Whyte, Ticketus or their proxy the only show in town

Sterling work by Chris McLaughlin at the BBC who brought us the news that Duff and Phelps have rejected a bid for Rangers from Brian Kennedy, the owner English rugby club, Sale Sharks.  Earlier today Kennedy suggested the administrators get their act together and move towards appointing a preferred bidder.

A preferred bidder may now be identified, if not yet publicly announced.

I can imagine the process to whittle bidders down:

‘Tell me, do you own Ibrox Stadium or security and floating charge over it?’

‘No?  Ah, that’s a problem, as we don’t have it either.  Where do you propose to play matches?’

‘Forget that one, someone tipped off St Mirren.’

‘Don’t take that tone with me, we’re doing our best in difficult circumstances and we’ve not been paid a pound.  Yet.’

Craig Whyte controls the security and floating charge over Ibrox.  He provided Ticketus with security for the money they due on the season tickets they purchased, worth in the region of £40m.

Mr Whyte and Ticketus, or a proxy, are the only show in town – and that show is not a CVA.  Everything else is just shooting the breeze at £600 per hour.

    i don’t see where this comes from, i don’t read Jesus’ words at the last supper saying anything about the B&W becoming his B&B

     

    When I asked my Catholic sisters about this, I was told it is a “miracle of faith” and since that expression makes no sense to me at all, I don’t buy that either.

     

     

    So, sacramentally – no problem

  2. Would one of our legal eagles just clarify for me please, is it not the case the judge could still rule that Ticketus have no standing other than as a creditor of Rangers and in such circumstances have no priority over the other creditors of Rangers?

    I’d like Celtic to publicly declare their position re Huns / Ref and also their intention to actively monitor decisions and proceeding before making further comment in md summer.( June 1st)

     

    I wouldn’t feed the media or the SFA anything.

     

     

    As this whole event unravels there will be explosions and sections of Hun society turning on each other.

     

    Best now to step clear and actively monitor at a distance…

     

    It also diverts Celtic energy to shedding a dozen or so players and sourcing 4 decent additions in preparation for next season…

    The only good thing I can see, is the issue got a good honest and fair discussion, anyone can follow it and come to their own conclusion.

     

    I will like many keep an eye on it to see if any evidence appears.

    I suspect BRTH could trap the breeze or paint green steam purple if he wanted, but at rates closer to D&P’s than mine. :) ;)

    I remember a few years back in a D Utd V thems game the king of foul mouth abuse to match officials Barry Ferguston turned on the assistant ref near the the dugout cos he didnt give thems a shy. It wasnt your normal building site stuff. He questioned who the mans father was his sexuality and another load of bile that I cant write on here at this hour. He didnt only do it once he turned on the guy again with another torrent of abuse.

     

     

    The Ass ref and the 4th official were about 10yds away but guess who was only 5 yards away? The Chief Constable of Tayside police. And he did nowt about it.

     

     

    I spoke to BFDJ on the SSB abt it but guess what again? You’re right, he didnt hear or see it eether.

    In what way is Scotland worse than NI in relation to this issue?

     

     

    I am Scottish but have lived in Newry for 14 yrs. My job entails visiting people at home throughout NI and my success is predicated on making sure those of a different background are left in the dark as to my own.

     

     

    To this day I hear things from people that are so hate filled, bigoted, racist and sectarian (9/11 was God’s way of clearing out the fenian scum from NY – or did you not know that?) it would make you weep. The West of Scotland in particular has an issue of course but, in my view, it is not (and never will be) as bad as it is here.

     

     

    The only reason it may not seem as bad is beacuse there is decidedly less mixing. This includes housing, education and social. This may give the false impression that all is well in the environment where we predominently reside, however it also means that when outwith this environment you are usually easily identified and this leads to people putting their “game face” on. I would say though that, depending on the area, you might be afforded more courtesy than you expected. I believe this is primarily a hangover from the days you needed to be very, very, very careful who you were talking to.

  16. Furious United report Rangers again

     

    Dundee United have reported Rangers for failing to pay ticket money due them for a second time (writes Tom Duthie).

     

    Today, the Ibrox club were up before the SFA because of £67,000 that’s still due the Tangerines from their Scottish Cup win at Ibrox last month. And now the Tele can reveal that, as of opening of business today, the Gers had failed to hand over another £19,000 or so from the league clash at Tannadice just under a fortnight ago.

    Rangers administrators Duff and Phelps have issued the following statement on the situation at the Glasgow club.

     

     

     

    Paul Clark, joint administrator, said: “We are pleased Martin Bain has, in light of the present situation at Rangers, offered to drop his action for damages following his dismissal by Craig Whyte whilst Chairman.

     

     

     

    “Mr Bain has also agreed to release to the Club a significant proportion of the sum that was arrested as part of this action. He has made plain the litigation was a response to the actions of Craig Whyte and not Rangers FC and given developments he now wishes to end the litigation action and do what he can to support the Club in these difficult times.

     

     

     

    “Duff & Phelps have agreed to settle the litigation with Mr Bain thereby avoiding the unnecessary costs of continuing with this court action.

     

     

     

    “On other litigation matters, on 23 March the High Court in London ordered that in addition to the current proceedings regarding the £3.6m that was transferred into the safekeeping of the administrators’ lawyers, Taylor Wessing, the parties with claims against Collyer Bristow (the former lawyers to Craig Whyte and Rangers FC) should bring their claims by 16 April 2012.

     

     

     

    “This has widened the court proceedings because we have substantially larger claims against Collyer Bristow, which we wish to bring as soon as possible. The original trial dates of 30 March – 4 April are now not being utilised as the wider claims are still being formulated. A further hearing will take place as soon as possible after the deadline for claims against Collyer Bristow of 16 April.

     

     

     

    “As regards the general administration process, we, as the Club’s administrators, would like to pay tribute to Rangers supporters for their continuing oustanding efforts to support the Club at this time.

     

     

     

    “We appreciate greatly the contributions made to the Rangers Fighting Fund and welcome the fact that those who are administering the fund have taken the decision to release funds which will offset some of the debts owed by the Club to other clubs.”

    Brian Kennedy is no longer in the running to buy Rangers and has urged the club’s administrators to opt for a rival bid instead, a representative for the Sale Sharks owner has said.

     

     

    Press Association Sport understands Kennedy was told by Duff & Phelps, the administrators, that his takeover bid was too low. He appears unlikely to table an improved proposal after saying he hopes Duff & Phelps go with the bid tabled by the former Ibrox director Paul Murray and his Blue Knights consortium.

     

     

    Kennedy was one of a number of parties who had expressed an interest in taking over the ailing Glasgow giants, who were forced to call in the administrators on 14 February. A spokesperson for Kennedy said he was “disappointed but not surprised by the outcome”.

     

     

    Kennedy added: “I was only going to get involved for the good of the club. I am glad the process is now moving on and I hope the administrators now go with the Paul Murray/Blue Knights bid as they have the best interests of the club and the supporters at heart.”

     

     

    Administrators hope to name a preferred bidder, possibly next week, after recently receiving a fifth offer for the club from a Singapore-based consortium.

    Yes.

     

     

    Then Ticketus would appeal and it would drag on for a year or two.

     

     

    The issues are not straightforward and involve fundamental differences between Scots and English law relating to the concept of real and personal rights.

    Only getting limited access in darkest but bright South Ayrshire, did the issue of a UEFA licence come up at all in the Regan interview.

     

    If so did the answer differ from the original, that is it was not overdue under the rules (at the time or subsequently under the monitoring rules that looked for overdues at 30 June?

  28. There is a view that Ticketus will not ultimately be successful and that they will eventually take their place in the queue of creditors. I would suggest that the only show in town remains HMRC and the First Tribunal…

  29. So Bain has dropped his case meaning that the £500K held from that action is now available to the administrators, minus Bain’s legal fees. Now will that leave anything – and if so what will they do with it?

     

     

    A wee question for the legal folk here about juristiction. If a contract is concluded in Scotland (for example) but includes a clause saying that English law should apply, is that binding on both sides? And what is the advantage to changing juristiction anyway?
