Illegal EBTs and Sporting Advantage question remains

Sir David Murray, Campbell Ogilvie, Dave King, as directors of a football club, you presided over tax evasion. While ordinary men and women have no choice, or criminal urge, to avoid paying for public services, you directed a deception on an industrial scale.

Sir David Murray and Campbell Ogilvie have their influence and signatures all over this act. The SFA was quick to discipline and sine die Craig Whyte after he was out of the game, it must now charge Murray and Ogilvie with bringing the game into disrepute. The stale influence of cronyism at Hampden must be routed and seen to be so.

The SPFL instructed an inquiry three years ago but with this verdict in, the SFA must appoint their own inquiry.

Why did the processes at Hampden allow this to happen and continue without check?

Why did Rangers get their European licence in 2011 despite being in arrears to HMRC, in contravention of that licence?  Who was responsible for this decision?

Why was a director and signatory of Rangers illegal tax schemes elected and reappointed president of the SFA?

How transparent were the SFA and the SPL in their handling of these tax evasion charges?

Was the SPL inquiry commissioned to uncover the facts, or to meet a desired objective?  Who prepared the inquiry remit and who signed off on that remit?

Lord Nimmo Smith found that legally executed Employee Benefit Trusts did not confer a significant sporting advantage.  In light of what I have already read of the verdict, we must now discover if such widespread illegal Employee Benefit Trusts conferred a sporting advantage.  This question has not been asked yet.

It’s time for football to shake off the shackles of corruption in Scotland, as elsewhere.

  1. BBC saying SFA and SPFL have little appetite to take things further. Well, what do you know…………..Way too many of them complicit in this. How can we take it forward? Pass a resolution to go after monies that should have come to the shareholders of clubs like Celtic? Can individual shareholders or groups of shareholders take such action?

    LNS JUDGEMENT was based on the ebt being lawful but it has now been proved illegal so by simple logic there MUST have been an unfair sporting advantage !!!

    ………….. could sumbdy get a hold of all the old Bhoys, either of the Frank’s……. and any loquacious Tim smitten by the smell of greasepaint or the sound of a clapperbpoard and politely ask them to stick to the facts as they are – the Huns cheated therefore the titles are tainted.

    Is it not the case that Rangers can appeal this decision.

     

    If that is the case ,then surely until they either decide not to,or they lose that final appeal.

     

    Then this decision is not finite.

     

     

    Therefore no action can or will be taken by the authorities.

     

     

    Secondly.

     

    In the event that this ruling is the final outcome.

     

    Do you think it is likely that The old one Rangers will be stripped of titles and trophies,and these then reappoint end to the runner up’s?

    LNS had a limited remit. Campbell Ogilvie presented allegedly misleading information. I should stress that LNS was engaged in a private capacity. His opinions and conclusions were not binding in law. Today’s judgement by 3 law lords is binding. Not only is their conclusion superior, but it renders the LNS conclusion flawed and irrelevant.

    It would appear that, as you are entitled to, you are having a go at the SNP.

     

    However, in doing so, do not forget that on Admin day, Alec Salmond was joined by Gordon Matheson, Labour Leader of Glasgow Council in proposing to put in a wee word with HMRC on THEIR behalf.

     

    One of his stated reasons for doing so was, that like Celtic, THEY had carried Glasgow’s good name all over the world.

     

    That would be to places like Manchester, Barcelona, Newcastle etc.

  10. I welcome like you all do the Court of Session ‘s decision on the big tax case.

     

    They (deidco) have the right to appeal but they must have grounds to do so, they cannot appeal for the sake of it. Regardless if they have grounds, they won’t appeal simply because they cannot afford to financially.

     

    Today’s decision apart to the visible world nothing has changed. Why because we still have a Club purporting to be the same, evidenced by the facts that they incorporate the name rangers, they wear the same badge (of dishonour), they play out of the same stadium as oldco, they wear the same strip as oldco, to the world they are oldco, except when it comes to paying what is owed to you and me (cue for a song), they are newco.

     

    There is only one way that the visible world will recognise they are no more, either as an oldco or newco, Third Lanark, put the Padlocks on and chuck them out of Scottish football. Until this happens nothing has changed.

     

    They are putting their two fingers up at us all, defiant to the footballing authorities and will not lie down.

     

    I will not rest until they are wiped from the footballing map. I like you have accepted their club died in 2012. I will make a prediction despite HMRC getting the decision they deserve they will always be a rangers to the world…

     

    I live and dream of Third Lanark.

    ROBERTTRESSELL. While I agree with the sentiment in your post I have reached an age in life where I dont think justice exists if you have enough money you can buy your own form of justice. If you have the majority on your side you can shape your own form of justice.It needs a very brave man or men in a position of high authority to highlight that the minority are being fed bull by the majority and they will not accept what has happened and what is happening but I see no sign of that brave man ( Peter Lawwell ) or men ( the Celtic board ).It only takes good men to sit on there hands for evil men to succeed.     There will be no appeal. You can only appeal on a point of law. Three law lords have deliberated at length and come to a conclusion. They have found for HMRC. Those in receipt of these trusts will be receiving tax invoices in due course.

    From what I have heard today no one has as yet figured the full consequences of today’s decision in the big tax case.

     

     

    All the commentaries on the Radio have so far concentrated on how HMRC will use this decision to chase other companies who have used similar schemes.

     

     

    Further, there are comments about how HMRC will make a claim on Rangers PLC for the sum now due ( unless the decision is appealed by someone ) plus interests and expenses. Further, the statements also say that HMRC are not likley to get too much in the way of pounds shillings and pence from BDO due to the value of their now established debt compared to the money available for distribution to creditors by the Liquidators.

     

     

    Right now, Radio Scotland are debating about LNS, Sporting advantage and so on.

     

     

    Yes — well that is all well and good.

     

     

    However, remember that the sports media are journalist with no legal knowledge and you are yet to hear from any financial journalists of any weight.

     

     

    Far more importantly you are yet to hear from many of the major players who have yet to have a say on this and who may well yet have a significant role to play.

     

     

    Back in the day, many of us who were labelled “bampots” – including Paul 67 – wrote repeatedly about how far wrong the press speculation was in relation to this case.

     

     

    That press speculation is no less accurate today.

     

     

    There are huge and unforseen and as yet unpublished and unwritten about consequences of this ruling.

     

     

    It goes far beyond what is being reported on television and radio and much of what is being stated in the press today is pure and utter balderdash.

     

     

    Make no mistake, what has not been said today is of far greater relevance and significance than what has — and unbeliveably the entire debate has gone down the wrong road yet again.

     

     

    I am out for my dinner tonight and cannot elaborate at the moment, but trust me — the whole consequences of this are far from being thought through by anyone commenting on it tonight.

     

     

    Today has seen the potential start of a whole load of litigation and the LNS ” decision” has about as much legal weight as the strand of a feather!

     

     

    By this time in a week, a fortnight, a month or a year from now — you will hear a very different sing than the one being sung today.

     

     

    By the way, Mark Daly and his team will be working overtime as will Alex Thomosn.

     

     

    You should watch the men who sold the jerseys from start to finish in light of today and figure what Daly was not allowed to say at the time.

I had the impression he had given up on “the men who sold the jerseys”. Will the BBC allow him to investigate further? They seem to have no appetite for that either; well, their Scottish sports department at any rate.

    The media are circling the wagons. ssb talking bollox about simonovic and books by Unknown players rather than discussing ebt. The usual claim by journalists that they don’t know anything about anything. Radio Scotland spend 20 mins on it (though Tom English did admit they did have a sport g advantage but queue lots of talk about being bored with it etc).

     

     

    So everyone. All Celtic need to do is challenge the SFA and the house of cards will fall. Will they.

  23. So. Justice – of a sort – eventually catches up with the ethereal entity known as “Rangers”. For those of us who paid good money to watch our team cheated out of titles, cups, and European revenue, it is a bittersweet moment.

     

     

    So much brilliant stuff has been written today, encapsulating many of my own thoughts. But, for what its worth, here are some “random thoughts” – as a better man than me once put it – on the where the dramatis personae stand today…

     

     

    Sir David Murray: utterly ruined and now confirmed as a spiv of the highest order. A complete charlatan, the epitome of Thatcherite economics and Scottish Masonic Old-Boys’ Club cronyism. When you consider all the hatred poured down on Fred Goodwin’s head, it is beyond incredible that this man has escaped opprobrium. And continues to be taken seriously by papers like The Herald. He will go to his grave knowing his “fiver-tenner” economics destroyed his club. A horrible, horrible blight of a man, and arguably the worst single individual involved in Scottish football, ever.

     

     

    The SFA: completely bereft of any authority in the game today. Utterly unable to manage our game and – what’s worse active participants in the biggest scandal in British football history. If there was any sense of morality in the game, they’d be switching off the lights in Hampden for good tonight.

     

     

    Dave King: Now confirmed as a director of a club engaged in industrial scale tax-evasion, as well as a convicted tax cheat in South Africa. Also facing an imminent contempt of court hearing. As big a spiv as Murray and Whyte – the fact he is not being chased out the door by the Mordor Hordes just confirms how incandescently stupid they are.

     

     

    Craig Whyte: Our Hero remains an enigma. Is he the only one associated with RFC to have genuinely suffered during this escapade – or is he a simple man on the make, who saw a chance, gambled, and will probably end up more or less OK? Whatever the truth, his frightened visage, googly eyes, cheap suit and five quid haircut will remain in the hearts of Celtic fans everywhere, for a very long time…

     

     

    Walter Smith: Surely the end of him being seen as anything other than an unimaginative, neanderthal, chequebook manager, whose only successes were financed by ripping off the tax-payer on a scale previously unseen anywhere in world football? (And Unirea still humped them!)

     

     

    Keith Jackson et al: Where do you start with the football MSM? An entire industry has been trashed by Murray and this scandal. Journalists exposed as nothing more than stenographers. The best were simply cowardly; the worst betrayed their profession every day and in every studio up and down Scotland. With the possible exception of Glenn Gibbons none of them – not one – emerges with anything other than a reputation in shreds.

     

     

    James Traynor: Without doubt the absolute worst of a terrible bunch. Journalism students of the future should study this man’s career in order to learn how not to do it.

     

     

    Mark Daly: Vindicated.

     

     

    Paul67/Phil/RTC: Vindicated again and again. The only truth-tellers in this whole saga. They should be on a stage, wearing medals, a la the final scene of Star Wars.
