Can History be bought, sold or transferred?

I was speaking to someone with only a notional interest in football last week who complained about football fans logic on several fronts including the notion of History.

I was asked, “What does it matter if a Rangers Newco playing at Ibrox being supported by the same people have an intangible claim to what happened in the past?

“Their memories remain, they cannot relive the past, what matters most is the future.”

Only a non-football fan could think like this, of course.  History is the context for whatever happens today, without it, the game is diminished, but we are now in a fascinating debate.  In practical terms, Rangers history could become quite a burden with the next few weeks.

The SPL are currently undertaking an inquiry into alleged illegal registration of players at Rangers during the 13 years before Craig Whyte rescued the club from the old board.  Hundreds of football matches could have been played, many trophies ‘won’ with footballers ineligible to play.

If these allegations are proven, games involving ineligible players will be marked as 3-0 defeats.  So much for the history, but what about the punishment?

Our friends at STV suggest that the SPL hold the view that the transfer of a league share from a liquidated company to a Newco would inherit historical rights from the liquidated party’s past.  For Rangers Newco, this would include penalties for around 500 games played by Rangers FC with invalidly registered footballers.

The tariff of which could sink even the healthiest balance sheet.

But still, if liquidated, Rangers FC, founded around 1872 and incorporated in 1899 would cease.  Newco can play wherever they like, it would be a new club.  The law would protect it from misdeeds of the old company while any assets, such as the badge design, film archive or historic Arsenal shares could be purchased by any third party, including Newco.  And before you bid, owning the badge design does not make you Rangers any more than if you acquired Rangers SPL share.

We’ve been told you can buy and sell history in recent weeks which is clearly nonsense but in finding a path through this subject you need to ask what is in the power of each and any organisation or group to affirm.

The SPL can transfer a share in the league and, in conjunction with the SFA, player registrations.  Both can also impose outstanding disciplinary measures.

Duff and Phelps can sell the badge design independent of the league share.

Craig Whyte can sell the stadium independent of all of the above.

No one can sell, buy or transfer 140 years of history, which is why football fans recoil at suggestions of a Newco replacing their team.

  6. I understand why fans of other clubs are agagainst the proposals that make up the Cheats’ Charter.

     

     

    But I don’t understand why they can say the same thing would have happened had it been us in the situation of near liquidation.

  7. An interesting take on ‘reinventing’ history that we need to see avoided at Rangers Newco is what has happened at Middlesbrough. Liquidated and reformed as a new company, the club’s badge heralded Middlesbrough 1986. More recently, they have gone back to the old badge of Middlesbrough 1875 (or thereabouts) and claimed that the liquidation was a minor point in their history and that the heritage of supporters, location and name mean that they are the same club – despite being separate companies. I would hate to see Rangers Newco airbrush history in the same way.

If they wanted this sorted all they have to do is look at RDB and TAF flo contracts, not exactly rocket science, but then again these buffoons dont exactly have to many brain cells.     A few things :

     

     

    Celtic are Champions 2011/2012, won fair and square, any tainting has been done by them.

     

     

    We are on the creditors list to the tune of £40k, what is this for? is it outstanding monies from the 28th December game? If so, has anybody heard what the situation is regarding the game against them on the 29th? Are we demanding money up front?

     

    I would like to think that we will not be passing 1 ticket on to them without being paid for.

     

    In the circumstance, that could be they cant pay for tickets, will we have 8000 spares or will one of our brilliant governing bodies bale them out?

     

     

    No to newco.

     

    No to Spl proposals.

     

    Yes to bill paying.

    Helping him along with my hand on his right arm as he glided at 0.4 mph past the reception with the very beautiful Filipino receptionist, the bold boy passed comment in a quite loud voice ‘ Paddy, she is gorgeous, want to half me for a Viagra’?

     

    Now I ain’t shy or easily embarrassed but the lady in question broke into a warm friendly smile and I replied, yip John she is indeed beautiful let me get the door for you.

     

    So just as I think we are getting out of ear shot the bold by raises his voice to say ‘ I can only give you half as I am keeping the other half in case I need a pish!’

    On another point, has anyone approached the agents for all the Rankers(IA) players from the last 20 years and asked them if they had kept a copy of their clients contracts. Shouldn’t be too difficult to dig them out. Oh and while you are at it (agents) did you receive a percentage from these EBT’s and check out the legality of it’s usage. (As you would surely have done in the interest of your client :-))

  19. On the one road, we’d have done it innaw I’d say mate.

     

    If I was a Hun I’d want to take the hit and start again in the lower leagues, I would think the history in intangible.

     

    For me it’s not really an issue as all of this has convinced me that Celtic must find another more honest league to play in.
