Photographing Police officers.. There is a common belief that it is illegal to photograph the police, this is not true but chances are they will arrest you.
It would ordinarily be unlawful to use section 58A to arrest people photographing police officers in the course of normal policing activities, including protests because there would not normally be grounds for suspecting that the photographs were being taken to provide assistance to a terrorist. An arrest would only be lawful if an arresting officer had a reasonable suspicion that the photographs were being taken in order to provide practical assistance to a person committing or preparing an act of terrorism.
There is nothing preventing officers asking questions of an individual who appears to be taking photographs of someone who is or has been a member of Her Majesty’s Forces (HMF), Intelligence Services or a constable so long as this is being done for a lawful purpose and is not being done in a way that prevents, dissuades or inhibits the individual from doing something which is not unlawful.
That’s what I was trying to ascertain earlier as as far as I know it’s not illegal to take pictures of anyone in a public place even the police.
The police stopped me in Buchanan street asked me a few questions about taking pictures. I answered there questions and then asked them if Street Photography was no illegal, they said no..
2013 so that’s why I was asking if they changed the law.
That they will chance their arm is clear but I think especially round intimidation at the football it’s a matter of standing your ground in regard to filming and photos.
And as far as I know they can’t look at your photos unless they invite you back to the station with representation present etc etc. you can offer to show them and I have done on occasion but as a courtesy more than as to answer their demand.

I think they can look at your photographs “if they have reasonable suspicion” but they have no right to delete them. Unfortunately “reasonable suspicion” is a bit vague

I know of quite a few cases of photographers being harassed by the police including a friend of mine. They don’t seem to know the law and that’s why the Met Police put out the statement. I don’t know if the law is different in Scotland.

Often the problem with having any dealings with the police is it can end up with your word against theirs. ..and the judge will normally believe them. .After all the alternative is. .an appalling vista
I live in Switzerland mate the polis are easy intimidated:)) They s top me quite often I got to know most of them now round the station:)) I think they’ve worked out I’m not a terrorist.

There have been cases of the police asking for any photographs taken before or during an incident if they could supply the images to help the police. I would think the police would not be bothered unless you are seen as a hazard or are breaking the law… or the police officer is a git.

I work as a photographer and I have a personal side project York After Dark (it’s on Facebook if you are interested) so I am out late at night with my camera and tripod. I often see the police and they will chat to me and I get no grief at all. The police in York are used to lots of people taking photographs and so they don’t see a problem.
Basically you can take pictures of pretty much anything in public places except in military areas.
2) What Can You Photograph While on Public Land?
Just about anything and anyone, and you don’t need permission. If you are standing on a public sidewalk, and spy Madonna walking into Starbucks, you are free to take her photo. If you shopping in LA, and observe the police busting Alec Baldwin for impersonating an actor, you are free to photograph Baldwin and the police arresting him, assuming you are doing so from public property. If you encounter an accident scene, there are no restrictions to your taking photos of the scene, the people involved, the EMTs, and police officers.

At the game today, first away game in a long time. Great game, no hassle until a squad of police and stewards lifted a wee boy from the home support.
Then a platoon arrived to get the guy who stepped on the track at the third goal. Probably one of the first out at FT to get back to the car. The three of us had to walk between a row of horses with a small army of cops behind them. My mate is a cop and he could not believe what was going on. Shambolic over reaction.
