majority, have the decision, while the SFA need to ratify membership.

If the SPL board vote to reward bad debtors’ shares in their league what incentive would most clubs have to pay their bills?  Fortunately, our history is more valuable than any amount of cash.

  1. Top of Clyde show at the minute and the crisis believe it or not is with us. Keevins as ever doing his bit to be ever more negative sticking the knife in insisting we are a shambles.

     

    But don’t mention those on the South Side please. That would not do at all….. what an old Uncle Tom he is.

    Sorry I am in London today and so have to kinda peak in here in between proper work!!

     

     

    Others will be able to say more about Close Brothers and their security than I ( nods to the Don I suspect ) but in my experience they are a rung above the last chance saloon funders. That is not in anyway to denegrate what they do as they are a very successful and reputable outfit but they are specialist funders who will have very strict lending criteria. This includes what they lend on, the loan to value ratios, securities taken, default stratagems and so on. They do like their pound of flesh though so they are not a cheap option and so tend to be for those who are in deep doo doo– as can be seen from the type of propmotional material put out by Mr Betts.

     

     

    If you get into Close Brothers you should have a swift exit up your sleeve!

     

     

    On a completely separate point, I read the STV piece about the SPL and the SFA possibilities last night.

     

     

    Memebership of the SPL for a Phioenix company may be one thing but it is all dependent on the SFA granting a licence. I wonder why they used Leeds as an example yet completely ignored the demise of Airdrie, who gained Clydebanks Licence and then the arrival of Gretna who gained a licence on application as a result of Airdrie going fut!!! That seemed more sensible to me! Airdrie did not die and rise as a Phoenix with a new licence– too risky perhaps– so they bought an old one from a dying club– in fact they bought the dying club.

     

     

    Two further things on that front.

     

     

    Should they so chose the SPL ( as distinct from the SFA ) can hold an enquiry or a commission into any matter, call witnesses, demand papers, statements and attendance etc should they so chose. Depending on the outcome of any such enquiry, the SPL can then impose a number of sanctions– including disqualification and removal from the SPL, unlimited points deductions and many other sanctions.

     

     

    The ten point automatic deduction– is a minimum and an automatic penalty for any insolvency. If the SPL choose to look into the matter further then they can increase that penalty should they find cause to do so. Again any club who is unhappy with their decisions is free to start a judicial review and all decisions are subject to appeal ( in so far as competent ) to the SFA.

     

     

    However for me the most interesting things to come out of my read was that the SPL should have been given any and all papers that relate to a players contract with the club AND may be given financial projections of the clubs trading performance for the coming year. These projections are then kept in a locked box by the Secretary of the SPL for a two year period! Obviously the projections should show players wages and bear some correlation to the contracts! That seems logical.

     

     

    I don’t know if Rangers give projections or have been asked to give financial projections, but the whole point of giving financial projections to a licensing body is to set out what you think the trading will be and to allow that body to monitor how close your actual figures are to the ones that you projected.

     

     

    I have no idea if the SPL carry out this function or indeed how the budgets compare to the actuals but it would be interesting to ask the question.

     

     

    On the contracts front– this is really interesting.

     

     

    Have the SPL– and the SFA– had full access to all Rangers player contracts going back years? If so, as I understand the arguments that have leaked out from the tax case, then they must have seen that written into those contracts are provisions for making payments to those players through the EBT? Again if that is so– have the SPL really sat back and allowed one club in the league to operate what turns out to be an illegal and unlawful payment scheme with their full knowledge and to the prejudice of all other clubs??

     

     

    That would be an astonishing state of affairs as contracts are meant to be in a standard form for all clubs. Could it be that the SPL have knowingly sat back realising that only one club has EBT contracts, or is it the case that they have simply been negligent and not realised what exactly Rangers PLC have been up to with their players? Surely they would have some knowledge of the effect of an EBT payment would mean and the purpose of having this method of payment?

     

     

    That is a very serious question for the SPL– and the SFA.

     

     

    However, what may be even more serious is the possibility that the SPL and the SFA were never shown those parts of any contractual arrangements or understandings that included the EBT payments and were at all times lead to believe that there were straight forward contracts in place with no EBT elements. How would that marry up with any financial projections?

     

     

    Also, if there have been a couple of years where it has been known that Rangers have been trading with an ever increasing Tax bill– should the licensing body not have taken some steps to warnthem at least about such conduct?

     

     

    Were Rangers so warned? Were the SPL and SFA negligent in a supervisery and monitoring capacity or was the real truth behind what Rangers were paying players and how much they owed in tax kept from those bodies by design.

     

     

    In which case how do the other SPL teams feel about this practice? How do the SPL officials and executives feel about any such scenario and what would be the sanction for a club who so mislead the SPL?

     

     

    Anywhich way that you look at this– How did Rangers manage to administer and enter into such player contracts without anyone else knowing– or at least saying something?

    me in that respect. They have went a long way to dispel the rumour. All is looking better. As I said earlier sometimes these things are good for morale.

    Integrity should be at the root of the game and therefore, a given.

     

     

    There is no case to present in support of the integrity of the game, rather it is up to those, who would corrupt that integrity, to defend their position.

     

     

    It didn’t take Paul Mc.Bride much effort, albeit it took a judge to rule, to make the SFA abide by their own rules re Peat’s involvement in Neil Lennon’s hearing.

     

     

    The rules are there and they are based on fundamental laws of fairness.

     

     

    This is more than getting a cup tie delayed.

     

     

    UEFA can do nothing else but support an exit for Celtic, if it can be demonstrated that the SFA are unable to govern the game fairly.

     

     

    As I said elsewhere, perhaps this is what PL was referring to when he spoke of the “demise” of the game in Scotland.

     

     

    The stakes are high and have been for the last four years of Honest Mistakes, etc.

     

     

    I can’t conceive of Celtic not pursuing the “those days have gone” route.

     

     

    We are at the cross roads.

  19. I doff my cap to both Lenny and Kris in the way that they have dealt with the rumours. They have come out fighting (no pun intended)…:)

     

     

    Given the old media a non story love it but no doubt they will go looking for one or spin it in any event. The show of togetherness in the face of adversity has to be applauded. All Lenny and the Bhoys need to do now is transmit the positive energy and togetherness into the rest of season, not just tomorrow night and Sunday. If they can, then we might just have a chance of doing something this season.

    a) Harry does not need James Forrest yet – he was just sending out a not so subtle message to the player and his agent

     

    b) PL will not sell at the first bid…he will encourage a bidding war if it is time to sell.

     

     

    I hope none of this comes about. I believe James will still be with us, developing for a couple of years yet. The boy likes his football; he won’t like being a benchwarmer at his age.
