Final day to appeal Lord Glennie decision set to expire

Charles Green, like Whyte and Duff & Phelps before him, is asking for admittance to the SPL on the basis that Rangers FC is a distinct entity from its legal identity.  While this theory has been strongly advocated by SPL chief executive, Neil Doncaster, by necessity, if you claim the football benefits of being ‘Rangers’, specifically player registrations, you also inherit Rangers penalties.

Although Rangers clearly won their challenge to Lord Carloway’s 12-month ban on player registration at the Court of Session last month when Lord Glennie referred the matter back to the SFA Appellate Panel, as the full ramification of the decision became clear to Green, who then had an irrevocable contract to buy Rangers or its assets, he floated the idea that he might appeal.

The SFA, correctly, decided not to instruct the Appellate Panel until the 21 day period when an appeal can be raised, which elapses today, has passed, just in case Green tells Lord Glennie he’s got it all wrong.

All this has been terribly confusing, not to mention expensive, for Scottish football, but with yesterday’s news that Rangers have a prima facie case to answer for subverting Scottish football for over a decade, the obstacles before Green are clearly insurmountable.  There is reason to believe we can quickly reach some clarity.

The SFA must, without delay, convene the Appellate Panel to consider Lord Glennie’s instructions and apply an appropriate penalty on the various legal and ethereal bodies which claim to be ‘Rangers’.  If the Appellate Panel suspend or expel what is left of the football club from the SFA, as must surely be expected, all questions about fan pressure, morals and votes become moot.

In this case, history will record the folly of Green’s appeal to civil law as the act which finally killed off any chance of ‘Rangers’ surviving, conveniently letting the SPL off the hook, while Green would be obliged to dispose of the stadium for a modest return to those capable of forming a genuinely new football club at some point in the future.

All organizations, if we want them to be fully inculcated with a harmonious culture of openness, transparency and justice need to be populated by the required amount of people who have little or no fear and desire. Fear and desire is the pendulum of urges that, if poorly regulated, leaves people liable to coercion and manipulation by forces that will enthusiastically take advantage of such weakness. Our problem is that people who attain status and positions of prominence, in nearly all organizations, not only football, are motivated purely by petty and puerile self-interest and all the concomitant fixations that come with that- these are people, particularly when they are not consciously aware, are susceptible to coercion by powerful extraneous forces. Doncaster and Regan are proof in point. Those people who are driven purely by self-interest should be subservient to those who have little or no fear and desire, rather than the other way around, especially in an organization that serves the common good: such an organizations need to have higher communal ideals and employ the best balance, of the right people, to enact those ideals. We need to be radical if we want to change. The root problem is the type of person employed: we require better quality of individual, who are open, possess transformative capacities and who have the necessary flexibility to adapt to complex demands. Could anyone, even the most ardent establishment apologist say that the present stultifying, stratified organized hypocrisy in any way resembles that ideal? The ideal future organization might be, in fact, will almost certainly be, totally different from anything we know, particularly if it emerges spontaneously- maybe it will be a grown up organization that no longer treats clubs, players and the fans as children

     

    We need people who are guided by something like the old concept of “duty”, except something more vital, more spontaneous, with people who are capable of sustaining a flashing inspiration and a deep abiding concern and to channel these forces effectively for the good of all- something akin to conscience. It of course has to be high quality people who love sport, football in particular, who believe in humanity, in the common good of society above and beyond any partisan prejudice towards specific causes or clubs. All this has to be motivated by a widening of football’s scope in Scotland: that football, even the fundamental purpose of grass roots football, can be a net to catch the underprivileged, to widen education amongst the young and heighten awareness of the importance of exercise and good health- football can be one factor, amongst a variety of vectors, in making society a better place, to improve the quality of peoples life’s. Celtic of course are pioneering this perspective with the football in schools innovation at Lennoxtown, but this approach has to be extended and broadened across the whole of society- by an organization that will sanctioned and established by people who are not averse to direct participation in grassroots football and to bind all the disparate variables into one overarching vision that takes us forward into a brighter future for the game.
