Prevailing attitude of hunger

Judging by these quotes, John Guidetti may just be the most excited footballer on the planet right now:

“I’m just going to work my socks off…. do my absolute very best…. give 100%.

“The one thing I hate more than anything is losing. I can’t stand it.

“For 90 minutes I am always giving everything.

“You can always expect 100% from your players and I’m going to give that [note the repetition of this assertion].

“I promise I’ll do my very best to do even a little bit of what [Henrik] did.

“Football without fans is nothing, it’s not worth it for me.”

There is a common theme across a few players who joined this summer, they have something to prove.  Guidetti, Mubarak and Tonev each had a difficult time last season, for varying reasons.  They need to hit the mark, whether it’s through form (Tonev), fitness (Guidetti) or simply being able to play in an environment which is remotely normal (Mubarak).

Scepovic is different.  He arrives with the wind at his back, but the prevailing attitude at Lennoxtown should be one of hunger. I suspect this contrasts starkly with last year’s arrivals.

    Their appeal is based on a point of law as i understand it. Can you explain in simple terms what the point of law is that they are citing?

     

     

    Indirectly connected but as i understand it HMRC as i understand are pursuing their case on a point of law.

  11. If I were a player for sevco, I’d want some assurances my wages were going to be paid. Where is the player’s union? From the PFA’s mission statement:

     

     

    “As an organisation our aim is to protect and promote the interests of our members.

     

     

    PFA Scotland is run by players for players and the experience within our team means we are committed to providing our members with the best possible advice and representation.”

     

     

    Certainly, integrity of contracts are included in the above. C’mon PFA, get your act together.

    I don’t know the exact detail but in very simple terms a pursuer who has a reasonable claim for damages or compensation on the face of it can ask the court to arrest the assets of the person he or she is claiming against if it appears that the defender is impecunious or likely to go bust.

     

     

    Now, my recollection of the law is that if it is demonstrated that A) the claim has any semblance of a reasonable foundation and that B) there is a reasonable prospect that the claim concerned would be defeated if the defender was allowed to squander or distribute their assets leaving them bust and unable to make that claim, then in those circumstances the judge shall grant an arrestment order covering the value of the claim and any reasonable expenses.

     

     

    On the other hand, if the defender ( in this case the Gers ) can’t show that the claim is rubbish at this stage ( very hard to do ) and demonstrate that there is no prospect of them going bust or being unable to pay the claim should the case go against them, then the only argument that they have left is to state that the granting of the arrestment order is ” Nimious and Oppressive”.

     

     

    ” Nimious and Oppressive” is the standard old fashioned legal phrase used in Scots Law to more or less state that the arrestment is ( a ) Unnecessary or Nimious — meaning that such an order is just simply not needed for any reason AND ( note that the phrase is nimious AND oppressive not nimious OR oppressive ) (b) Oppressive in the sense that granting any such order- even if it were justified on the face of it — would result in such a calamitous, unfair and unjust consequence in the circumstances that would lead the judge to conclude that the order should not be granted in such peculiar circumstances.

     

     

    No doubt Rangers argued all of that before the court and depending on the detail of what the judge said they may see a chink in his reasoning, but any appeal will simply mean that the whole argument is regurgitated at some point in the future.

     

     

    As PF Ayr has rightly pointed out — the appeal, the granting of the order and the financial situation all point to a smoke filled room, a spot of arm wrestling, and a begrudged but — ahem — tax efficient settlement being reached pronto!

     

     

    Otherwise the money is locked up in a dark cupboard for an indefinite period.

    THE Company confirms that the Court of Session in Edinburgh has granted a request by Mr Ahmad for an order allowing him to arrest £620,000 in a Rangers bank account or the accounts of others who may be due to pay sums to Rangers.

     

     

    He sought this order in connection with a claim against the Rangers Football Club Limited for alleged unpaid bonuses in the amount of £500,000.

     

     

    The court granted permission to arrest £620,000 to take account of the sum sued for and Mr Ahmad’s legal expenses in connection with his claim.

     

     

    Leave to appeal this decision has been sought by Rangers and the court will deal with that request on Tuesday.

     

     

    This is a provisional procedural measure and the fact that this procedural ruling is in Mr Ahmad’s favour it is in not an indication that the court accepts there is any merit in his claim.

     

     

    The court has not yet considered the merits of Mr Ahmad’s claim. Mr Ahmad’s claim is being robustly defended. The case proceeds to a full hearing on its merits commencing 11 November 2014.

     

     

    If the defence of this claim is successful the funds arrested will be released.

     

     

    Further announcements will be made on this matter in due course.

    Unless they get cash from somewhere the merits of Ahmed’s case will never see the inside of the court.

     

     

    Also, as steted above the entire incident could trigger a run on their money with people looking for all sorts of assurances for wages and other future payments.

     

     

    It may also make the selling of players difficult as they have the right to arrest any money due to Rangers by anyone.
