McIntyre witness evidence of DOS scheme tax overdues

For any football club to be licenced to play in Uefa competition it has to be up to date with social taxes. The world wondered why in the years prior to their liquidation owing tens of millions to HRMC, Rangers managed to remain up to date for every licence application (made through the SFA).

Football authorities are bound by certain limitations. They can oblige clubs to make them aware of any overdue taxes, but if this information is not forthcoming, they have no powers to demand information from the tax authorise. In short, if you lie, you will get away with it, until and unless you are caught.

Nor can football authorities deal in information of dubious probity. “Some guy on the internet gave me this document” which they should not legally be in possession of, is not the basis to charge a club.

At Craig Whyte’s trial at Glasgow High Court this morning, former director of former Rangers, Donald McIntyre, faced questions from defending counsel and also former director of former Rangers, Donald Findlay.

McIntyre was shown a document dated 2010 from HMRC to Rangers saying tax for PAYE and National Insurance was due on Rangers Discount Options Scheme (DOS), involving players Tore Andre Flo, Craig Moor and Ronald de-Boer was “payable in full”. This tax was never paid and £500k of interest accrued until the club went into liquidation.

McIntyre told the court Rangers had “no choice but to accept liability” as due to the existence of a “side letter”.

Despite this, Rangers signed off their licence application in March 2011, which enabled them to take Scotland’s Champions League qualification spot for season 2011-12.

The irony of this information coming out in a fraud trial will not have escaped you. Some key points:

Information that Rangers were overdue to HMRC prior to their Uefa licence application in 2011 has been confirmed by a competent officer of the company for the first time, in open court.

Rangers DOS scheme for Flo, Moore and Ronald De-Boer was not subject to the SPL’s Lord Nimmo Smith Commission inquiry and has not, thus far, been investigated.

Mr McIntyre is still in the witness box giving evidence.

    Canamalar … this ‘best interest of the shareholder’ thing means whatever people want it to mean…

     

     

    I think the best outcome for the Board (and what I believe they were hoping would happen) is that, behind closed doors, a deal would be done ….the bad guys would realize that the crap was about to come out, deals would be done to clean things up somehow, and the game in Scotland would go on …. Celtic would be far enough ahead financially, and would go from strength to strength …. Celtic run away with titles, Sevco would still exist, dirty laundry would not be aired, and everyone would go forward …..

     

     

    conversely, if the crap all comes out, the game in Scotland suffers a real hit to its credibility … which is worse for some, but bad for all involved …. and Celtic may suffer if the league in which it plays is seen to be a sham … (even if Celtic were not involved)….

     

     

    if the truth comes out, the SPL takes a hit, maybe loses some sponsors, which means less money to spread amongst the various teams …. less revenue for Celtic … and volia, it is in the best interest of Celtic shareholders for the truth not to come out …

     

     

    I have seen in my 25 years that anything and its opposite can be justified under the BISH test …

    I honestly believe sevco couldn’t care less about what rangers done, however if there is a way we can pin it to the SFA and make them responsible as auditors then I believe the Plc need to take action, for the last 4 years all their superior resources regarding Res12 have been engaged in thwarting our quest for justice, ask Tony Donnelly 0)

    there are clear guidelines on this and thats the only reason Res12 was not dismissed at the start, it registered with both the city and the authorities and those same people are still watching. All shareholders interests must be protected not only corporate bulk.

    I am pretty familiar with the law on oppression cases. As always, I am not licensed in Scotland, but the case law on this is pretty consistent in most of the common law countries … from Foss onwards… and the Corporation laws on this are also quite consistent …. honestly, I dont see this as an avenue whereby Celtic shareholders will get redress …

     

     

    but, you are more aware of what was said and done in this case, so I will defer to you on this… and hope that you are right, and that some good will come from all of this (if only so I can get back to watching the bhoys!)

     

     

    I bought a St.Pauli shirt today … may be my new team to watch until we get this mess sorted out! but, to paraphrase a great … MiT (St. Pauli fan) will never sound as right as MiT (Celtic fan).

    I told Auldheid the very same when I saw him last, the little man is expendable fodder, they who must be protected will be and that includes the suits of Celtic sad to say, you are banging your head against the proverbial brick wall mi amigo, and they know it.

     

    I have said from the get go that withholding money is the ONLY thing they will react to, everything else is to be honest, a waste of time as is becoming clear.

    The Plc at the time could have led the way to clean up the game in scochland but decided it wasn’t worth the effort, behind closed doors and controlling the narrative was their response, which in effect is to condone the corruption.

     

    I’m reminded f one of our earliest meetings where I was told winning the farry case was a great victory, one simple question killed that argument, Why am I here now then ?

    I have often thought the longer this debacle has ran – why UEFA do not require some form of Financial Authorities (approved) Certification as part of FFP when any Club applies for a European Licence.

     

    Hell – try taking £10K cash out your account and then pay it into another account (say your Kid’s) and you have to undergo all the ‘money laundering’ checks.

     

    There has to be a more accountable Auditing Process by the Governing Bodies. If the pan-European system is so lax – surely there must be other financial breaches similar to the SFA/Oldco out there?

    three and a half hours till work, might be a good idea to get a little kip. I hate my hackles, they keep me awake. I’ve sat and read some amout of shite over the last few months and managed to ignore the cyclical arguments but tonight I was astounded of forehead to read what was offered as fact from someone who is respected and taken at his word by most, spin is the only conclusion I can reconcile that statement with and spin that supports the SFA is scurrelous in my book.

    I disagree with everyone on this but am too tired to explain why.

     

     

    I think the SFA and UEFA if necessary did have the right to go to the Tax authorities and seek independent clarification but am too tired to seek out the appropriate sections and powers.

     

     

    The fact that they didn’t is damning but is irrelevant to the impact of the current evidence. Whether they could have clarified things before now has no bearing at all in the event that what is now being said is wholly different to what was submitted to the SFA at the time — and that is the key issue.

     

     

    Reading Paul’s article I see he ends with an assurance that no stone will be left unturned in looking into all of this.

     

     

    Clearly, there are many on here who think that is bullshit, and it may be so, but then again not 72 hours ago there were others who predicted that Donald Findlay’s main job in this trial was to protect and preserve the reputation of David Murray.

     

     

    It appears to me that he is in fact doing everything he can to point out that Murray buggered up Rangers PLC long before Whyte arrived on the scene, and that there was a practice of non disclosure and possibly false accounting and submissions well before Whyte got his hands on the club.

     

     

    If that is correct, and I fail to see how it isn’t, then how does that testimony stand in comparison to the written submissons prepared by the club as at March 2011? If a completely different set of facts are now being spoken to, then one can only conclude that the previous submissions were wrong or inaccurate, and irrespective of whether the SFA did jack shit or not at the time, the whole thing is worthy of a further commission and investigation now.
