Supreme Court gets to grips with Rangers Tax Case

I long ago promised to take nothing for granted regarding the Rangers Tax Case, as it confounded my predictions from the off, but with the matter underway today with its final arbiter, The Supreme Court, I’m prepared to go as far as to say: so far, so good.

There is a long way to go – so no one should be out celebrating a draw. The matter will not be settled by the performance of a QC on his feet, rather the finer points of law. Today has been interesting, so far, but we will hopefully be well into our next Champions League group stage games before we hear the outcome.

    JJ reading the runes of events at Court of Appeal. His view is that counsel for BDO having a stinker and (however gauging the body language of the learned judges is at best an inexact science and not always a clear indication of final outcome) that their Lordships and Lady less than impressed.

  2. Supreme Court is not arsed about Sevco, will merely find for or against a company/ business known as Rangers at that time. SFA will ignore all findings.

  3. Since I was bored today I for the first time ever watched the Supreme Court in action.

     

     

    AM the appalling appellant QC A Thornhill was basically ripped a new orriface by the Law Lords. 2 of the 5 were not buying his bollocks while a 3rd was very cynical. All 3 blokes. Neither of the two female Law Lords said a word. QC AT was question on a fair few points off his submition.

     

     

    In the afternoon Gosh you could have blew me away as two of the Law Lords assisted QC Gosh who had a real funny way of saying the word ‘to’. Gosh’s argument were pretty simple – that the enulments paid into the trust/a were salaried earnings and therefor taxable at source and even if his first argument did not hold water then his second that the sub trust/s created for players to take loans from were also income and taxable at source. Two Law Lords brought up paragraphs of previous cases under appeal and paras in QC Gosh’s submission to support and clarify his arguments. One female Law Lord told us she was new to this and basically that she did not understand the financial case that is EBT, so how she can judge on it I don’t know. Other other female remained quite while the third male questioned only for clarification of points opposed to his earlier cynical questioning of QC AT.

     

     

    Can’t remember the 3rd QC (second acting on behalf of HMRC) but his case was made, while requiring further time tomorrow, with only Q’s with regards clarification of the points and argument he was making. His major bombshell that I think will deal the deal will be argued am tomorrow re. Trust/Sub Trust Protector/s.

     

     

    In normal circumstance the Protector should be impartial have no conflict of interest and be a third party. It looks like the bombshell will be QC arguing that the Protector/s were in fact the players and executives who could take money in the form of loan as and when they pleased.

     

     

    Unless the 33rd level Grand Master/s step up for QC AT this is a done deal in favour of HMRC based on submissions so far.

     

     

    But we’ve been here before and the hand shake is more powerful than the law.

    obs wudda preferred we beat the turd team in the league on sun but in the context of our winning spree and being in the running for the triple and a cup tie coming up and all and sundry being able to see our strengths and weaknesses (which only st mirren saw) and designing what’s by now a well refined game plan against us, I’m glad br and co have had a chance to reflect on game plans and refocus training, squads strengths and tactics prior to the end of the season

    Sorry to drag the blog out of the courtroom, but I have a slight nagging alarm about a football related matter.

     

     

    Looking at, what I can now say with the benefit of hindsight, were the dark days of the last few months of Ronny’s managerial tenure, there was a general consensus that the players were either not good enough, or had the wrong mentality, or maybe both. Although a Ronny backer for probably longer than was merited, I did feel that certain players did display a weak mentality, and seemed to freeze when the big games came up (i.e. European qualifiers and Sevco semi-final).

     

     

    A lot of these players are still in the team, and have been higher achievers, under Brendan’s tutelage, so basically were good enough (for the SPFL at least) it would seem.

     

     

    However the poor function of the team against Sevco last Sunday has me questioning the mentality of some of the players again. I know it is only one game, in an otherwise successful season, and will have no bearing on the title, which is in the bag, but nerve shredding Champions League (sic) qualifiers are rapidly looming on the horizon. After the success of qualification for the group stage last year, these qualifiers are the (or even theee) most important games of next season. This importance is two-fold, firstly as we need to be competing in Europe, at least at the group stage, for our enjoyment of the season, and to keep us in a position of prominence in European football as the cartel begins to close the shop, and also to get the dosh to keep us ahead of Sevco and under our heel where they deserve to be.

     

     

    Before anyone replies saying I am displaying hunlike tendencies of entitlement if my support is dependent on success, may I just point out that it isn’t. The World is the way it is, I wish it was different, but it isn’t. I wish Celtic to be successful, rather than not, but my support is unconditional. I wish football embraced purer moral standards and was less avaricious, but it isn’t and I am increasingly a pragmatist as I get older.

     

     

    Niggling doubts about the temperament and mentality of some of the current group of players remain.

    Im not sure about that as tax affairs are Confidential, if some of them pop up when you haven’t heard from them in the media for years I reckon they need the money for whatever reason,the BBC had a list of some of the EBTers so maybe I’m wrong, maybe the BBC didn’t want to release the names of all who had them.

    I havn’t posted on CQN for a couple of years but I read your post at 15th march 1:37 PM, and although I’ve read other posts that I’ve found really interesting and worthy of debate or indeed forwarding to the related body/office for futher consideration, yours has piqued my heart.

     

    I’m not diplomatic – I speak from the heart, therefore couldn’t have written your concise comment without adding a further 5 eff words (at least). As far as I know, just from hearsay, Sircumcision is as sore as liquidation and not to be confused with circumcision which is a nuisance if you happen to supported a club from Govan.

    Gosh detailing the Tax Cass and EBT’s go back to 1999. If this is the case why did LNS restrict consideration to after 2002?

    The respondent in this case is the Attorney General for Scotland. The Attorney General for Scotland is Richard Keen, Baron Keen of Elie. His interests include golf, skiing, shooting and opera, whilst he is a member of the Bruntsfield Links Golfing Society.

     

     

    Lord Hodge’s interests include opera and skiing, and he is a member of Bruntsfield Links Golfing Society too.
