Ogilvie was born for this moment as SFA to consider expelling Rangers

877

Although Rangers won their case at the Court of Session today, they have the option not to serve the ruling on the SFA that its Judicial Panel’s 12 month ban on player registration is illegal.  Winning the point in law might sound like a victory, but taking the Association to court breaks membership rules of the SFA, rules imposed on all associations by Fifa.

We will find out soon enough the reach of SFA president, Campbell Ogilvie, who was one of the recipients of an EBT which precipitated Rangers crisis.

Rangers are deep in Sion territory now.  Either they walk away from this showdown, the SFA expel or suspend them from football, or Fifa will shortly remind the SFA of their duties when a member club takes action in the civil courts.

Campbell Ogilvie was born for this moment; it justifies him holding onto his position all these months despite being “heavily conflicted”, according to his chief executive.  I do not expect this to end well.

Despite an independent judicial panel ruling against Rangers, there is no way the office holders at the SFA will expel Rangers, no matter what they do. They would rather jeopardise the Scotland national team and every other club’s European participation.

Confused (and off to bed so might not see the answer)

Today’s judge did NOT change the disciplinary panel’s sentence. Just the appeal hearing’s.

What is the significance, if any, of that?

Is he saying the appeal panel should have upped the sentence for them having had the temerity to appeal without grounds? Or is it all just something and nothing?

Indeed. Reading his tweets, I think he’s reluctant to hog any limelight, so happy to appear but not as ‘tweeter’ etc – he’s a mainstay on FF too. You’d have thought ‘fan’ would have done. Many have touted him as fans’ rep on a new board.

The CAS could not intervene prior to the 2011 rewriting of the SFA articles and cannot now. This is not their jurisdiction.

The CAS does not deal with cases where this independent appeal body is in place. Rangers have exhausted this route.

    FIFA statutes Articles 62-64

“3 CAS, however, does not deal with appeals arising from:

    (a) violations of the Laws of the Game;

    (b) suspensions of up to four matches or up to three months (with the exception of doping decisions);

    (c) decisions against which an appeal to an independent and duly constituted arbitration tribunal recognised under the rules of an Association or Confederation may be made”

  7. canamalar –

Thanks for that. So the reason Rangers did not go to CAS was nothing to do with the SFA not recognising them, which is what I read on CQN.

Another thing. Duff & Phelps are quoted in a newspaper as being “unaware” that going to the CoS was against FIFA regulations. I refuse to believe that. At least I refuse to believe that nobody at Ibrox or in the media advised them that this was the case before going to court.

They are lying when they say they did not know. Which means they knowingly went to the CoS, fully aware of the likely consequences of doing so, therefore it was a tactical move in the hope of forcing the SFA to bring the club down, to do their dirty work for them.

  11. I wonder if the President of the Scottish Football Association has reported details of the court action by one of the member clubs to Fifa.

I wonder if Fifa expect all cases of clubs taking court action against an Association to be reported to them or if they expect individual Associations to deal with the offending club accordingly.

if you remember back to the lost appeal it was the fighting fuds that screamed for the decision to be challenged in court, they also paid for the legal fee’s.

We know they will blame D&P

They knew the ull ramifications of taking the sfa to court

I believe this is a deliberate ploy by them to try and destroy scottish football

D&P are IMO very afraid of the threats and intimidation.

  19. Guys can someone explain this to me.

Newsnight have just stated that the CVA has put up circa 9p in the pound and that this is the best deal on offer as the liquidation option would have less than a penny in pound available. Therefore no brainier CVA has to be accepted as makes business sense.

Now, given tHe CVA is putting up £5m to offer to creditors yet Newsnight states that assets owned by the club are valued at £100m?

Why would HMRC and Ticketus not just liquidate them and take a share of the £100m assets??

Apologies if I am totally missing the point here but can anyone clarify for me?

    Hail! Hail!

  20. C.O. is myopic…he sees little. He needs reminding that justice is blind. So,myopia is no excuse for doing nothing. And turning a blind eye is not justice, either.

So things are cranked up a notch or two.

Stick or twist time for the sfa.

What are the scenarios that we could be facing ?

In all honesty far too many to mention, doing my head in, the brotherhood will be working at full tilt as we speak, they will have their work cut out now, but somehow, there will be a deal done, I would stake my life on that.
