Ogilvie was born for this moment as SFA to consider expelling Rangers

Although Rangers won their case at the Court of Session today, they have the option not to serve the ruling on the SFA that its Judicial Panel’s 12 month ban on player registration is illegal.  Winning the point in law might sound like a victory, but taking the Association to court breaks membership rules of the SFA, rules imposed on all associations by Fifa.

We will find out soon enough the reach of SFA president, Campbell Ogilvie, who was one of the recipients of an EBT which precipitated Rangers crisis.

Rangers are deep in Sion territory now.  Either they walk away from this showdown, the SFA expel or suspend them from football, or Fifa will shortly remind the SFA of their duties when a member club takes action in the civil courts.

Campbell Ogilvie was born for this moment; it justifies him holding onto his position all these months despite being “heavily conflicted”, according to his chief executive.  I do not expect this to end well.

Despite an independent judicial panel ruling against Rangers, there is no way the office holders at the SFA will expel Rangers, no matter what they do. They would rather jeopardise the Scotland national team and every other club’s European participation.

    The SFA has a simple decison to make. It may be a difficult one for them, but it’s pretty simple. If Rangers serve Glennie’s Order, the SFA needs to expel Rangers from the game. Failure to do so will result in the SFA breaching its own responsibility to the game.

     

     

    Forget new sanctions for the original offence. It should not come to that. If Rangers serve the order, they breach one of the conditions of their membership and are kicked out. It’s that simple.

     

     

    CVA Proposal 1. I’ve spoken to a few folk in the trade, and no one can explain how D&P have managed to increase current year VAT and PAYE by £4M over the past 4 months without trading wrongfully.

     

     

    CVA Proposal 2: The offer is conditional on Rangers retaining membership of both the SFA and the SPL. The SPL Inquiry into Ineligible Registrations has yet to formally establish the facts never mind come to a decision. The sanction from the SPL for Rangers corrupting the tournament since its inception can only be expulsion from the tournament. There really is nothing else. You cannot have a member acting in the utmost bad faith for 14 years and not kick ’em out. The CVA therefore is incapable of being accepted without some accomodation having been found with the SPL in the matter of sanctions.

     

     

    Following on from the SPL establishing the facts of Player Ineligibility, the SFA and SFL will require to consider how these breaches impacted on their tournaments. Moreover, the SFA, as the local Licensor, will have to view the facts not against the SPL’s rules, but against the FIFA Rules for the Registration of Players. You see, Player Registration is a worldwide framework, not a local arrangement that can be adapted to suit. If you fail to register your players properly, you are in worldwide poo-poo. The SFA have no discretion in this matter.

     

     

    Finally, despite D&P being under a legal obligation to report to the Court and Companies House the outcome of the Creditors’ vote on the various resolutions put to them on the 20th April ‘as soon as practicably possible’ we, and the Creditors, remain unaware of what Authorities D&P were given.

     

     

    One of the key resolutions was to authorise D&P to sell the business and assets at their discretion without further recourse to the creditors. Those more gen’ed up than me read Section 6 of the CVA proposal as confirming that D&P have not been given the authority to sell the assets, hence a Nominee Committee being required to manage this matter.

     

     

    In short, it appears as though the CVA is incapable of being accepted without the SFA and SPL pre-judging the outcome of the various Inquiries into Rangers.

     

     

    And that D&P do not have the authority to sell the assets to Sevco as proposed, in the event that the CVA fails.

    Udinese play in front of about 14/15000 fans, yet have a couple of world class players in their team. Porto – well their story is well publicised. If you look at some of the players who have come into the epl (albeit for a few quid in transfers) we have seen Kaboul (auxerre), Samba (Herha), Ba (Hoffenheim – who got him from Mouscron in belgium), Diame (rayo vallecano), n’Daw (st etienne), song (bastia), Bassong (metz), Kompany (anderlecht via HSV).

     

     

    Celtic are bigger than almost all these Clubs – admittedly Hoffenheim have a few quid – yet these clubs were able to scout those players, and sell them on for serious cash. Each of those players would add a lot of value to a team like ours, as well as netting a big return when sold on. Instead, we seem to be set on getting guys on loan from england, and irish journeymen. To compete in europe, we need quality. And with celtic’s budget, quality needs to be obtained through some creative thinking. when we have scouted a bit creatively, we have done ok: Hooper (watched since he was in LeagueOne) and Wanyama being successes, Bangura – less so.

    Celtic don’t sign the TV deal. The SPL do. Celtic can vote against it (and have done so in the past) but if other members vote for the deal there ain’t anything we can do about it. We signed up to the rules of the SPL and unlike others we don’t break rules we have agreed to.

    A lawyer on RTC said that the whole thing came down to the “any other punishment” clause. Generally the law does not like this, preferring all possible punishments to be set out explicitly. The first Lord reckoned it was ok, the second one didn’t.

    “Further to yesterday’s ruling by the Court of Session, the SFA is currently consulting with lawyers regarding the way forward in respect of potential sanction(s) against Rangers Football Club arising from breaches of SFA regulations.

     

     

    The SFA is extremely disappointed with the ruling of the Court of Session in light of the fact that the independent tribunal had imposed a transfer embargo for breaches of SFA regulations which, according to the tribunal were almost as serious as match-fixing.

     

     

    Despite what might be interpreted as a novel and restrained sanction, Rangers FC have sought to jeopardise the participation of all SFA clubs and the national side in international competitions arising from the decision of Rangers FC to seek recourse to a civil court in contravention of SFA and FIFA regulations.

     

     

    Having effectively thumbed their noses at the SFA and FIFA, presumably in full knowledge of the difficulties referral to the Court of Session would entail, the SFA will immediately remit the matter back to an independent tribunal for reconsideration. In view of the factual findings of the previous tribunal and the submissions on behalf of both parties at the Court of Session, it appears inevitable that the only realistic sanctions now open to any tribunal are suspension or expulsion of Rangers FC. Manifestly, suspension or expulsion from the Scottish Cup would be wholly inadequate, particularly given that the breaches of regulations were not matters relating solely to participation in the Scottish Cup.

     

     

    It is to be noted that further enquiries in relation to alleged dual contracts are ongoing and any punishment of Rangers FC in the event of findings against the club in respect of dual contracts will be decided with regard to the irresponsible actions of the club in respect of the above matters.

     

     

    The actions of Rangers FC have required significant, unnecessary expenditure by SFA in dealing with these legal matters and it will be the intention of SFA to seek to recoup any legal and incidental expenditure arising therefrom.

     

     

    The SFA notes the restraint demonstrated by other clubs likely to be affected by the above matters and shares the frustration of said clubs and their fans with Rangers FC.

     

     

    The SFA is primarily concerned with all member clubs adhering to the rules and essentially, operating fairly in a manner consistent with maintaining the sporting and financial integrity of the game as a whole.

     

     

    The SFA will also seek to land a man on the moon by 2015, achieve world peace and end poverty. These tasks will be developed immediately after we deal with Rangers FC in a fair, proportionate manner”

    There is an awful ( not sure whether that is the correct word ) feeling of……. I don’t know…. something about my mood this morning.

     

     

    Imagine taking a blank piece of paper and drawing a tiny dot in the middle of it.

     

     

    Now imagine drawing a series of arrows– Big and Small– which point towards that dot. Each and every one coming from a different direction. Each and every one is a different length and size– some big, some small.

     

     

    Now imagine that the dot is you– and that everywhere you look there is some kind of problem rushing at you, coming up behind you, striking you, only to be replaced instantly by another one coming from a different direction.

     

     

    That is Rangers FC this morning. Every which way it turns it faces attack and danger.

     

     

    Remember David Murray saying they had nothing to fear re the Tax issue and the EBT’s– they had taken the best professional advice possible.

     

     

    We thought then that the EBT case would sink the club– well we haven’t even got to that yet and look at where they are.

     

     

    All the old board gone.

     

    Murray’s empire gone.

     

    Bain and the gravy train– gone.

     

    Whyte has been and gone.

     

    Kennedy & the Whyte Knights– been and gone.

     

    Players Been and going?

     

    Lloyds– been and gone.

     

    The league and all competitions– gone.

     

    D&P been and sucking every penny they can get out of the coffers.

     

     

    And still to come is the tax case, further sanction from the SFA on Whyte’s failure to disclose etc, further sanction from the SFA/SPL on dual contracts, further sanction from SFA/SPL on the decision to go to court, potential sanction from UEFA/FIFA for the same thing, potential liquidation if CVA is rejected, potential personal action against Directors in the event of liquidation, seemingly irreversible lack of funds going forward, Stadium in need of urgent maintenance, no ability to plan for next season, no signings to boost season ticket income, no certainty as to who will benefit from season ticket income, no football clubs willing to deal with them in any event as a result of failure to meet football bills, prize money and revenue witheld by SPL to meet footballing debts… and the matter that Barca and RTC have alluded to which could blow all of the above out of the water!

     

     

    Further King says he will sue Murray.

    … and on and on and on it goes.

     

     

    As someone who is fairly used to advising on business problems, and the minutiae and the kind of things that people just ignore or hide from or sweep under the carpet when they are under stress or strain… the Rangers case is a belter!

     

     

    I am reminded of going to one of these seminars where someone puts a theoretical situation to you, and asks for a solution and what the chances of success are and the cost of that success.

     

     

    At the seminar a guy posed the following problem.

     

     

    Your phone goes at 4:55pm on Friday and you take a call about a man who owns a number of petrol stations, properties and other businesses. They are all in his name alone. He has been involved in a car accident, and while he is living, he is only expected to live for 48 hours at most. Nothing can be done to save him… it is only a matter of time.

     

     

    If he dies, then his wife will cop for a huge amount of inheritance tax and other liabilities, to the extent that she will probably lose house and home as well as a husband and father. It is all very tragic.

     

     

    However the phone call is from the family accountant who wants you to drop what you are doing and over the next 48 hours come up with a plan to create a business partnership between husband and wife in respect of part of the business and to transfer all titles to that partnership prior to death so that she escapes the tax and financial ruin. Further various limited companies have to be formed, and they have to take over part of the business taking them away from the family.

     

     

    All of this will involve an immediate power of attorney, the setting up of a trust, appointing Directors and shareholders urgently and so on.

     

     

    To complete the task you will have to work all weekend non stop, cancel a golf weekend, bring in staff on an emergency basis, piss off friends and family and so on.

     

     

    However, you will save the wife/ widow Millions of pounds, she will be forever in your debt and you will probably have a client for life. However, before you start the accountant– being an accountant– wants to know roughly what you will charge for such a service?

     

     

    And at that the question was thrown open for debate.

     

     

    The correct answer? Well people took various guesses and estimates, made calculations and provisions, came up with figures and sliding scales.

     

     

    At the end of the day, however in my opinion, there was only one real correct answer.
