‘Only Newco option is SPL’ utter rubbish

Scottish Premier League chief executive, Neil Doncaster, yesterday told the BBC that no provision existed for a liquidated SPL club to reconvene as a Newco FC at the bottom of the Scottish Football League (reported at 1821 on their crisis timeline).

This is being grossly misreported to suggest that the only opportunity for a Rangers Newco to phoenix is to slip straight back into the SPL – completely and utterly untrue.

There is also no provision for a Newco FC to slip into the SPL.  Newco FC would be able to apply for membership to the Scottish Football League (where they would unquestionably be accepted) or the Scottish Premier League.

The default position when a club goes out of business in the Scottish Premier League is that the club that finishes bottom of the league at the end of the season escapes relegation.  As things stand, Dunfermline would remain an SPL club and Ross County would be promoted.

No moral, legal or football administrative argument has been made to suggest that Dunfermline will be relegated to allow a new club entry into the league.  None whatsoever.  Dunfermline Athletic will remain a SPL club if Rangers are liquidated.

The various parties seeking to phoenix Rangers would get the lawyers onto securing a stadium, scouting some part-timers, buying a ticketing system, applying for entry into the Scottish Football League and finding cash to employ stadium stewarding. This could take weeks but is more likely to take months or even years.

Football needs to get used to this idea.

Neil Doncaster did not suggest a Newco FC applying for entry into the SPL had any primacy over an application to the SFL.  In fact, an application to the SFL would not have to overcome the unfortunate objections of Dunfermline Athletic  – who pay their BBC licence fee and are worthy of due respect.

  4. I can’t see anyone buying Rangers unless Craig Whyte relinquishes all title to Rangers i.e. he walks away with nothing and I cannot see that happening. Then there is still the matter of the wee Tax and big Tax case as well as other numerous other creditors such Heart of Midlothian FC. I am not a financial expert by any stretch of the imagination but I think that unless the interested buyers have a member of the Saudi royal household in their consortium where does the 80 -100 million pounds that may be required just to break even come from? A CVA is possible – not likely given HMRCs stance or perhaps the potential buyers are discussing purchase of the assets post liquidation with the administrators.

    One thing I forgot to add and which I was only reminded off by a tweet from Rangerstaxcase, the HMRC will insist on any newco setting up a bond to cover PAYE and NIC due to their previous non-payment. They tweeted this is usually several millions.

     

     

    I tweeted back I am reliably informed the amount is £5 million…just another few quid to add to the amount any newco will have to factor in.

    Murray sold to Whyte, but it wasn’t really Whyte, it was another company that he might own but nobody can find out anything about them. Meanwhile the money he used to buy off LTSB is owed to a venture capitalist company called Ticketus/Octopus for ticket sales for the next 3/4 seasons for games at Ibrokes, when they might not even be playing there, nor in the SPL..

     

    The gorilla in the room is the HMRC and the various bills for outstanding taxes dating back at least a decade, which could conceivably total as much as 75 million according to the current owner. Selling off of whatever assets they possess including the stadium and Murray Park.

     

     

    The Sword of Damocles hanging over them all is the probable findings of deliberately using unregistered players for perhaps as long as 15 years, with the punishments that may be meted out. The probability of no European football for a decade, lower league status, points deductions for 5 seasons, freeze on signing players, accounts scrutiny requirements, and that’s before UEFA get to work on them.

     

     

    If this was the Dragons Den or (in the States) Shark Tank, none of the investors would be remotely interested, and the Administrators would be sent away to the sound of maniacal laughter.

    Interesting. sounds like a protracted affair. Not clear to me what’s left in the carcass to pick from. The succession of vultures have already picked it clean. What assets are left?

     

     

    Ibrox, and potentially Murray Park have been ringfenced away from the carcass.

     

    Player Registrations revert back to the SFA in the event of a liquidation, AFAIK. So they too lie outside the carcass (Although I don’t suppose there is anything stopping a purchaser buying them back off of the SFA)

     

    They may or may not have access to future ticket sales income

     

    The catering and merchandise businesses are not part of the carcass.

     

     

    What’s left? The brand? The Crest?

    Directly or indirectly, Rangers’ use of Employee Benefit Trusts has forced the club into administration and to the verge of liquidation.

     

    Nevertheless, the club’s enemies wish to inflict further damage by claiming Rangers gained an advantage from ‘financial doping’. Moreover, there are even demands that trophies won by the club over the past 12 or 13 years be stripped due to an alleged omission in the documentation pertaining to players’ registrations.

     

     

    Let’s deal with the registration issue first. Rangers’ position was that the EBTs were non-contractual and therefore should not be included in documents submitted to the SFA and SPL. This view is supported by experts in the field (see yesterday’s Herald article). There was no attempt to mislead or to keep the EBTs hidden. Section 6 of the annual accounts (‘Staff Costs’) explains the purpose of the trusts and enumerates the sums involved.

     

     

    Therefore, the logic being used by the club’s antagonists is fatally flawed – it demands that sanctions be imposed because of judgments made many years after the EBT scheme was introduced. This is completely unacceptable in my view and contrary to natural justice. Any objections about the registration issue should have been raised at the time. The fact that complaints are being made officially only after a decade has elapsed and, indeed, only after the club entered administration and is consequently unable to defend itself, speaks volumes for the motives behind recent moves.

     

     

    The ‘financial doping’ argument also borders on the absurd. Most accounts of the money Rangers FC saved over the course of a decade put the figure at £24 million. This represents less than 5% of turnover and equates to the sums flowing from the club to the Murray group over the same period. Indeed, Rangers FC actually paid the Murray group at least £6 million for the ‘privilege’ of the trusts being administered on its behalf!

     

     

    Figures provided by Martin Bain in his case against the club indicate that the combination of interest charges and the penalties being sought by HMRC mean that the club is required to pay back approximately twice the sum of £24 million. How on earth can this situation be referred to as ‘financial doping’? My interpretation of the phrase would be a permanent advantage gained by underhand means or assistance from outside bodies.

     

     

    Of course, this definition would encompass the support Celtic FC has received from the taxpayer and ratepayer in relation to the purchase of significant tracts of land in the vicinity of Celtic Park for the sum of £1 and the huge financial benefits that will accrue from the Commonwealth Games and associated redevelopment of the Parkhead area. As opposed to the obstacles the local council put in Rangers’ way, everything possible has been done to assist Celtic, even down to the gift of London Road Primary School and retention of the Barrowfield training pitches.

     

     

    Encouraged by a mass media which panders to their psychoses, the Celtic-minded hordes are whipping themselves into a frenzy of retribution and vindictiveness. Business professionals and lawyers spend hour after hour on websites and blogs scrutinising the minutiae of Rangers’ use of EBTs from every conceivable angle. The rank and file concoct evermore fanciful scenarios of punishments that should be meted out to Rangers FC. In stark contrast to the orgy of hatred accompanying Rangers’ current problems, it is worth noting that in 1952 the club defended Celtic when it was under threat of expulsion from the SFA due to its refusal to comply with an order from city magistrates to remove the Irish tricolour from the main stand.

     

     

    From the Celtic boardroom to Baird’s Bar, all sense of perspective has been lost and the wider ramifications to Scottish football and, indeed, Scottish society, have been completely overlooked. This is not normal behaviour and these are not normal people.
