Clarity on the administration vote, from one club, so far

The potential scenario of a Scottish Premier League club going out of business, becoming an ex-club, has played out in several places since we discussed it last month.  As a result, we have all had an opportunity to establish our views on the matter, what would and would not be an acceptable reaction by the league and SFA.

The first ‘insolvency event’ of a failing club is likely to be the appointment of an administrator to protect the company from immediate creditors.  This would draw a 10 point penalty.  The choice of the administrator for a football club could be a controversial subject, especially if some creditors stand to lose a considerable amount of money through any rushed deal.  For example, although Rangers have a considerable potential liability to HMRC hanging over them, their creditors might feel that a period of administration stretching several years into the future would enable all debts to be paid in full, a position not all administrators would necessarily agree with.

It’s normal for directors to appoint an administrator prior to a creditor getting to court but if creditors don’t feel the appointment is likely to serve their best interests they can apply to appoint their own.  These battles can get acrimonious.

In the days after an administrator is appointed the club may not be in a position to fulfil its fixtures.  When Gretna’s administrator informed the Scottish Football League they could not guarantee they would be able to fulfil the following season’s fixtures the league relegated them two divisions, to the bottom rung of the league structure.  This proved to be a temporary position before the administrator admitted defeat and folded the company.  Precedent suggests we should look out for a double relegation if a club in administration has to tell the league they cannot fulfil fixtures.

There is no point waiting until a well-organised administrator presents a fait accompli to the league before we look for precedents and debate an appropriate response.  For the integrity of the Scottish game, football fans need to be ready for this debate.  Where possibly, colours should be pinned to the mast.

One outcome of the online debate in the last couple of days (thanks to untiring work of our friend Phil) is that Celtic were forced to consider this question.  I sought and received assurances that they will not vote to admonish owners of an ex-football club with a paltry point penalty, allowing them to reform as though nothing happened the following season.

The question is still-hypothetical, so clubs are not in a position to comment officially yet, but we are in a healthier position for the debate and should encourage high profile supporters of other clubs to engage the debate as some from our own club have recently.

    INVERNESS CAN CRUSH CELTIC’S FLAG DREAM A SECOND TIME SAY JOSH MEEKINGS

     

     

     

     

    JOSH MEEKINGS reckons Inverness are ready to deal another title blow to Celtic and boost their own dreams of making the top six in the SPL.

    Those assurances have been given.

     

     

    Now I’m the first to admit that the assurances may turn out to be worthless,but when the custodians have given their word that there is nothing in the story,they will find it even more difficult to backtrack.

     

     

    THAT is the value of the whole affair. They have been forced into a corner which they had previously avoided because no other journalist wanted to ask the question.

    In today’s Herald article on Christine Grahame Michael McMahon MPS is quoted as saying that Grahame “while considering the so-called Bigot Bill, as she appears to believe more Catholics need to be arrested to even things up.”

     

     

    She may not have used those words and McMahon–like all politicians–is being economical with the facts, but his words do sum up the impression that Grahame unwittingly, and I believe spontaneously gave to a huge audience while she was questioning professor Tom Devine (See here : http://www.youtube.com/watch?v=LL6lMjdRuxA&feature=related ).

     

     

    I believe Jeanette Findlay of the Celtic Trust wrote to her for clarification immediately on hearing her (Grahames’s) exchange with Tom Devine.

     

     

    Grahame, as Justice Committee Convener left me in no doubt that she saw the new legislation as a way of balancing up the disproportionate number of Rangers’ fans who were convicted of sectarian offences under the old 2003 Act by roping in Celtic fans for the new offence of political sectarianism.

     

     

    Most damning to me was the fact that as Justice Committee Convener Grahame had nothing to say about the extraordinary revelation that the analysis of sectarian crimes data (2003-present) that she, academics, and the RC Church had eagerly awaited had been destroyed by COPFS!

     

     

    How can she or anyone advocate bringing in new legislation to deal with sectarian crime when the efficacy of the existing legislation cannot be examined as the data relating to such crimes has been mysteriously destroyed when we were all waiting to see it?

    I am kind of surprised that Phil has been getting it in the neck for this article. For the record I have contributed to Phil and even after he Championed Mr. Fleming as head of referee development … which didn´t sit right with me at the time and still doesn´t. That for me is far more of an issue than our PLC talking about an escape route for the old firm.

    I see the board have been forced to answer Phil Mac’s charge, and I see those not questioing Phil’s integrity are satisfied with the clubs response. The same people who promised to back GS 100% on Tommy Burns Thursday, the naievety on here can be stunning sometimes, the old firm board will decide what is best for them not the club, when the time comes. Anyone ho elieves anything that lot has to say publicly is gullible beyond belief.

    Deep down any thinking Celtic supporter knows that our board are in bed with them, I know it but it still doesn’t stop me supporting the club and contributing to the club, and there are many thousands out there who are the same, and the board know it.

     

     

    From a financial point of view I can understand where they are coming from, they are wrong to hold that view imo, cos without them we could and would be better off, it’s more the sectarianisism that they are condoning that bugs me.

    I think a lot of the support see themselves and their fellow fans as the club and not the PLC. The PLC do not represent their aspirations. They support the club DESPITE the PLC. If our PLC defacto support continued sectarianism to mainatin their repugnnant and ancient marketing model I think it will be noticed and many will no longer want associated with that.

     

     

    Our PLC due to their terminal impotence have reached a juncture that they need to negotiate. I fear that they haven´t the slightest inkling in how to deal with it. We are at a crossroads … we become the archetypal WWF henpecked wife … to get bums on seats or … we break free and fulfil our true potential eventually …. sadly the need for profit making while being absent will hinder that for ever.
