Final day to appeal Lord Glennie decision set to expire

Charles Green, like Whyte and Duff & Phelps before him, is asking for admittance to the SPL on the basis that Rangers FC is a distinct entity from its legal identity.  While this theory has been strongly advocated by SPL chief executive, Neil Doncaster, by necessity, if you claim the football benefits of being ‘Rangers’, specifically player registrations, you also inherit Rangers penalties.

Although Rangers clearly won their challenge to Lord Carloway’s 12-month ban on player registration at the Court of Session last month when Lord Glennie referred the matter back to the SFA Appellate Panel, as the full ramification of the decision became clear to Green, who then had an irrevocable contract to buy Rangers or its assets, he floated the idea that he might appeal.

The SFA, correctly, decided not to instruct the Appellate Panel until the 21 day period when an appeal can be raised, which elapses today, has passed, just in case Green tells Lord Glennie he’s got it all wrong.

All this has been terribly confusing, not to mention expensive, for Scottish football, but with yesterday’s news that Rangers have a prima facie case to answer for subverting Scottish football for over a decade, the obstacles before Green are clearly insurmountable.  There is reason to believe we can quickly reach some clarity.

The SFA must, without delay, convene the Appellate Panel to consider Lord Glennie’s instructions and apply an appropriate penalty on the various legal and ethereal bodies which claim to be ‘Rangers’.  If the Appellate Panel suspend or expel what is left of the football club from the SFA, as must surely be expected, all questions about fan pressure, morals and votes become moot.

In this case, history will record the folly of Green’s appeal to civil law as the act which finally killed off any chance of ‘Rangers’ surviving, conveniently letting the SPL off the hook, while Green would be obliged to dispose of the stadium for a modest return to those capable of forming a genuinely new football club at some point in the future.

    The green/white/orange bands on the end of the sleeve are on the inside.

     

    Is this correct or have I bought a dud?

     

    She has now turned the ends of the sleeves up to show the bands.

    They are not interested in obstructing the “club”, only in chasing the miscreants; therefore they will keep the path clear for the switchover.

  10. Celtic Supporters Association calls Emergency Meeting to vote on Selective Boycott.

     

    The Executive Committee of the Celtic Supporters Association met last night to discuss the possibility of a Newco Club being admitted directly into the SPL for the coming season 2012/13.

     

     

    It was decided unanimously to call an Emergency Delegates Meeting of our branches this coming Sunday June 24th at 1pm in our London Road Social Club.

     

     

    The EC will be putting forward a motion that states “The Celtic Supporters Association will call on all its members to take part in a selective boycott of any club which votes for a Newco to be admitted directly into the SPL for the coming season 2012/13”.

     

     

    This has been a very emotive issue for all football supporters in Scotland, we have to decide whether sporting integrity should take precedence over commercial interest, and in the opinion of those supporters canvassed by us up until now that is the case.

     

     

    We understand the need for chairmen of clubs to balance their books to the best of their ability, but that must be done by operating in an honest and fair market, one or more club’s can’t be allowed to operate with an unfair advantage.

     

     

    We are calling on all Chairmen and CEO’s in the SPL to vote for honesty and integrity, a clear and appropriate punishment must be imposed on any club who fail to operate in that manner, irrespective of which particular club that happens to be.

     

     

    The Celtic Supporters contribute a considerable percentage of the finances generated within Scottish Football; we will not continue to support clubs who put their own interests before the basic principles of sporting integrity.

    1) The phrase is “dissolved” and the process is liquidation of “winding up”. Paperwork/formalities have to be completed by the administrators to complete the arrangements for a Creditors Voluntary Liquidation, at which point BDO will run the liquidation, which will take many months while they investigate the corporate failure and distribute whatever assets are left. When this is over (~12 months?), Rangers will be dissolved.

     

    2) Lack of time to complete investigation, lack of information which they would hope would have been provided by the FTT and lack of clarity over Rangers’ legal status will be cited as the reasons for the delays.

  22. Ex-Rangers director Dave King has claimed the newco club would not be able to generate a profit.

     

     

    The South Africa-based businessman held talks with Charles Green, chief executive of the new Ibrox club on Tuesday.

     

     

    He claimed to have received assurances that the last owner of Rangers FC plc, Craig Whyte, was not involved in the Sevco consortium that bought over the club’s assets.

     

     

    Mr Green’s group paid £5.5m last week to cover administrators Duff and Phelps’ £3m fees, as well as an estimated £1m to cover the liquidation of the company incorporated in 1899 by neutral insolvency firm BDO, a process that will begin in several weeks’ time.

     

     

    Mr King, who is subject to a restraint order preventing him from dealing with realisable property because of a multi million tax case against him, said Mr Green’s “for profit” model of running Rangers will prevent them from competing at the top level.

     

     

    He told STV News Mr Green had also given him “absolute, categorical insurances” that Mr Whyte is not involved in the newco.

     

     

    Mr King added: “I think [Charles Green] is going to try to run the club to make a profit. I don’t believe that’s possible. I believe for Rangers to be the Rangers that we all want them to be, it requires investors who are willing to subsidise losses for a number of years. I don’t believe you can do that on a commercial basis.”

     

     

    Regarding the failure of the consortium led by former Rangers manager Walter Smith to take over the club, Mr King said he was “not surprised” the £6m offer had been rejected.

     

     

    Challenge

     

     

    He said he thinks running Rangers will be “immensely challenging” for the Sevco group, while he also stated that he did not know where the money would come from to keep the newco club afloat.

     

     

    Mr King admitted that Sevco was now the “only game in town” for Rangers, while he also said he felt the new club would need around £30m of investment to cope with the next three years of “wilderness” because of the ban on European football for that period that the club received for carrying out a newco switch to shrug off its huge debts.

     

     

    After meeting Mr Green at Ibrox on Tuesday, the chief executive of Johannesburg investment firm Micromega Holdings said he felt the newco regime would have to “aggressively cut costs” to make a profit. He also stated that he did not feel it would be “in anyway possible” for a strong Rangers to emerge from a business model dependant on making profit.

     

     

    Mr King previously claimed he invested £20m in the club in 2000 when Sir David Murray was in charge. He then stated he was planning to sue the former owner for the cash because of Sir David’s financial mismanagement of the Glasgow club, including the use of offshore tax avoiding employee benefit trusts (EBTs) to pay the wages of players and some directors.

     

     

    Sir David claimed he would vigorously contest that action if it arose, while Mr King was unsuccessful in registering as a creditor of Rangers FC in a company voluntary arrangement (CVA). He had lodged a claim for £20m and stated that he would put any money he retrieved back into the club.

     

     

    He also accused Sevco chief executive Mr Green of using season ticket sales to fund his takeover, similar to Craig Whyte, who bought Sir Davids 85% stake in Rangers for £1 last May and used a £25.3m deal with London firm Ticketus to wipe out the club’s £18m debt to Lloyds Banking Group.

     

     

    Mr King is currently being pursued by the South African Revenue Service (Sars) for 2.7bn rand (around £227m) dating back to 1991.
