Illegal EBTs and Sporting Advantage question remains

Sir David Murray, Campbell Ogilvie, Dave King, as directors of a football club, you presided over tax evasion. While ordinary men and women have no choice, or criminal urge, to avoid paying for public services, you directed a deception on an industrial scale.

Sir David Murray and Campbell Ogilvie have their influence and signatures all over this act. The SFA was quick to discipline and sine die Craig Whyte after he was out of the game, it must now charge Murray and Ogilvie with bringing the game into disrepute. The stale influence of cronyism at Hampden must be routed and seen to be so.

The SPFL instructed an inquiry three years ago but with this verdict in, the SFA must appoint their own inquiry.

Why did the processes at Hampden allow this to happen and continue without check?

Why did Rangers get their European licence in 2011 despite being in arrears to HMRC, in contravention of that licence?  Who was responsible for this decision?

Why was a director and signatory of Rangers illegal tax schemes elected and reappointed president of the SFA?

How transparent were the SFA and the SPL in their handling of these tax evasion charges?

Was the SPL inquiry commissioned to uncover the facts, or to meet a desired objective?  Who prepared the inquiry remit and who signed off on that remit?

Lord Nimmo Smith found that legally executed Employee Benefit Trusts did not confer a significant sporting advantage.  In light of what I have already read of the verdict, we must now discover if such widespread illegal Employee Benefit Trusts conferred a sporting advantage.  This question has not been asked yet.

It’s time for football to shake off the shackles of corruption in Scotland, as elsewhere.

    Success would have been UEFA investigating, I expect there are far better results available now :)

     

    It is now proven fact that the SFA are in the frame for losses in the millions to Celtic shareholders, Celtic PLC are responsible to protect our interests, remember we are talking millions maybe 10’s of millions, that needs to be addresses and the shareholders need to discuss this, me I’d like an EGM or at least someone at the AGM to ask if the board have made a claim for compensation against the SFA or if they have requested criminal investigation into serious organised crime ?

    And what of football? We now have a situation where three Law Lords have ruled that the club were tax cheats during one of their most successful periods on the pitch. We know the reason why they did it was that it meant Rangers could afford players it otherwise could not afford. This is not contested.

     

     

    How does this sit with Lord Nimmo Smith’s judgement that cheating on tax in this way conferred ‘ no sporting advantage’ to the club on the pitch?

     

     

    Some will now argue that cheating on your tax to be able to afford better players in your team is about nothing but conferring sporting advantage and many others would see matters in that light.

     

     

    Whether the Scottish football authorities – the SPFL in particular – choose to revisit this question, in the light of today’s court decision, is not yet clear. I await their call back to me. Many fans are already revisiting it of course.

    The West London CSC will be on the One Show tonight with yer man Rod Stewart…no idea what’s happening, except that my lhad is heading there now to join the on stage gang.

    I would think that UEFA have an obligation to investigate now.

     

    You know as well as I do, that the only way any kind of justice will be done, or be seen to be done will come from the shareholders of our club, I would like to think that the suits would at least make some sort of statement on behalf of the shareholders, but I won’t be holding my breath.

    They didn’t cheat. Well, yes technically it was a little bit illegal. But not cheating to gain an advantage. And there was no sporting advantage. The club while operated by the old company won fair and square. Then it went bust and the new company running the same club has nothing to do with this. It’s entirely financially healthy. Ok, it is a loss making business with no chance of credit and needing millions to see out the season. But that’s fine. It will be sorted.

     

     

    One more thing to think about: if we for a second buy the fiction that club and company are separate, and that the liability for tax evasion lies with the old company not the club, then surely that must mean the players were employed by the company and not the club? Isn’t it third party ownership if a club plays players owned by someone else??

    It was posted on here yesterday that around 40k tickets have been sold for tomorrow. Was up at the ticket office at half three today and I ony saw one person. The operative at the only booth open stated that sales were sluggish today. Hopefully this was just the time I picked and we will indeed get a decent and vociferous crowd.

     

     

    Even managed to get “my” own seat at the discount price of £25.

    Ps : the 18.00 hrs kick off doesn’t suit everyone, but I’ve heard from more than one person stating that it’s excellent for school children attending the game.

    After the laughter though – it was cheating. We were watching a rigged game. That we still regularly skelped them while we were going in to austerity mode and they were buying players they couldn’t afford, paying them wages they had to dodge tax to pay is something that has been overlooked too.

     

     

    The leagues we won were generally by a country mile during that period (Tommy Burns Thursday aside) – theirs were won by a point or a goal.

     

     

    And by the way – the same principle applies right now to their successor club. THe only club in Scotland not able to meet it’s bills paying out the second best wages in the Scottish game!! And they are allowed to continue with no investigation from the football authorities? They are openly admitting that they will need external funding, effectively that they may not be able to fulfill fixtures and not a peep from the blazers?

     

     

    I agree 100% with Paul67 today – a purge of hampden is the only way ahead. A new inquiry based on todays news is also a must. In fact it could be argued that Nimmo Smiths effort should not have been allowed until the tax case had gone to it’s final conclusion – if Oldco appeal then any inquiry should also be stalled so that it can deal in fact.

     

     

    So a mixture of laughter and anger remains.

     

     

    Bitterness is best left to those whose nature it is in. I’ll do righteous indignation, enjoy my clubs continued survival and success, the rebirth of sustainable football clubs in Scotland with the exception of the one – and it is increasingly clear that the Ibrox entity is despised by all and sundry who don’t claim allegiance to it. We were all right all along. Every club ever knocked out of a cup, relegated after losing 3 or 4 times to a team that financially doped itself up, missed out on Europe, teams in europe that they knocked out or denied points and therefore income to………. they are all owed justice.
