Strict liability when playing to gallery

Being responsible is not always easy, especially when it comes to running a football club, where playing to the gallery offers vastly better short-term returns, and no doubt a rush of endorphins.

If your fans are engaged in an activity which regularly brings them to the attention of the courts, and your club into disrepute, it doesn’t matter what you think of the apparent offense.  You may chant an offending song in the shower every morning month, but your only public comment on the matter can be to chastise and urge fans to desist.

Clubs in Scotland voted against what is known as strict liability.  This means they are not held responsible for transgressions by their fans – and who wants to be held responsible for the actions of others who protected from personal liability by hiding in a crowd.

Part of the deal on not having strict liability is that clubs must demonstrate that they take all steps necessary to dissuade and educate their fans from carrying out criminal or regulatory offenses.  It’s simply not possible for club to tell fans their illegal actions were justified, as this would place the club itself in the firing line.

The nonsense following the Scottish Cup final is all background noise as far as we are concerned, but be aware the contagion will spread beyond those you could consider highly dysfunctional operators.

Solving Kids Cancer in memory of Oscar Knox

Our own Bundoran Bhoy will run the Edinburgh Marathon on Sunday on behalf of Solving Kids Cancer.  He has put in an enormous amount of work ahead of the event, for a cause which you are only too familiar with.

    I met a hun today, he lives in a valley a fair few miles away from mine, and if the truth be known, he is one of the nicer brits around, he is from Belfast, but still a hun for aw that.

     

    He mentioned football today for the first time for ages, no that I see him that often, but it must be the re emergance of the warbiola that done it, anyways, he isny that bad, he knows they are not the same club and that they are a fair few years away from us, he also knows that without a sugar daddy they are fecked, he would be one of the few who seriously dislikes Minty with a passion.

     

    Bought me a couple of beers to boot.

    Completed my 1st ever marathon yesterday in absolutely scorching weather which made it even tougher but I completed it for Oscar and Solving Kids Cancer and I’m well chuffed I did.

    A few years ago when they were still alive he was as brazen as it gets, since they died he hisny been as brash, I never mention football, he has to broach the subject, then he gets it with all barrels, maybes that’s why he disny mention it too often :-)

     

    He knows fine well, like all the huns do what happened, they cheated and got caught, end of, all that matters now is for it to be fishal.

    It will be interesting to see if/when UEFA impose sanctions, on the issues raised by Res 12, what the outcome might be.

     

     

    I’m assuming of course that the sanctions will be imposed direct and not through the SFA.

     

     

    Now the suggestion is any sanctions raised will be imposed on Rangers FC (il) and UEFA will EITHER look at this as a Legacy punishment to be settled by The Rangers Football Club currently playing OR as a retrospective breach by the Old Club and nothing to do with the Newco.

     

     

    Of course it will be an interesting to see the outcome.

     

     

    Yet for me no matter what the outcome is, it must surely be another nail in the coffin for the LNS Comission report; this in reference to their Club, Company Dichotomy.

    • Rangers will not be stripped of any of the five SPL titles won during the period in question

     

     

    The company that formerly ran the club have been fined £250,000 for not disclosing payments to relevant authorities

     

     

    • The commission found that the ‘oldco’ management did not take professional advice on disclosing the payments

     

     

    • It was ruled Rangers did not gain any unfair competitive advantage from the contraventions of the SPL rules

     

     

    • The non-disclosure of the payments did not mean any of the registered Rangers players were ineligible to play

     

     

    • As the players were still eligible to play, no sporting sanction or penalty is to be imposed upon Rangers

     

     

    Rangers’ current owners will not be held responsible for any breaches made by the previous company

     

     

    Of course, the findings do look ludicrous in light of what we know today but the Club/Company destinction if anything even more so.

     

     

    Does anyone think that UEFA will sanction the Old Company, exonerate the “current owners” and postulate that Rangers are the same Club.

     

     

    Not a chance.

     

     

    So whatever way the Sanctions fall, it will further undermine and discredit the LNS Report.
