Last night when Neil Lennon told BBC Radio Scotland that Norwich’s second offer for Gary Hooper was “not as high as £6m” and that despite reports, the club had not tabled a fresh contract offer to the player, you would be forgiven for thinking the entire transfer saga was a product of fantasy.

Neil also confirmed Gary’s contract offer from Celtic is due to expire on 1 February, when I understand the player’s current representation deal also expires.

None of this counts where it really matters.  Gary continues to perform like a player on top of this game.  St Mirren next, then he can start the countdown to Juventus.  Put the Italians in their place and he will attract attention from more than a plucky green and gold tribute act.

A corner of Glasgow stood still today to bid farewell to Sean Fallon.  Sean’s 19 grandchildren delivered touching bidding prayers while son Sean recounted many of the times and habits which shaped his father’s life.  It was a fitting tribute to such a great life, marked by sincere and loving words from Sir Alex Ferguson.

    The public face of Juve has been consistently neutral about Celtic . I have seen /heard nothing arrogant , I have seen nothing tremulous , hesitant or frightened .

  20. Wilson’s article is clearly aimed at securing a less harsh punishment for oldco at the Tribunal.

     

     

    Wilson/Graham make a couple of points about the FTT(T) decision, side letters, the Tribunal’s constitution, the point of the SPL’s non-disclosure rule and the use of EBTs as an “error” when processing payroll payments for the 5 players listed in paragraph 233.

     

     

    1. The FTT(T) decision fully vindicates oldco and renders the SPL Commission a farce.

     

     

    The FTT(T) is being appealed. It contained a substantial minority dissension. It does not bind future FTTs(T), why should it bind the SPL Commission? It does not have the same line of enquiry as the SPL Commission. Why should the SPL Commission be bound by the result of the FTT(T), or dettered from sitting as a consequence of it? The side letters detailed in the FTT(T) contain undertakings to fund ub-trusts with cash in the event of football players reaching certain performance targets linked tot he playing of football. That is a contractual obligation on behalf of oldco. This contractual obligation requires to be lodged with the SFA. Graham makes points about cars/player’s drinks/other emoluments being made to footballers having to be disclosed in contracts of service. Here’s a hint Chris, if they are contractual entitlements, they ARE disclsoed. Now, there is an argument based on the FTT(T) that the actual “cash” equivalent of the funds deposited by RFC oldco into sub-trusts was only available to players via a discretionary “loan” from trustees. However, what cannot be disputed is that RFC (not the trustees) undertook to fund sub-trusts, and make reccomendations to trustees, based entirely on a player’s footballing performance. That looks very much like a second contract to me. These were not disclosed.

     

     

    2. The Tribuanl’s constitution

     

     

    It is chaired by LNS. Its composition is completed by two QCs. Graham has called it a kangaroo court in the past. If he wants to go down that line, fair enough. I wouldn’t. He makes out as if the SPL rules weren’t known, and agreed to, by RFC prior to their coming into existence. He seems to suggest that the use of SPL rules, and their presentation by the SPL’s lawyers, contaminate the entire tribunal process. Here’s a hint; it’s dispute resolution. Each party gets the chance to put its own point forward regarding interpretation of the rules. As regards which rules we use to measure oldco’s behaviour, perhaps Chris has a better set than those which were in force at the time(s) to which the charges relate.

     

     

    3. Point of the non-disclosure rule.

     

     

    It has a value in making sure players can demonstrate that they have been paid their due by their employer (which happens to be a company in every instance of everyt eam which ahs ever played in the SPL, but that’s another argument). But in my view that is not all the rule is there to achieve. Football has a bad history of payments udner the table, to players, agents, managers. The rule in my view also aims to stamp this out; to ensure that transparency exists as regards transactions between players and football clubs in roder that the sporting integrity of the competititon not be undermined by opaque financial arrangements. Rangers chose not to disclose the payments in order to obtain a tax advantage. They didn’t “mis-administer” the arrangements with the SPL, they deliberately didn’t disclose EBT arrangements, including side letters. Breach of this rule, even if no RFC oldco players are complaining theye weren’t paid enough, is serious enough for the reasons outlined.

     

     

    4. Payment to the 5 players via EBT being disclosed tot he SPL:

     

     

    There is a susggestion that the 5 players listed in paragraph 233 were paid their cntractuial entitlement via an EBT “in error”. The tax wasn’t paid on these EBTs. It will never be paid. If, say, player A, received £40,000 NET through an EBT, when he should have gotten £40,000 via payroll, as detailed in his SPL contract, is that okay? Or is it his earnings gross of tax and NI that are disclosed in his SPL contract? I am certain it is the latter. Therefore, if player A has a £40,000 entitltement detailed in his SPL disclosed contract, and gets £40,000 Net via an EBT, then that is an undeclared payment, as the tax man doesn’t get his cut of the payment? What if you lok at it the other way, say he had a £40,000 gross entitlement disclosed in his contract, and was paid £25,000 via EBT. On the face of it you would think that was all hunky dory in terms of the SPL’s rules. However, the £15,000 tax/NI deduction was never paid to Hector. That is a clear cut case of a financial advnatge being gained over your opponents. More to the point, this inter-mingling of EBT/Payroll, rather militates against oldco’s contention that the arrangements were entirely separate!.

     

     

    In short, the two articles throw up more heat than light. The SPL Commission should crack on, and I can’t wait for when it does.

    I’d like to know the reasons for the delay in the FTT appeal. With HMRC consenting to EBTs being labelled merely loans, their appointment of the discredited BDO–found to be untrustworthy by a QC, and now the delay in appealing the FTT verdict added to the long wait for the Tribunal itself, I’m not entirely convinced Hector is all he’s cracked up to be.

     

     

    Of course, I hope my cynicism is misplaced.

    As regards the MSM in Scotland,they are toast.It never occurred to them that perhaps Celtic and all the other sides from whatever division constituted a bigger readership than the the followers from Snake Mountain.Certainly the rebellion as regards Norwegian Blue FC just waltzing back into Scottish football as if nothing had happened took them by surprize.It was a well deserved kick in the wobbly bits.
