Ticketus secure their £40m of tickets

None of you will be surprised at today’s opinion from the Court of Session in Edinburgh that Rangers’ deal with Ticketus cannot be set aside, despite some absolutely pitiful reporting to the contrary.  It’s fine to get things wrong every now and then, we all get Duff information on occasion, but please….

It’s worth recording, Ticketus may only have paid £20m + vat but the tickets they own are worth in the region of £40m. High risk investments require a high return.

Rangers’ administrators argued that the deal inhibited their ability to rescue the company but the heroic Blue Knights submitted a bid accommodating Ticketus, undermining the administrators’ argument. If only the Blue Knights were in a position to strike a deal with Craig Whyte they could be regarded as helping the situation instead of being hapless fools.

Next up is HMRC, who have not capitulated and agreed to accept a few pennies in the pound.  They have not agreed to accept anything less than all monies owed.  Soon after that we will hear that no court has been able to set aside Craig Whyte’s security over Ibrox.  The most underappreciated man no longer in Scotland remains the only person with a reasonable chance of phoenix-ing Rangers.

The first 26,000 (approx.) tickets sold to each Rangers game for the next three years are owned by Ticketus.  In the event a phoenix occurs, Rangers will have to revert back to budgets from their glory days of the 1950s – we will soon be told this is a great omen.

If you are going to Ibrox on Sunday, take care and enjoy your visit.  Take photographs of the occasion and send them in, we’ll perhaps use them on a future edition of CQN Magazine.  It may prove to be the end of an era.

    the first thing to note is that D and P are making no attempt to say that this deal is “null and void” or can be overturned or is fraudulent….despite the crap spouted by the media poodles up here for weeks…(yes Keith…I’m looking at you!!)

     

     

     

    his answer to the first question…it’s a valid and enforceable personal contract under Scots law…and Ticketus are entitled in terms of that contarct to get whatever Rangers collect for the relevant season tickets over the next 3 years..in other words, if the current Rangers continue to exist then they will be handing over a substantial wodge of cash every year for the next three to Ticketus…

     

     

    the second question….he basically says….it’s up to you….I’m definitely not saying that you can…you’re the administrators…you need to decide if ripping it up and stiffing Ticketus is in the best interests of all creditors…if you want to rip up this deal and tell Ticketus that they’re singing for their cash, then expect them to be running back to either this court or an English one and suing your backside off…and that litigation will be very long, very expensive and impossible to predict and might even render D and P themselves liable to Ticketus!!!

     

     

    I can see why both sides are claiming “victory”…but it strikes me that D and P are not brave enough to breach this deal and render themselves potentially liable…

     

     

    I think it makes liquidation more likely…the only alternate is a sale that involves Ticketus being involved and recouping their dosh in some other way…if that happens then the continuing Rangers will be utterly hobbled financially for years…

     

     

    the judgement is also filled with comments that make me think that there will be significant further court time arising from this matter!!

     

     

    if they liquidate then Ticketus will be in line with other creditors…and Rangers will not exist…

     

     

    and remember…none of the above deals with the big tax case..

     

     

    nor Whyte’s “security”

     

     

    nor the case next week in London re the £3.6 million in Collyer Bristow’s account

     

     

    nor Bain’s unfair dismisssal

     

     

    nor the £15 mill owe to HMRC for the last ten months PAYE/VAT/NI

     

     

    so..in short…they still seem completely gubbed to me unless there is that very stupid billionaire out there
