SPL propose rules for Newco FC

We told you back in October last year that Rangers were likely to be liquidated and a Newco FC would be formed, which the SPL would vote back into the league.  Today the SPL issued terms of how the deed will be done as they issued 8 resolutions to be voted on later this month.

The key resolution is 2A, which establishes a procedure to phoenix a Newco into the place of an ex-club.  Crucially, this resolution only requires the support of 8 SPL clubs, all 12 of whom will be eligible to vote at the meeting.  5 clubs would be needed to block this proposal and right now there is only one willing to do so.

Resolutions are as follows:

Resolution 1 proposes an increase in the sporting sanction (points deduction) on any Club which suffers or is subject to an Insolvency Event from 10 points to the greater of 15 points and 1/3 of the Club’s SPL points in the preceding season.

This resolution increases the penalties imposed following an insolvency event, it requires the support of 8 clubs to be carried and should be supported.

Resolution 2A proposes further sporting sanctions in the event that any Club undergoes an Insolvency Transfer Event (i.e. transfers its share in the SPL to a new company where this occurs because of the insolvency of the transferor) of 10 points in each of two consecutive seasons from the Insolvency Transfer Event.

This resolution provides for an ‘Insolvency Transfer Event’, defining what happens when a club ceases to exist and a Newco FC is formed.  No provisions currently exist for such a scenario and I see no reasons to introduce any.  The resolution requires the support of 8 clubs to be carried and must be opposed.

Resolution 2B proposes revisions to the fee payment arrangements i.e. SPL fees to any Club which has undergone an Insolvency Transfer Event will be reduced by 75% in each of three consecutive seasons from the Insolvency Transfer Event.

This resolution provides for a financial penalty in the event the Insolvency Transfer Event resolution is voted through and requires the support of 11 clubs.  This is an outrageous and arbitrary increase in support required to impose financial sanctions.  All an Insolvency Transfer club needs is the support of one other club to halt financial penalties.

If resolution 2A is passed, resolution 2B should be subject to the same voting criteria and must be supported.  The SPL must ensure a financial penalty is imposed for financial misdeeds.

Resolution 3 proposes extending sporting sanctions where an Insolvency Event is suffered by a Group Undertaking of a Member Club of the SPL (Group Undertaking is defined in Section 1161(5) of the Companies Act 2006).

This resolution confirms insolvency events at group owner level are applicable to the club, requires the support of 8 clubs and should be supported.

Resolution 4 proposes updates and extensions to the definition of Insolvency Event in the SPL Rules.

I assume this is an administrative requirement and needs the support of 8 clubs.

Resolution 5 proposes updates and extensions to the definition of Insolvency Event in the SPL Articles and clarifies the process in the event that a Member which is the subject of an Insolvency Event is required to transfer its share in the Company.

This is a technical resolution defining how clubs lose or transfer their share in the League.  It requires the support of 11 clubs but it is not clear if has any consequence, more than clarifying administrative procedures.

Resolution 6 proposes a specific requirement in the SPL Rules that Clubs must pay their Players in terms of their Contracts of Service on due dates and places a duty on any Club to report any failure to pay its Players in a timely manner to the SPL.  Failure to pay Players and / or to notify such failure to the SPL would be a breach of SPL Rules.

This resolution should enhance fair play, requires the support of 8 clubs and should be supported.

Resolution 7 proposes a requirement in the SPL Rules that Clubs report to the SPL any failure to make payments to HMRC in respect of PAYE and NIC (a Default Event).  Any Club suffering such a Default Event will be subject to a Player Registration Embargo.  Any failure to report a Default Event shall be a breach of the SPL Rules.

This resolution prohibits clubs in tax arrears from signing players, requires the support of 8 clubs and should be supported.

If only they would pay their taxes we would not need to bother with any of this.

    Will kill me, and my family, to do it, but as I commented the day this was first suggested, we will not be renewing our season-tickets for Celtic and will no longer be attending any matches or subscribing to any tv station which shows Scottish Football.

     

     

    Absolutely zero sporting integrity will remain if the SPL do this and so we would be finished with Scottish football.

    THE SFA’s head of referee development has hit back at comments from Charlie Richmond after the former official claimed he had been the victim of a culture of favouritism.

     

     

    Richmond called time on a refereeing career dating back to 1991 on Saturday after feeling unfairly sidelined from taking charge of SPL games over the last 18 months.

     

     

    The 43-year-old, a category one official since 2000, blamed “people within a position of power at the SFA” and followed Steve Conroy in quitting this year.

     

     

    However, John Fleming, the SFA’s head of referee development, disputed the claims made by Richmond.

     

     

    In a statement on the SFA’s official website, Fleming said: “While many of his complaints appear to be historic, I consider his comments an affront to the work currently undertaken by the Scottish FA to promote and support referees at all levels.

     

     

    “I am sure there will be plenty of Charlie’s former colleagues who will feel misrepresented by his comments.

     

     

    “Over the past few seasons he made a decreasing effort to attend referee association meetings and training sessions.

     

     

    “Charlie has also failed to attend our winter training camp – vital for mid-season debriefing and discussion – for the past two seasons.”

     

     

    Richmond had told BBC Radio Scotland’s Sportsound programme: “Apparently I’m not a team player. My interpretation is it means I don’t suck up to the right people.”

     

     

    Fleming insisted Richmond had been supported, adding: “Charlie claims he lost the support of the ‘decision-makers’ within the referee committee yet was reintroduced to the Clydesdale Bank Premier League this season after a prolonged period of performance management.

     

     

    “This involved one-to-one discussions and appointments outwith the SPL in an effort to rebuild his confidence.

     

     

    “It is curious that Charlie did not see fit to air these grievances while he was officiating in UEFA and SPL matches.”

     

     

    In addressing Richmond’s comments, aired yesterday, Scottish FA chief executive Stewart Regan responded on Twitter.

     

     

    Regan wrote: “Referee appointments are based on performance. Would prefer to see consistent under performers ‘retire’ without feeling need to blame others.”

     

     

    John McKendrick, chairman of the Scottish Senior Football Referees Association, took issue with Regan’s comment, while also criticising Richmond’s remarks. Richmond has not been a member of SSFRA for several years.

     

     

    In a statement, McKendrick said: “The SSFRA also considers that it is unhelpful and regrettable that any recently retired referee should be described as a ‘consistent under performer’.

     

     

    “Referee development and improving performances means that changes to the official list of referees owe more to rising standards of performance among emerging referees, rather than the poor performance of retiring referees.

     

     

    “Scottish football should value, rather than deride, the contribution that recently retired referees have made to our game.”

     

     

    Addressing Richmond’s comments directly, McKendrick added: “The SSFRA takes issue with some of the insinuations and assertions that were made by Charlie in this interview.

     

     

    “We dispute and are offended by the claim that referees need to ‘suck up’ to progress.

     

     

    “Similarly, we would argue strongly that our members who officiate in the SPL have demonstrated over a sustained period that they have the ability and the right to operate at that level.”

    Every game we play though, on our global tour, call a press conference before it and TELL THE WORLD WHY.

    During a previous discussion on this matter, Ernie Lynch pointed out to me that UEFA couldn’t sway any decisions made by the member clubs acting as the SPL. It’s a business set up by the member clubs and run for the benefit of the member clubs.

     

     

    In terms of sporting integrity, our target has to be the SFA via any inroads we’ve made with UEFA/FIFA. The alledged dual-contracts, tax avoidance and possible criminal activity makes a complete and utter mockery of Platini’s flagship Financial Fair Play initiative.

     

    We need to bang the drum about this and make sure that if the SFA don’t act in the correct manner, then UEFA/FIFA threaten them with the expulsion of the national side from EC/WC.

     

     

    There are a number of options to be discussed when it comes to exerting commercial influence, from away bhoycotts to pulling out of any proposed TV deal or even refusing to play the Newco entity and taking the points hit.

     

     

    We still have to see how the SFA play their hand (I know!) after investigating the Rankers contract situation and also the result of the Big Tax Case.

     

    I still think it’s too early for Celtic to come out with any definitive statements.

  23. Unity of purpose is what is required of us right now. We have European games to look forward to next season. I would imagine our Board has some keen legal beagles.

     

    Rankers are a scummy rabble’detested worldwide.This is how THEY want us : feeling in disarray at THEIR shameful dealings. No matter what happens,we are family,Celtic through & through. We will get past this. THEY are tainted by a permanent stench.

All during a period of upheaval – player wage deals done which seemed strange – deferred wages. End of season prognoses – can’t pay and won’t pay yet the administrators remain optimistic.

     

     

    However bent these charlatans are – would you risk our club for them? Not renewing your season ticket? Benefits them not us!

     

     

    Aye, it’s rotten and it’ll leave a poor taste, made all the worse for the press making it look clean and shiny and the only honourable way.

     

     

    But to make Celtic destitute on the back of the actions of cowards and liars and cheats is downright insane.

    Celtic cannot resign. So we should stop that there. There seems to be no other footballing option for Celtic than the SPL.

     

     

    We will go out of busines if we resign. We would not have a football team (which many could stomach it seems) but all the people Celtic employ and all the businesses that rely on Celtic in the area will lose their jobs. That’s a lot of people out of work in the area that Brother Walfrid set up a football club.

     

     

    What can we do?

     

     

    Discover who drew these proposals up, and when and at whose behest?

     

     

    Bhoycott all SPL clubs grounds from now to the end of the season. Make it known to the SPL clubs what their income will be from Celtic in this future SPL Franchise.

     

     

    If possible create a collective including other clubs that demonstarte against corruption in the SPL.

    If everyone else complies to this corrupt and disgusting fix then there is only one club who can put a stop to it.

     

    It is Celtic and therefore the fans. Us.

     

    If we paying customer make clear our disgust at continuing to be part of such a biased league then the board have a decision to make.

     

    Will they come out with the “we we don’t like it either but what can you do?” rubbish… or will they actually draw a line in the sand which could bring the game to it’s knees without us? A united board and support can stop this fix happening but it takes the kind of courage that only an organization with moral rectitude could enforce.
