Doubt remains until we hear the words Prima Facie

Neil Doncaster has uttered the words “Prima Facie” more often than any other figure in public life since February when Celtic Quick News first asked if Rangers EBT payments were declared to the football authorities, almost always after the words “we don’t know if there is a”.  While we are all assuming the SPL have now established Rangers have a case to answer for illegally registering footballers for over a decade, it’s important to hear the words.

Rangers refused to submit information to the SPL for three months and only did so under the duress of a deadline, but we don’t know what they have submitted.  I have been concerned that Rangers would simply try to brass the entire episode out, submit the contracts the SFA and SPL already had, and deny having any record of side agreements.

Consider the clubs modus operandi in recent months and years.  Sir David Murray provided cover in March, categorically denying side contracts existed, while the current men in charge have been too busy to spare much time researching the issue.  A response of “We don’t have any information” would not have surprised me.  Rangers submitting full information – including details on the side letters which exist but which the BBC do not have – would surprise me.

The SPL should have realised months ago they would get nothing from Rangers without a deadline but they are in awkward position if the answer from the club is not what is expected.  It’s far from clear that they can take evidence from the BBC and may require information from the First Tier Tribunal verdict to substantiate what everyone knows.  The verdict is unlikely to confirm any names.

Until Mr Doncaster says “Prima Facie evidence exists” we should not assume this episode is on track to be dealt with.

    Original transfer embargo for one year challenged in court, contested on principle of being not within rules. So according to DR RFC(IA) propose a 6 month embargo.

     

    Would this also be out with the rules if one year ban was found as not legal.

    If I was a creditor I would be more intrested in how D&P can now say they have enough cash flow to run on in to July, paying full wages as they go, were did this money come from? some no doubt from the £2 mill for finishing 2nd in the league, money won by fielding a team not paying their tax.

     

     

    The SFA are now under the watchful eyes of FIFA, this is a good thing I believe as if the SFA don’t follow the rules they will be punished, unfortunately that could impact on all of the member clubs in Scotland.

     

     

    All of the parties involved in this life support pantomime, creditors, prospective owners, D&P, SFA, SPL, are being pushed in to a corner and one of them is going to have to take the part of the grim reaper in this act.

     

     

    In my view HMRC are holding off, I don’t know if the proposed CVA only covers a certain element of the tax cases, with the BTC sitting in the background not actually active in play yet. Maybe HMRC are waiting to see if a newco will appear before hitting them with the BTC and probably putting newco in to liquidation anyway, I just can’t see how they can separate the old from any newco, potentially their insistance on taking their history with them could prove fatal to any newco.

     

     

    If they still exist next season I expect that this time next year we will see a huge number of the SPL teams taking the option of ditching their debts and starting afresh.

     

     

    Maybe Celtic should start spending big money this transfer window afterall!

    Don’t underestimate FIFA on this one – they take a very dim view of civil court activity from renegade clubs. This is a nightmare for the Huns now.

     

     

    The three members of the independent panel will make their decisions, and I’d guess a suspension of some sort is the best we can hope for, and not at all an unrealistic outcome.

     

     

    You are right about the Laptop Loyal. They have simply confirmed what we always knew to be the case, regarding their championing of all things Rangers. A lot of people have been exposed during this farce, and the media are right up there with their blatant lies – this morning’s effort being the latest example.

     

     

    But telling lies to provoke a reaction from the likes of us is all they have. Best to just laugh it off. Enjoy their misery.

  12. I’m taking that DR article with a massive pinch of salt, after all, how many times has the same paper claimed that RFC’s various ‘saviors’ have ‘cut deals’ with HMRC, the SFA, the SPL et al? It’s wishful thinking from Keith Jackson, you can almost see the tears soaking it!

     

     

    I think even Regan knows that a suspension from the Scottish Cup is simply not enough and that total suspension or expulsion is probably the only sanction that will satisfy FIFA. That said, you never know with the SFA.

     

     

    In any case, its absolutely ridiculous that it has been allowed to get this far, the season starts in 8-10 weeks yet fans still don’t know what the hell they’ll be watching next season, its pathetic.

     

     

    And just saw that taxpayers money being used to fund the OO bigot bashes, what a bloody disgrace, you’d think Scotland would be doing everything it could to eradicate such a group rather than appease and indeed, fund them.

  15. The revised punishment for the huns will be decided by the Independent Panel. Regan has no input.

     

     

    They can’t reduce it to a fine only. They have already said that expulsion is too severe. That leaves no Scottish Cup or a suspension.

  17. Perhaps Green is trying to distance himself from Duff & Duffer to allow a backtrack and acceptance of the transfer embargo for the full one year (providing he can’t cut a deal for 6 months with SFA).

     

    Green know the gravity of the situation now that FIFA are involved. He can’t cut a deal, suspension is inevitable.

    Then there’s also the payments through EBTs investigation that is still to be reported to the SPL Board.
