Ogilvie was born for this moment as SFA to consider expelling Rangers

Although Rangers won their case at the Court of Session today, they have the option not to serve the ruling on the SFA that its Judicial Panel’s 12 month ban on player registration is illegal.  Winning the point in law might sound like a victory, but taking the Association to court breaks membership rules of the SFA, rules imposed on all associations by Fifa.

We will find out soon enough the reach of SFA president, Campbell Ogilvie, who was one of the recipients of an EBT which precipitated Rangers crisis.

Rangers are deep in Sion territory now.  Either they walk away from this showdown, the SFA expel or suspend them from football, or Fifa will shortly remind the SFA of their duties when a member club takes action in the civil courts.

Campbell Ogilvie was born for this moment; it justifies him holding onto his position all these months despite being “heavily conflicted”, according to his chief executive.  I do not expect this to end well.

Despite an independent judicial panel ruling against Rangers, there is no way the office holders at the SFA will expel Rangers, no matter what they do. They would rather jeopardise the Scotland national team and every other club’s European participation.

    What this underlines is that the Allies were perfectly well aware of the religious and cultural significance of the Monastery at Monte Cassino and made strenuous efforts to avoid damage to the ancient structure.Their initial efforts were unsuccessful and resulted in a huge number of casualties.Only then was the decision taken to use bombers.

     

    The Germans were also aware and cynically employed the Monastery as the lynchpin of the their defensive line,the Gustav line .That they were aware is proved by their removal of ancient religious artifacts from the building for safe keeping.

     

    This is not a bad account of the first phase.

    I admit to not being an expert – but how can a CVA work if they don’t now how much they can offer because it depends on them winning a litigation case? Who in their right mind can vote for something that they don’t know how much its worth and when they will be in aposition to pay.I think someone on here needs to come up with an alternative suggestion as to what we now call the CVA!!!

     

    Some legal expert with knowledge of european sport law is on BBC2 newsnight scotland at 11.00. Trailer on BBC radio suggest he thinks RFC(IA) have just made a huge mistake by going to COS today. HH

  18. I have read a few posters commenting that Rangers did not go to CAS because the SFA do not recognise it. That is simply not true.

     

     

    CAS is recognised by FIFA and UEFA and any club in the world wishing to take their association to task are entitled to take it to CAS.

     

     

    The SFA are certainly not in any position to refuse to recognise CAS.

     

     

    Where did this notion come from? My guess would be someone in the media trying to make a case for Rangers going to the Court of Session.

     

     

    Also, the reason the SFA’s clause “and any other punishment deemed appropriate” was not raised in the CoS is because the law of the land does not recognise such a clause. You will often see a notice along the lines of “Maximum Penalty 6 months imprisonment or a 5,000 fine”. You will never see at the end of such a notice, ” . . . or any other punishment deemed appropriate”.

     

     

    It’s a catch-all that has no basis in law, although it is fine in a private club like the SPL/SFA or the local Bowling Club.

Any time you hear RFC supporters talk they acknowledge that they need to be punished but never say what punishment would be appropriate. They then object to any punishment that is given.     If you haven’t already seen it I would recommend the HBO series ‘Band of Brothers’ which I recently watched on DVD. Based on the accounts of an US airbourne division from D-Day to the end of WW2 it does, to a certain extent, try to show both sides of the conflict solely from a soldiers point of view. Obviously does not shy away from the horror of the Nazi regime. In fact I would say it is the most powerful depiction of the Holocaust I have ever seen in either film or TV medium and when you take in the total running time of the series it barely touches on it. Very cleverly done.
