Urgency behind SFL plan

812

Dictionaries across the English speaking world will need to be updated for the term ‘loose cannon’, currently- noun, a person whose reckless behaviour endangers the efforts or welfare of others.  In future they should be appended, ‘Charles Green’.

For months Charles has been busy telling anyone who would listen to him that his The Rangers club will never appear in the Scottish Premier League.  Now, he has told the world the Scottish Football League are set to propose reconstruction which would see the end of the SPL and create one fewer step between his new club and top flight football.  He told TalkSport, “I understand that the Football League [presumably he means the SFL]on Wednesday are having a meeting of clubs and it’s the intention of the executive to unveil what they think would be a restructuring plan for Scottish football.”

Green is one of the few from the SFL who have had anything to do with the plan, few were aware of it until his announcement yesterday.  I hear the other architects of the plan inside the SFL are chief executive, David Longmuir and Airdrie United director, Jim Ballantye.  My source also told me SFA president, Campbell Ogilvie was “in on the ground floor with the SFL plans”.  They will all, surely, be frustrated that Green was out there with the news before the league were.

As STV today reported, the SFA have set a deadline of 30 November for the leagues to agree a reconstruction plan, “threatening they would instead push through with their own plans to bring about change by the 2013/14 season if an agreement could not be reached”.  That’s next summer!

Timing here is everything, and is urgent.

The SPL Commission will soon convene into Improper Registration of Players at Rangers…
the predecessor club of The Rangers…
whose SFA membership The Rangers benefited from in order to compete in league football with less than three years accounts…
and who consequently are liable for penalties served on Rangers.

If found guilty, and no one is holding to the pretence otherwise anymore, the consequences for The Rangers are enormous.  Forget about the inevitable stripping of titles, this is of historical consequence only, prize money [of circa £15m]will also be reclaimed and a punishment levied.

As I have said before, the toxicity of the old club is simply not viable to continue with.  Newco Rangers either have to start from scratch, or the structures of Scottish football need to brought down with any penalties due wiped from the slates.

The Rangers share prospectus, now overdue, will have to detail these risks to the company unless an alternative narrative can be agreed and presented.

The chances of the SPL giving this Longmuir, Ballantyne and Ogilvie plan serious consideration are remote.  It is a nonsense, will be rejected by the SPL and may even face opposition from those clubs within the Scottish Football League who stand to benefit from the change, but will find the motivations behind it unsupportable.

Scottish football is enjoying a well-earned renewal this season, no thanks to the game’s administrators, but the serious allegation, that many leagues and cups were won for over a decade by a club which was paying players against the tax laws of the country and against SFA, SPL and Fifa regulations, has yet to be resolved.

Until we know the truth, hear the consequences, know that those responsible are no longer in control of the game and have been banned for life from future involvement, there can be no talk of expedient change.

STV’s revelation that the SFA have imposed a 30 November deadline is the greatest illustration yet why “heavily conflicted” Campbell Ogilvie should have been on garden leave months ago. All those who carried out the duties which led to this shambles, and who have legal responsibility for it, should receive the life ban from the game that was promptly applied to Craig Whyte.

A swift rebuttal of this nonsense with a clearing of the decks is required. There can be no discussions on these matters while inquiries are on-going and those responsible for recent events are still running the game.

    Deceit in Scottish Football?

The attempts to fast-track Sevco into a league they don’t want to play in, and virtually no one would welcome them in, are becoming tiresome.

  2. The sooner Celtic get out of this shambolic excuse for a national football league set-up the better.

Not sure where our future lies – but I would like to think that it will be in some sort of pan-European league, possibly- at least initially – with other ‘big’ clubs from other ‘diddy leagues’ such as Holland, Belgium, Scandinavia… (?). Then, hopefully, a fully-blown European Super League.

Wishful thinking? Possibly… but anything would be better than this!

Celtic would be welcomed with open arms into such a set-up

    HH!!.

    Great article Paul.

Notwithstanding the unconcluded governance issues you highlight, changing number of teams/leagues is mere window-dressing.

Of greater importance is grassroots coaching and better facilities as well as a move to summer football.

Play-offs l do agree with and would enhance end-of-season excitement.

Sounds a bit, er convenient to me …

  5. Excellently put, Paul.

It will be interesting to watch how this latest stunt unfolds in the days ahead. And it can only be a matter of days.

In my waters, I have a feeling that we’re witnessing the end of masonic control of Scottish football: the shock waves from the demise of the Foe Malign are simply too great; there is no longer a unfiying cause behind which all the bretheren can rally.

Very good piece by Cosgrove but c’mon, where’s he been?

I’m an engineer with diddly squat in the way of a finance background or insider contacts but when Murray went to the ‘loyal support’ for £50 Mill and got 1, even I thought at that time the game was a bogey.

100 years of sectarian employment policy, where were our Scottish media, where was Stuart?

Not good enough for them finding voice after the internet bampots have rumbled them.

WHY are there conflicted people running our game, where has Stuart slated them?

He’s not the worst culprit…….by a long way………they are ALL complicit.

  7. Great article again Paul.

I still can’t believe Jim Ballantyne the man with his RFF badge on is still involved in this.

I hope all Scottish fans stick together on this again, we are the lifeblood of the game not these corrupt morons.

  8. Reconstruction is only shuffling the same amount of money around. It will have no real benefit.

What is needed is amalgamation of the small teams into ‘super teams’.

Of course, the idea will horrify many, but is it better to see your wee team go out of business or join with other local fans in supporting a team that can compete with the best and be economically viable?

I’m not sure who would want to link up with Sevco though. :-)

  9. Ballantyne is a sleekit piece of work he is the one to watch here airdrie are just a sideline it sevco that is his true love and he will use any means to get what he wants he is very well connected i have had past dealing with him

It was reported from MSM to social media that the FTT case would issue its report in October 2012, IMO that is why the SPL commission set November 2012 as its time to hear the ole Rankers case, the commission was banking on a backdrop of a widely expected guilty verdict in the FTT case, the SPL commission then could easily counter the allegations of a witch hunt, I believe we will wait till the FTT deliver a verdict

  12. The Airdrie guy is the same one whose known as a well known Sevcovian? Not to mention RC Ogilvie. I knew when I read it yesterday that it stank.

Little surprise that no SFL clubs or fans were consulted over this. I would hope we would use our own clout to scupper any such nonsense. Reconstruction is being forced here for all the wrong reasons. What happens when Sevco goes tits up? Do we accomodate their successor to the nth degree?

Time for another bampot revolution methinks.

  13. No Celtic should not comment on this plan, as it would only give the story, and that’s all it is at this stage, credence.

This will not get as far as the bottom of R.C. Ogilvie’s Garden, of which, he should be tending to as we speak…por cierto

How do you see the sevco share issue being subscribed? do you think they will stump up now the pressure is truly on?

  15. The most repugnant thing about these proposals is not the proposals themselves but the people who are behind them.

  16. I meant use our clout behind the scenes not in public! Tis the way Peter Lawwell and his Vatican paymasters prefer it in any case ;)

    – ‘omnishambles’ is the word of the year according to O.E.D.

Except up here, where it’s ‘zombishambles’.

  19. Can’t believe this two league proposal.

League football used to be quite simple in concept. Everyone played everyone else, home and away. Each team played every other team the same number of times. All clubs had the same fixtures. Neat and tidy.

Then the SPL came along with its stupid split idea. Now fixtures are uneven and teams don’t lay the same fixtures. It can even result in teams having one more or one less home game that their rivals. Hardly an equitable situation.

And now we have a proposal for two leagues that split with teams from one playing teams from an entirely different division in the second half. A sort of extended series of play offs, really.

Can’t we just go back to simpler times? 16 or 18 teams, each playing each other home and away? The way all sensible football leagues operate.

  20. A great article Paul.

Ref the Hibs announcer you can bet if the positions were reversed the Jambo’s would have applauded.

Over the top in my view, similar to our treatment of Tiger Tim Stevens which was shocking.

  26. Ex-Rangers director Dave King has Scottish restraint order revoked By Mike Farrell 13 November 2012 09:02 GMT Facebook Tweet Google

Dave King: The former Rangers shareholder has had the restraint order revoked.SNS Group

Former Rangers director Dave King has had a restraint order against him in Scotland revoked.

The Johannesburg-based businessman had the restraint order taken out against him by the South African Revenue Service, which has been involved in a long-running dispute with him.

In Scotland the order was enforced by the Crown Office, which prevented the 57-year-old from dealing in “realisable assets”, which prevented him from being able to invest in any Scottish companies, including Rangers.

Mr King is accused by the South African authorities of transferring the assets of his financial risk management consultancy firm, Ben Nevis, to Metlika Trading Limited after his old company was pursued for a £222m tax bill by the country’s revenue service.

The restraint order was initially taken out against Mr King in 2006 after he was charged with criminal offences involving alleged tax evasion and breaches of exchange control regulations in relation to the transfer between Ben Nevis and Metlika.

He claims to have invested around £20m in Rangers oldco, formerly The Rangers Football Club plc, in 2000. This led to him owning a 5.3% stake in the company through Metlika.

In a Court of Session action earlier this month, Mr King was successful in revoking the restraint order against him as an individual, although the court action remains in force in Scotland against Metlika.

A Crown Office spokesman said: “Following a request by the South African prosecuting authorities restraint was sought by the Crown in 2006 of assets of David King and Metlika Trading Limited, a company associated with David King. Part of the property held by Metlika included a shareholding in Rangers FC. The court granted a restraint order on 29th June 2006.

“The court recalled the restraint order in respect of King on Friday 9 November 2012. The restraint order in respect of Metlika remains in force.”

When contacted by STV regarding the court action to recall the order, Mr King said: “I did have the order revoked and also received a costs order against the Crown.”

He was unsuccessful in revoking a separate court order against him, imposed by Sars and HM Revenue and Customs. It froze £7.8m in a London bank account in the name of Metlike Trading Limited, which the tax authorities claim the Castlemilk-born businessman obtained through the transfer of assets from Ben Nevis.

In June the High Court Chancery Division in London rejected his claim to have the freezing order withdrawn.

In June, days after the Sevco consortium bought oldco Rangers’ assets in a £5.5m deal, Mr King held talks at Ibrox with newco chief executive Charles Green.

He stated that Mr Green had given him “absolute, categorical insurances” that former owner Craig Whyte was not involved in the Sevco group, while he also stated he did not believe it was possible for the newco to run at a profit, which the owners believe it can do.

Following the appointment of administrators at Rangers in February, Mr King stated he was planning to sue former Rangers owner Sir David Murray over his £20m investment in the club because of financial mismanagement, including the use of offshore tax avoidance employee benefit trusts (EBTs) to pay the wages of players and some directors between 2000 and 2010.

Sir David claimed he would vigorously contest that action if it arose, while Mr King was unsuccessful in registering as a creditor of Rangers FC in a company voluntary arrangement (CVA). He had lodged a claim for £20m and stated that he would put any money he retrieved back into the club, but administrators Duff and Phelps rejected his application.

A HEARING into the use of Employee Benefit Trusts by Rangers is likely to be deferred until next week.

Rod McKenzie, the Harper McLeod lawyer appointed to gather evidence against the Ibrox club by the independent commission established by the SPL, was involved in a car accident last week and has not yet recovered from his injuries.

    ———————————————————————————

I have not read any official timeline for when this will now take place, surprise, surprise.

If Rod gathered evidence, and I am sure he did not work, nor charged his time alone for this work, a delay of a week may be acceptable. Any longer would once again be negligent. Rod is not on the committee, he would be used to validate evidence. A duty, I am sure, some of his assistants could also do.

Nothing happening here till the FTT result is published. What again is bad is that the SPL do not issue a statement concerning the trubunal.

  30. The SFL Proposal for New structure has been outlined as 3 divisions containing 16 ,10 ,18 teams

Therefore even if it was up and running by next season it makes no difference to Zombie FC

Stay with me for a second….

CURRENT STRUCTURE if they were to be promoted from the Current SFL3 into the Current SFL2 they would be 2 promotions away from the top flight.

NEW STRUCTURE as newly promoted team from SFL 3 they would still be in the NEW Reconstituted Third Tier – made up of the current SFL 2 ( bottom 6 or 8 ) + all of the current SFL 3 and still 2 promotions away from top flight!!
