SPL propose rules for Newco FC

We told you back in October last year that Rangers were likely to be liquidated and a Newco FC would be formed, which the SPL would vote back into the league.  Today the SPL issued terms of how the deed will be done as they issued 8 resolutions to be voted on later this month.

The key resolution is 2A, which establishes a procedure to phoenix a Newco into the place of an ex-club.  Crucially, this resolution only requires the support of 8 SPL clubs, all 12 of whom will be eligible to vote at the meeting.  5 clubs would be needed to block this proposal and right now there is only one willing to do so.

Resolutions are as follows:

Resolution 1 proposes an increase in the sporting sanction (points deduction) on any Club which suffers or is subject to an Insolvency Event from 10 points to the greater of 15 points and 1/3 of the Club’s SPL points in the preceding season.

This resolution increases the penalties imposed following an insolvency event, it requires the support of 8 clubs to be carried and should be supported.

Resolution 2A proposes further sporting sanctions in the event that any Club undergoes an Insolvency Transfer Event (i.e. transfers its share in the SPL to a new company where this occurs because of the insolvency of the transferor) of 10 points in each of two consecutive seasons from the Insolvency Transfer Event.

This resolution provides for an ‘Insolvency Transfer Event’, defining what happens when a club ceases to exist and a Newco FC is formed.  No provisions currently exist for such a scenario and I see no reasons to introduce any.  The resolution requires the support of 8 clubs to be carried and must be opposed.

Resolution 2B proposes revisions to the fee payment arrangements i.e. SPL fees to any Club which has undergone an Insolvency Transfer Event will be reduced by 75% in each of three consecutive seasons from the Insolvency Transfer Event.

This resolution provides for a financial penalty in the event the Insolvency Transfer Event resolution is voted through and requires the support of 11 clubs.  This is an outrageous and arbitrary increase in support required to impose financial sanctions.  All an Insolvency Transfer club needs is the support of one other club to halt financial penalties.

If resolution 2A is passed, resolution 2B should be subject to the same voting criteria and must be supported.  The SPL must ensure a financial penalty is imposed for financial misdeeds.

Resolution 3 proposes extending sporting sanctions where an Insolvency Event is suffered by a Group Undertaking of a Member Club of the SPL (Group Undertaking is defined in Section 1161(5) of the Companies Act 2006).

This resolution confirms insolvency events at group owner level are applicable to the club, requires the support of 8 clubs and should be supported.

Resolution 4 proposes updates and extensions to the definition of Insolvency Event in the SPL Rules.

I assume this is an administrative requirement and needs the support of 8 clubs.

Resolution 5 proposes updates and extensions to the definition of Insolvency Event in the SPL Articles and clarifies the process in the event that a Member which is the subject of an Insolvency Event is required to transfer its share in the Company.

This is a technical resolution defining how clubs lose or transfer their share in the League.  It requires the support of 11 clubs but it is not clear if has any consequence, more than clarifying administrative procedures.

Resolution 6 proposes a specific requirement in the SPL Rules that Clubs must pay their Players in terms of their Contracts of Service on due dates and places a duty on any Club to report any failure to pay its Players in a timely manner to the SPL.  Failure to pay Players and / or to notify such failure to the SPL would be a breach of SPL Rules.

This resolution should enhance fair play, requires the support of 8 clubs and should be supported.

Resolution 7 proposes a requirement in the SPL Rules that Clubs report to the SPL any failure to make payments to HMRC in respect of PAYE and NIC (a Default Event).  Any Club suffering such a Default Event will be subject to a Player Registration Embargo.  Any failure to report a Default Event shall be a breach of the SPL Rules.

This resolution prohibits clubs in tax arrears from signing players, requires the support of 8 clubs and should be supported.

If only they would pay their taxes we would not need to bother with any of this.

    No Sky/ESPN and more C 67 and an away bhoycott sounds about right. The more things change………..It was mentioned a while ago on here that our club would insist upon a 15 point penalty for three seasons. Cant remember who said it but it was posted so whoever it was got it right it seems. It’s the biggest boot in the nuts ever. HH.

    For months now, everyone who is anyone in Scotland has discussed Rangers NewCo scenarios as if they were mere formalities and not an affront to justice and to the rules we as a club have lived by.

     

     

    Our determination to play by those rules has cost us – YOU AND ME AND EVERYONE HERE – days like Black Sunday and others. It send a good man, Tommy Burns, to the scrap head of the dole. It has cost other clubs millions. It has cost the game in Scotland it’s soul.

     

     

    The club which did it, which did all of it, has talked, OPENLY, for MONTHS now, of scenarios which allow them to treat debt as an inconvenience, something they can avoid with a little creativity and the connivance of the authorities.

     

     

    And now we are a bare three weeks from that being done. For all they appear to be in total disarray, they have retained their first team squad, and are all set to go. They have run up further debts which they have NO INTENTION of every making good on. They have urinated all over all of us. If they did not plan it this way, these are the most fortuitous developments in their history. If they did plan it this way then truly these people are the scum of the Earth and the joke is on US.

     

     

    They are going to get away with it, all of it, unless our club refuses to play ball.

     

     

    That is the reality.

  6. Celtic have to do everything they can to block this. This would mean that a club can run up £100m of debt buying success it can’t afford and evading taxes but would be actively encouraged to liquidate and transfer their league share to a Newco to escape those debts. Transfer of league share in these circumstances should be completely prohibited. Rangers should be made to start from the bottom and work their way back up.

     

     

    The most bizarre thing about all of this is that if Rangers stay in administration next season they would have a 21 point penalty (based on their current haul of 63 points) but if they liquidate and Rangers 2012 takes their place the Newco would only have a 10 point penalty. This cannot be allowed to happen!

     

     

    Anything less than entry at SFL3 level, titles and cups stripped and strict financial fair play rules being introduced (emphasis on the “fair”) would be an affront to sporting integrity.

     

     

    I really do hope that Celtic are aware of the depth of feeling amongst the Celtic fans on this. I want the club to expend every last penny fighting this through the courts if need be.

     

     

    We have been cheated for the past 14 years and possibly more given High Adam’s revelations. We cannot be cheated for another 14.

    If we go to Fir Park en masse, we are not only giving creedence to a corrupt league but worse still we are saying that no matter how rotten it is we will support it financially.

     

     

    Away Bhoycott is our only weapon and we have to use it now.

     

     

    We have to send out a message with this game that we will not give one green penny to clubs who support such a betrayal of sporting integrity.

    Just heard the news that Duff & Duffer have delayed announcing the preferred bidder till the SPL stitch up is forced through .

     

    I have said on here many times that any bids would probably require SPL for newco . This seems to prove this ,are the new bidders making sure the way is clear for pulling the plug and marching right back in laughing all the way .

     

    I can’t express my rage at what the so called powers that be are doing here .

     

    No one is with us on this Celtic ,it is time for us to fight and this time the gloves really do have to come off .

     

    Let them what is right for the peepils club but make sure they all know we will be doing what is right for CELTIC FC and no one else ,NONE OF THEM .

  15. I am happy (if a little anxious) to wait and see what official line is taken by Celtic FC.

     

    In the meantime,IF “going nuclear” is being considered,here are a couple of ideas.

     

    1.The league is won,the team don’t really need our support in getting over the line.A very public boycott of the 2 remaining away league fixtures.

     

    2.If the Cheats Charter is voted through and we feel so strongly as a club about such injustice then take the national association to court.This is strictly against UEFA rules and can result in EVERY club plus national side being barred from Europe.Kamikaze time!

     

     

    I also see that stv are suggesting that newco (zombie huns) would retain their history.I would imagine HMRC would have a view on that if the perception is zombie huns = same auld tart with a new coat on.As in,by the way chaps you still owe us £75m

    THE AWAY GAME BOYCOTT SHOULD START NOW!

     

     

    The “Gang of 10” should be in no doubt how strongly the Celtic support feel about this. If they want financial windfalls like the one we just gave Killie then they should think lo0ng and hard about voting these proposals through.

  18. Am I right in thinking the conditions to achieve resolution 2A can never be met, because a liquidated club cannot transfer its share to another company. The share must be rescinded to the SPL, who will then reassign it appropriately, no?

     

     

    In these times of austerity and UEFA financial fair play, it’s pretty shameful that a football association is busying itself establishing rules to specifically support financial doping and tax avoidance.

    I am not in the least surprised that the Newco Rangers will be voted back into the SPL.The situation is Rangers have cheated but are about to shed there skin and reappear after cheating there creditors out of millions of pounds.Now I am not sure what Celtic can do about it if they lose the vote.I know that as individuals we can do our own thing and I for one will not follow this corrupt Scottish football set up I feel it would be crazy to put in one brown penny to Scottish football.I will no longer come on CQN or anyother Celtic blog.Bhoys I am sorry but as I see it those cheats are going to rub our nose in it and laugh at us while doing it.H.H.

    So, the SPL has proposed to change it’s rules, (with some skewed voting structures into the bargain) to enable Rangers FC to continue in existence in it’s present form, despite every creditor getting stung. £134 million of debt and counting, plus a minimum £100 million write-off by MIH and yet somehow the SPL feels it needs to accommodate football’s version of the Titanic. Built in Belfast, sunk in Glasgow! Like every other Celtic Supporter I will always support Celtic Football Club, beit in the SFL, the Highland League and even the Scottish Junior League. I think Shettleson Juniors could be classed as a local derby. But we are not talking about Celtic FC are we, we are talking about Celtic PLC, an entity which first and foremost sees itself as part of the Old Firm, even if one part of it exists no longer. I said a couple of weeks back that we, Celtic, should have been offering Scottish Football an alternative vision, should have been talking not just to the Clubs, but their Supporters too. Have we honestly done that? Answers on a postcard please!

    could the club look into doing beam backs to CP for away games or open lounges within the stadium with a membership scheme .

     

    If we reach the cup final ,can we do this for this game also ,the highest profile game left for Scottish Football authorities ,how would it look if not one single CELTIC fan turned up at Hampden but instead 60,000 turned up at CP .
