Supreme Court gets to grips with Rangers Tax Case

I long ago promised to take nothing for granted regarding the Rangers Tax Case, as it confounded my predictions from the off, but with the matter underway today with its final arbiter, The Supreme Court, I’m prepared to go as far as to say: so far, so good.

There is a long way to go – so no one should be out celebrating a draw. The matter will not be settled by the performance of a QC on his feet, rather the finer points of law. Today has been interesting, so far, but we will hopefully be well into our next Champions League group stage games before we hear the outcome.

    Monday 16th March

     

     

     

    I had a wonderful visit today with my mother, father and Marcella. Wonderful, considering the circumstances and the strain which indeed they are surely under.

     

    As I expected, I received a lot of verbal flak from Screws going and coming from the actual visit. Their warped sense of humour was evident in their childish taunts, etcetera.

     

    I wrapped myself up well to keep me from the cold. My weight is 58.25 kgs today, but I burnt up more energy today with the visit. I’ve no complaints of any nature.

     

    I’ve noticed the orderlies are substituting slices of bread for bits of cake, etcetera — stealing the sweet things (which are rare anyway) for themselves. I don’t know whether it’s a case of ‘How low can you get?’ or ‘Well, could you blame them?’ But they take their choice and fill of the food always, so it’s the former.

     

    They left my supper in tonight when the priest (Fr Murphy) was in. There were two bites out of the small doughy bun. I ask you!

     

    I got the Sunday World newspaper; papers have been scarce for the past few days.

     

    There is a certain Screw here who has taken it upon himself to harass me to the very end and in a very vindictive childish manner. It does not worry me, the harassment, but his attitude aggravates me occasionally. It is one thing to torture, but quite a different thing to exact enjoyment from it, that’s his type.

     

    There was no mirror search going out to visits today — a pleasant change. Apparently, with the ending of the no-wash protest, the mercenary Screws have lost all their mercenary bonuses, etcetera, notwithstanding that they are also losing overtime and so on. So, not to be outdone, they aren’t going to carry out the mirror search any more, and its accompanying brutality, degradation, humiliation, etcetera.

     

    Why! Because they aren’t being paid for it!

     

    I’m continually wrapped up in blankets, but find it hard to keep my feet warm. It doesn’t help my body temperature, drinking pints of cold water. I’m still able to take the salt and five or six pints of water per day without too much discomfort.

     

    The books that are available to me are trash. I’m going to ask for a dictionary tomorrow. I’d just sit and flick through that and learn, much more preferable to reading rubbish.

     

    The English rag newspapers I barely read, perhaps flick through them and hope that no one opens the door. A copy of last week’s AP/RN was smuggled in and was read out last night (ingenuity of POWs again). I enjoyed listening to its contents (faultless – get off them ! – good lad Danny (Morrison)). I truly hope that the people read, take in and understand at least some of the truths that are to be regularly found in it. I see Paddy Devlin is at his usual tricks, and won’t come out and support the prisoners…

  9. I watched the Rangers (IL) court case yesterday, and I’m agreeing with a guy on twitter who kind of sees it like I see it, the Lords and Lady seem to be looking at each other with a look of ” wtf are we doing here?”

     

     

    It’s absolutely amazing when you take those free mason B……s out of Scotland how easy the truth comes out, well it’s all coming out now, and the dish is being served cold, KARMA is a wonderful word, as the chickens come home to roost.

    When the huns were drafted into the league via the 5 way agreement, one of the stipulations were that sevco would pay all the old huns football debts……so, bear with me, the EBT recipients were furnished with letters telling them that the club would be responsible for any or all tax due.

     

    This being the case, could a player if he is chased by Hector sue sevco since they are liable for all old huns footy debts

    I know what you are getting at but I don’t think it is likely. The 5-way agreement, or at least the draft we have all seen defined the footy debts:

     

     

    “RFC Scottish Football Creditors” means [the SFA, the SPL, the SFL], The Dundee United Football Company Limited, Heart of Midlothian FC PLC, Aberdeen Football Club PLC and any other football club in membership of the SFA, which are owed or which may become owed any sum or sums by RFC;”

     

     

    Basically, employees weren’t covered.

     

     

    Notice Celtic are listed in there…so they must have been paid for the tickets for the last Old Firm game ever, eh? Although Celtic would have been covered by “any other football club in membership of the SFA, which are owed or which may become owed any sum or sums by RFC”.

    It’s been the involvement of UK wide institutions that have been the huns undoing.

     

     

    Control of their bank account moving from Edinburgh to England, the raid by the City of London Police, The Takeover Panel, the Supreme Court.

     

     

    Contrast that with the treatment they get in Scotland from the SFA and the SMSM.

     

     

    Draw your own conclusions.

  24. A former bookmaker who sued a betting chain for £250,000 winnings over Rangers relegation has lost the action.

     

     

     

     

    Arnold Kinloch placed £100 on the Ibrox club being relegated from the SPL in 2011 and was given odds of 2500 by Coral Racing.

     

     

    The club went into administration in February 2012 and later into liquidation that year and returned to playing in the bottom tier of the Scottish senior leagues in the SFL Third Division.

     

     

    Mr Kinloch,72, of Simshill Road, in Glasgow, took Coral to the Court of Session in Edinburgh after it refused to pay out on the bet he placed on September 5 in 2011 at its branch in Glasgow’s Tollcross Road.

     

     

    His betting slip read: “From SPL – Rangers to be relegated” and maintained that relegation meant an SPL side started the next season in a lower league.

     

     

    Coral contended that relegation was confined to going down only one league on points, according to league rules.

     

     

    It said Rangers Football Club Plc sold its one share in the SPL to Sevco Scotland following the sale of assets by administrators, which required the approval of at least eight members of the SPL and the application was refused, making it no longer eligible to play in the top tier.

     

     

    It then applied to join the SFL and was permitted to come into the lowest league.

     

     

    Lord Bannatyne said: “The foregoing process cannot be described as being moved by anyone to a lower division, or being moved down or demoted.”

     

     

    The judge said: “I am satisfied that what did not happen was that the SPL moved or demoted Rangers to a lower division.”

     

     

    “Rangers ended up in a lower division by the entry into a contract which allowed them to join the SFL in the third division,” said the judge.

     

     

    “I am persuaded that the reasonable man is not only directed but driven to the rules of a particular sport when placing a bet in a sporting context. The natural and ordinary meaning of a sporting term is the definition of that term within the rules of that sport,” he said.

     

     

    Lord Bannatyne said: “It would be impossible for a betting business to be run and for it to offer bets on sporting events without reference to the rules of the sports.”

     

     

    The judge said: “I am satisfied that the odds of 2500/1 to a reasonable person placing a bet as well as the reasonable bookmaker would clearly indicate that relegation meant what is contended for by the defenders (Coral) that is, the highly unlikely event.”

     

     

    Lord Bannatyne said he was persuaded that the sound construction of the bet placed was that advanced by the betting firm. He added: “Accordingly, on this construction of the pursuer’s bet it is a losing bet.”

     

     

    Mr Kinloch told the court that he had been following media reports over Rangers financial troubles before placing the wager.

     

     

    He said in a statement: “I thought it was a good ‘throw away bet’ and I didn’t expect to win but there was a small possibility that I would win.”

     

     

    “Nobody at Coral suggested to me they would only pay out if Rangers went down on sporting prowess or on points, and in fact they didn’t try to negotiate with me at all on the bet,” he said.

     

     

    Mr Kinloch’s position was he had placed the bet as “a punter” but told the court that he had been a bookmaker’s clerk and bookmaker.

     

     

    He accepted that in the past he has been asked not to lay bets in certain betting shops. He said the average guy in a betting shop was “a complete mug”, but described himself as “not a mug punter”.

     

     

    He also accepted during the earlier hearing that he knew the SPL and SFL had rules and that he was very good at looking things up on the internet.
