McIntyre witness evidence of DOS scheme tax overdues

For any football club to be licenced to play in Uefa competition it has to be up to date with social taxes. The world wondered why in the years prior to their liquidation owing tens of millions to HRMC, Rangers managed to remain up to date for every licence application (made through the SFA).

Football authorities are bound by certain limitations. They can oblige clubs to make them aware of any overdue taxes, but if this information is not forthcoming, they have no powers to demand information from the tax authorise. In short, if you lie, you will get away with it, until and unless you are caught.

Nor can football authorities deal in information of dubious probity. “Some guy on the internet gave me this document” which they should not legally be in possession of, is not the basis to charge a club.

At Craig Whyte’s trial at Glasgow High Court this morning, former director of former Rangers, Donald McIntyre, faced questions from defending counsel and also former director of former Rangers, Donald Findlay.

McIntyre was shown a document dated 2010 from HMRC to Rangers saying tax for PAYE and National Insurance was due on Rangers Discount Options Scheme (DOS), involving players Tore Andre Flo, Craig Moor and Ronald de-Boer was “payable in full”. This tax was never paid and £500k of interest accrued until the club went into liquidation.

McIntyre told the court Rangers had “no choice but to accept liability” as due to the existence of a “side letter”.

Despite this, Rangers signed off their licence application in March 2011, which enabled them to take Scotland’s Champions League qualification spot for season 2011-12.

The irony of this information coming out in a fraud trial will not have escaped you. Some key points:

Rangers DOS scheme for Flo, Moore and Ronald De-Boer was not subject to the SPL’s Lord Nimmo Smith Commission inquiry and has not, thus far, been investigated.

A note of caution: this is all new information, and anyone who tells you there is an easy way to navigate to the desired outcome is almost certainly overlooking a great deal.     That’s a lot of bad news to deal with all at the same time.You and the loved ones affected will need a lot of strength to get through such a difficult time and hopefully will share the burden with each other.

     

    I don’t pray but I will be wishing you all whatever it takes to help deal with such a sad period and you will never be far from my thoughts.I’m sure the love and memories will provide succour and eventually bring a smile to your saddened hearts.

    What has been revealed to date through the evidence provided, validates what has been speculated on, but never proven, over the last few years.

    I don’t give a toss what happens to any of the parcel of rogues, except for the SFA.

     

     

    It will depend on who (and I include Celtic) uses this information to call the SFA/SPL, as was, to account; for account they must.

     

     

    There is an arsenal of smoking guns being revealed.

     

     

    Many people, including, I hope Celtic, have been waiting for sworn testimony from those involved, before proceeding with a course of action.

     

     

    This should involve title stripping and resignations, at least.

     

     

    When this is over, there will be decisions to be made by supporters.

     

    We already have some who have turned their back to the game and if there are no consequences , then there will be more.

     

     

    That would be an Appalling Vista for the game.

  10. The main reason given was that LNS didn’t strip titles because the ‘techniques in question were available to other teams therefore no sporting advantage’. Putting aside the fact that the wee tax case/DOS was not included in LNS, today in open court under oath, Donald McIntyre admitted that at a meeting with HMRC they provided him with a copy of a side letter, therefore RFC had ‘no option but to accept liability’. His words. The side letter was likely for either Moore, Flo or De Boer. Regardless, the scheme in question was not available to other Clubs therefore even going by LNS logic they are bang to rights re Title Stripping.

     

     

    As for Res 12, McIntyre admitted they were aware of the wee tax case as early as November 2010. It wasn’t declared to the SFA come 31st March 2011 in their submission for a UEFA licence. It’s important to note they didn’t appeal the wee tax case and it was never paid. Murray simply ignored it. Again, bang to rights. The Huns and Regan.

     

     

    Res12 and Title Stripping in one day, and its only day 3 of the trial. Someone, somewhere must be raging.

  11. Scott Sinclair is quite obviously a fans favourite and he has certainly contributed on the goals front but for some strange reason, I am yet to be convinced. On the other hand, I have been and remain a fan of Callum McGregor.

     

    I think it comes down to players in whom I feel confidence regardless of who we are playing against. Calmac comes into that category as do Simunovic, Tierney,Roberts, Brown and Dembele. Players who are very close to being there ( for me ,remember ) are Armstrong,Griffiths and Rogic.

     

    Gordon has his moments,Lustig seems to have had his best season,Boyata is still improving and I remain hopeful, Biton can be excellent but I fear Scottish football is not for him and Forrest can be brilliant….or not .

     

    I know I have missed some out but, overall,although I am happy with what we have , I still don`t feel as confident as I would like to when we play CL games.

    Craig Whyte, could not care less if he is found guilty of either charge. What I am enjoying though is seeing it all played out in Court, showing that oldco were cheats and were up the creek without a paddle.

     

    Will Minty give evidence, in my opinion no chance, he has them all in his pocket and the Brethern will protect him. Will he be stripped of his title, will oldco be stripped of theirs, no chance in my opinion.

     

    Findlay is our new Hero although his efforts will go unrewarded with no action being taken.

     

    Freemasonry is alive and kicking in Scotland.

     

    If HMRC win the appeal it will be a small victory unless titles are stripped and the SFA took to book. It is at times like this I wish Fergus McCann was still in charge…

    The logical moral legal and correct consequences are title stripping, knighthood stripping, jail time for many, the end of Rangers and the demolition of Ibrox. Therefore, a one pound fine max is my guess.

  23. I’ve been working from home the last couple of days while looking after my unwell dog who had a procedure last week that has left him…let’s just say resenting me. Anyway, I’ve been released to go visit the pub and I’ve managed to catch up on all the White trial goings on properly.

     

     

    I think what has been covered so far has confirmed what we all though; Craig Whyte didn’t sink the Titanic, he just pinched some of the silverware (ok, no footballing silverware…other than flogging to St Etienne velo) before hopping on to a lifeboat while they were calling for women and children.

     

     

    Anyway, about Sunday. I didn’t watch the match until last night. A much more pleasant way to enjoy THAT kind of game. I, amongst others on here, have always rated McGregor – he may not be a player for every match but his contributions over the course of a season are worth their weight in gold.

I’m pleased you’ve picked up on the implications of the DOS re LNS enquiry/Title Stripping. I’m a bit miffed that James Forrest and John James haven’t.
