Illegal EBTs and Sporting Advantage question remains

Sir David Murray, Campbell Ogilvie, Dave King, as directors of a football club, you presided over tax evasion. While ordinary men and women have no choice, or criminal urge, to avoid paying for public services, you directed a deception on an industrial scale.

Sir David Murray and Campbell Ogilvie have their influence and signatures all over this act. The SFA was quick to discipline and sine die Craig Whyte after he was out of the game, it must now charge Murray and Ogilvie with bringing the game into disrepute. The stale influence of cronyism at Hampden must be routed and seen to be so.

The SPFL instructed an inquiry three years ago but with this verdict in, the SFA must appoint their own inquiry.

Why did the processes at Hampden allow this to happen and continue without check?

Why did Rangers get their European licence in 2011 despite being in arrears to HMRC, in contravention of that licence?  Who was responsible for this decision?

Why was a director and signatory of Rangers illegal tax schemes elected and reappointed president of the SFA?

How transparent were the SFA and the SPL in their handling of these tax evasion charges?

Was the SPL inquiry commissioned to uncover the facts, or to meet a desired objective?  Who prepared the inquiry remit and who signed off on that remit?

Lord Nimmo Smith found that legally executed Employee Benefit Trusts did not confer a significant sporting advantage.  In light of what I have already read of the verdict, we must now discover if such widespread illegal Employee Benefit Trusts conferred a sporting advantage.  This question has not been asked yet.

It’s time for football to shake off the shackles of corruption in Scotland, as elsewhere.

  1. Re: the recipients of EBT payments paying the tax they owe, the Finance Act 2014 allowed for HMRC to issue Advance Payment Notices (APNs). This means that they can ask for the tax they believe you owe them while a dispute is ongoing. If they’re wrong about it they pay you back with interest. Plenty of day rate contractors/freelancers were caught out with EBTs being sold as legitimate umbrella schemes. HMRC have been issuing APNs to these people for some time. So I’d expect to see a slew of stories about ex-players being skint as they attempt to pay the back-taxes on the basis of APNs that have already been issued. Perhaps they haven’t responded to HMRC on the basis that the case was still ongoing, but HMRC won’t accept that.So, unless the use of side-letters can somehow be used as a get-out, then HMRC will expect the amounts to be paid. Providers of most EBT schemes will not have issued side-letters – that’s the difference with the huns case.

  2. If the celtic board has been going about their business quietly in the background given the “unknowns” – NOW is the time for them to go for the jocular. Another aspect – the money they laundered into Scottish football could have liquidated Celtic (If we chose to buy at that level of debt) as well as other teams in Scotland).

    This is an old chestnut and we have moved on by miles from the conclusions and consequences pointed out here.

     

     

    Cambell Ogilvie signed off the very first EBT side letters in the wee tax case.

     

     

    Everything about that tax scheme – a tax scheme which was admitted and accepted to be completely illegal – was accepted by the Rangers directors as being unlawful from start to finish.

     

     

    HMRC wrote to Rangers and pointed out that as a result of them accepting the HMRC contentions, every single tax return submitted by the Ibrox club was deemed to be “false” for the period from 1998 onwards.

     

     

    Think on that – no no declarations – false declarations!!!

     

     

    When you agree to one of these tax scheme, the accountants who set it up spell it out to you that you are accepting a massive legal risk with no guarantees that it will work.

     

     

    Remember Paul Baxendale Walker and what he said to the BBC?

     

     

    He said that the scheme was legal PROVIDED the directors adminsitered it properly and was very smug about the consequences if they did not operate it properly.

     

     

    Imagine being one of THOSE directors tonight?

     

     

    And guess who THOSE directors were and think what some of them are doing now?

     

     

    And guess who benefited? Who got the money? And who had their agents draw up contracts saying that Rangers PLC would indemnify them IF it turns out they did have to pay tax?

     

     

    That is INDEMNIFY — doesn’t mean that the players are not liable. They were INDEMNIFIED by a company that is now bust.

     

     

    By a Chairman whose group of companies who are now bust!!!

    BDO have duties to ALL the creditors of RFC PLC.

     

     

    I have not read the whole judgement yet but a lot of those creditors will be rightly pissed off tonight if A) HMRC have scooped the pot and B) if they were in anyway misled as to the creditworthiness of the company – especially if they were so misled by those who benfited from EBT’S.

     

     

    BDO might want to pursue that line?

     

     

    I wonder if those directors had the same kind of clause in their contracts as Charlie Green? Not that it will do them any good.

     

     

    I wonder what BDO’s take will be on director’s who negligently administered a disasterius tax scheme that ends up costing ordinary creditors a fortune?
