Whyte’s proxy set to step forward for acceptance by SFA, SPL

984

When Duff and Phelps put their initial deadline in place for bidders for Rangers back in March, Celtic Quick News took the view that Craig Whyte was the only show in town and that any successful bid for the company’s assets would have to come from him or his proxy.

We didn’t know who his proxy would be then and we are still not sure – although we could have a pretty good guess.

Place the current SPL and SFA dramas aside for a moment.  If a deal is done to allow a Rangers-Newco to apply to play football next season the new ‘owner’ will be a Craig Whyte appointment.

If this unfolds in the days to come, I fully expect the SFA will take a very long time to consider any Fit and Proper questions, and I expect the SPL board will vote 4-1 to allocate a share in the league to the Newco.

Celtic, united with their own fans, and fans of the Gang of 10 clubs stand in one corner.  The boards of the Gang of 10 want Rangers-Newco money too much to object.  Don’t even count on Newco being subject to the penalties discussed at yesterday’s meeting.

A CQN’er is raising funds for the Wellburn Care Home in Dundee.  Run by the Little Sisters of the Poor, Welburn offers incredible residential support for those in need in the Dundee area.  It is only a viable concern through the dedication of the sisters and volunteers and fundraising initiatives such as sales of work, coffee mornings etc.

You can support their work by bidding for a Celtic top signed by the first team squad at this eBay auction.  Your help is greatly appreciated.

  1. i dunno about all the stephen hawkings stuff…

i’d rather think of oldco like fredo in the godfather part 2… newco taking them out in a rowing boat and sticking a bullet in the back of their brain.

doesn’t help my hopes they get relegated or eradicated, but it’s a pleasant vision nonetheless.

    TheGreenManalishi….yes mate, we should do that soon. A bit of a celebration in Leeds. Here’s what I read on Etims;

Topping of the Morning ( sent yesterday, the same day as Board vote was suspended…and strangely Topping has now resigned citing external issues…hmmm)

    Hi….

I’m compelled to write by Neil Doncasters disgracefully transparent interview on BBC radio this evening.

Nobody appears to be picking up on several issues relating to the role (potentially) of Ralph Topping in this whole saga so I’m hoping you can publicise it.

I was an IT Consultant based in Leeds for 18 months working on a large programme of work. During this period both professionally and socially I had several conversations with said Mr Topping. At this point I can confirm that he is an absolute bona fide Rangers fan through and through.

That in itself should provide a reason for him to be excluded from any decision-making process re NewCo entry into the SPL. However, there are other reasons why he should exclude himself and avoid (well founded) allegations of conflict of interest.

He is the CEO of William Hill, therefore it is in his firms interest to see Rangers in the SPL due to the turnover WH receive through bets placed on Rangers.

Additionally, as William Hill is the sponsor of the Scottish Cup, is it right that a firm who wish to see their competition with a major team involved have their CEO on a committee charged with deciding entry of a NewCo into the league? (My assumption here is that if there is no NewCo in SPL, they’ll struggle to get into the SFL at this stage, hence no Scottish Cup participation).

    Worth a mention?

    Cheers

  3. See the Blue Knights are back in the fray again, with a much stronger bid.

    But just to clarify…

Couple little conditions, D&P sort out the CVA thing and the Craig Whyte thing.

Reminded me of when the Bishop visited Craggy Island, I pararphrase…

Bishop: Dougal do you have any concerns

    Fr Dougal: No!

    Bishop: Are you sure?

Fr Dougal: Well…… You know The Father, The Son and The Holy Ghost?

    Bishop: Yeesss?

    Fr Dougal: That!

You include Anthony Stokes to be shunted in your plans going forward.

Strange decision seeing that for the third season on the trot he’s broken the twenty goal mark, the requisite for a striker and don’t forget he probably saved Neil lennon’s job with his two strikes when Celtic’s season appeared almost finished almost before it had begun against Kilmarnock. Stokes is actually a better footballer than Gary Hooper.

Auldheid have I picked you up correctly in thinking that the license to play in the SPL is not transferrable to a Newco, so even if they form they would still have to apply to the SFA and Uefa??

    =============

Yup that is my understanding and I have made the same point repeatedly but it all depends on what pages you read. The licence is granted by the SFA but membership conferred by the SPL. I can be a member of the Licensed Pub Owners Society but without a liquor licence I cannot run a pub.

The SFA on their web site say that the licensing of clubs playng in the SPL (not the UEFA comps although same criteria apply) is governed by UEFA licensing rules. That means applying the criteria in those rules, criteria a Newco simply cannot meet and if you take the Doncaster argument that the member share can be transferred , the share not the licence, then if football can deem that OK UEFA can deem it OK to bring the baggage that the share carries with them, including sums owed to other clubs not to mention unpaid social tax. Doncaster cannot have it both ways a Newco is a Newco and clubs appearing out of thin air cannot get a licence. A club getting a CVA is not a Newco.

The SFA rules are also crystal clear that a licence is not transferable

    3.3 UEFA Licence

3.3.1 UEFA Licence Awards for Scottish Premier League Clubs (SPL)

A Licence cannot be transferred from one legal entity to another.

    Licence NOT transferrable

so no wriggle room there which means any club applying to join any professional league in Scotland has to have a license granted by the SFA.

For clubs below the SPL, National Club Licensing applies and even under that Newco face hurdles but not at UEFA scrutiny level.

The only way a club can get a licence approved by UEFA where the rules do not allow (and take yer pick which criteria should apply but three years accounts are a definite) and for this an Exception Case can be made , presumably by the SFA if they were so intended.

The SPL case is based on commercialism but to allow a Newco entry as an exception on that basis tramples al over UEFA’s own stated integrity policy.

The only way a Newco can get a license TO PLAY IN THE SPL is to get UEFA approval. If UEFA give it they might as well close up their integrity shop. The SPL in even contemplating a TB deal that requires integrity to be violated have shown they cannot be trusted to run a league. The SFA have the power and I venture the support for forming a different league, probbaly two of 14 with Newco in SPL2.

They should get off their fn backsides (there are times I wish I could swear on CQN) and take charge of this fiasco.

Agreed with most of that list except: Rasmussen & Juarez never received a fair crack of the whip. Just like Hooiveld. Look at him now. K Wilson has no chance of leaving. He will be given one more season at least. And so he should. Blackman- what has he done wrong? Yeah let Paddy go elsewhere- for my own selfish reasons alone- so I can see his unique talent more often. Bangura- does he not deserve at least a semblance of a chance? Brozek- you seen much of him then? Stokes- scored over twenty goals this season- crap intae? Man you are one hard nosed armchair scout.

I didn’t say I wanted all of them to go, they are the most likely though, imo.

Paddy I would keep, but if he isn’t playing, what’s the point?

K Wilson has looked an absolute bombscare, like Dan, every time I have watched him, but he will probably be staying, unfortunately.

Rasmussen and Hooiveld are, imo, not good enough.

Juarez, yes could maybe try him out again.

Blackman, I only saw in the one game, didn’t impress me, and feigned injury ala lafferty, don’t need that type.

Bangura? mmm, this guy is a bit of a mystery. His “best bits” video, ehh, wisnae very good, to put it politely, and he has looked like a fan who has won a contest to get on the pitch, he might come good, I hope he does, but I doubt it.

Brozek, haven’t seen much, but hasn’t done anything to impress so far.

Stokes, I would keep, but we have Hooper, Sammi, Watt, plus a likely new striker, he will struggle for game time.

At the end of the day though, it’s all about opinions.

All these posts about the power celtic have to thwart the zombie bhun’s cunning plan seem to appear on these ‘trough’ days. We must remember though that the much lauded miracle performed by fergus came at a price. We are no longer the club we were, we may be stronger but Celtic are now a PLC and the board have legal responsibilities which will not allow some of the proposed actions

Drastic action required to improve the mood today. A visit to the fridge was met only by the ‘rapidly becoming vintage’ champagne which prompted me to check the ‘use by’ date on the ice cream.

Modern Fairy Tale…The tale of The StoryTellers and the B.E.Ts

Are we sitting comfortable, then lets begin.

Once upon a time there was a storyteller named Rod and he became friends with a Scottish businessman, lets call him Moray. Moray was often forgetful and so he didnt get his favourite Rod mixed up with any other, he called him Rod A. Rod A was always promising great things for Moray so he became known as Rod A Foresight. Now Rod A also had a story telling mate. A big fat lazy mate and sure enough he got the nickname Gym Trainer.

Soon Gym Trainer and Rod A Foresight were Morays favourite story tellers and Moray would tell them everything and the guys would pass on his good stories and keep the bad stories to themselves. After some good times, the bad times came and Moray told them how he had been having troubles and had started using B.E.Ts. B.E.Ts were Morays ways of keeping his gold coins for himself and he didnt want the bad man named Hector Inspector to come and find them.

Rod A and Gym Trainer were simple souls so while Moray fed them on big lovely dinners and home made fine wines, they were happy to forget they knew about the B.E.Ts when a little while later, the man named Hector Inspector came calling.

Moray told them it would be fine and they tried to hide under the bed. Sadly for Moray and Rod An and Gym trainer, the big bad Hector Inspector wouldnt go away. He wouldnt be happy with Lamb or wine and everyone started to get very scared. Moray ran away and no-one could find him. Rod A and Gym Trainer began to have questions asked about how much they knew and what story didnt they share.

Rod A and Gym Trainer managed to find Moray and asked him to help. Moray laughed in their faces and reminded them that they knew all about the B.E.Ts and indeed wallowed in the fine food and scraps from Morays table. Rod A and Gym slowly realised the brazen Moray would be more than happy to reveal how they had helped cover up the terrible B.E.Ts and they ran away from Moray crying.

Now Rod A and Gym sit alone at night and cry into their pillow. Each has been told the best thing they can do is to admit the truth. They dont like the truth, they are scared of it . They know its power. The Truth is making them very very scared indeed. Each is ready to expose the other and try and claim innocence first. Who will it be Rod A or Gym Trainer…whispers are it wont be long at all before one of them bring all theiur own story of The B.E.Ts..like The BFG but only scarier and uglier.

As I understand it a CVA need 75% or more of creditors (based on amounts owed) to agree it.

Whyte is out of any calculation in this process.

Therefore HMRC can block a CVA given the proportion that they are owed of the total.

Can someone confirm what the total is and what HMRC are owed?

Am I correct in saying the BTC would not form part of the equation?

Hi Bob – great question. In theory, D&P could call a meeting to consider CVA proposals on 14 days’ notice. They could do this as soon as one or other of the bids becomes unconditional. HMRC would be entitled to vote for the full amount of unpaid PAYE – £15m or so. D&P could be very bold and say that they will only admit HMRC’s claim for the big tax case to rank for voting at £1 since the outcome is not known. I guess it could still be found in Rangers’ favour. However, this would be likely to be challenged by HMRC in pretty strong terms and, if the case were found in favour of HMRC at a later date, the CVA would probably fail anyway.

A useful line of enquiry for any budding journalist wanting to be his own man might be to ask the SFA, who are looking at club licensing now as part of an annual process. to clarify the position. e.g

Which Licensing rules apply to Rangers as an SPL club/candidate, UEFA or National Club?

Will a license be granted under those rules for Rangers as they are, and if so how have they met the criteria?

Will a Newco placed in the SPL qualify for a license and under what provisions?

Will a Newco placed elsewhere qualify for a license and how?

and the Biggy. If a license is refused can Rangers in any form and in any placement play professional football anywhere?

I’m afraid you’re making a common but understandable error, of adhering to the Standard Model, which assumed that macro-level physics theory – incorporating standard laws and principles which apply to observable entities – apply to oldco/newco

Instead, they exist in the mysterious world governed (maybe thats the wrong word) by quantum mechanics.

Clearly therefore, you need to use canonical quantization – Pertubative S-matrix

    S(fi) = , where S is the S-matrix… obviously

Of particular relevance is quantum entanglement, where oldco and newco exist in different places at the same time, and then again, maybe they don’t – its all down to probability
