The premier business paper where Uefa is headquartered in Nyon, Tribune de Geneve, today ran an advert, paid for by public subscription, questioning the governance of Scottish football.

The advert asked readers to reference The Offshore Game report: Doing SFA for Fair Play and explained some of the issues governance, accountability and oversight in Scottish football.  It reads:

“A report by The Offshore Game (TOG), an arm of The Tax Justice Network (TJN), has highlighted examples of poor SFA governance in respect of:

• A Commission established in 2012 by the Scottish Premier League to investigate the use of employee benefit trusts to reduce the tax paid to HMRC by an SFA member club where the SFA provided key testimony which is now being questioned.

• The processing of a UEFA Licence in 2011 by The SFA when Court Officers called to collect overdue tax from a member club between Champions League and Europa League qualifying games. Proving there were no overdue and unpaid taxes was a condition of granting then retaining a licence to compete in both UEFA competitions. The tax concerned was never paid!

• The SFA have neither commented on the TJN report nor attempted to address the issues it raises. The TJN has called for an independent review of the SFA to make it more accountable.

• A group of shareholders of Celtic PLC acting in terms of Resolution 12 of the Celtic PLC AGM of 2013, have been pressing the SFA for over two years for a satisfactory explanation of their administration of the UEFA licensing process in 2011. In the absence of any meaningful reply they have now taken up the case with the UEFA Club Financial Control Body.

The TOG report highlights the financial cost over a decade to the British Taxpayer in Millions of pounds. The cost to Scottish football in terms of the loss of trust placed in the SFA to govern the Scottish game with integrity is incalculable.

Football fans everywhere are invited to read this important report into the game in Scotland.”

Our game suffers from a perceived lack of oversight, accountability and governance; fundamental requirements in modern sport which have been painfully lacking across world football for decades.  Uefa now have an opportunity to measure where Scottish football, and their own processes, are on these metrics.

  1. Just seen a letter from HMRC dated 5 May 2011,to Murray International Holdings, reference Rangers Football Club plc, which gives MIM until 16 May to accept the DOS offer – £2.8 million tax due, and thereafter another 30 days from acceptance to settle the debt, on pain of interest being charged and formal proceedings for collection commenced.

     

     

    It seems to me that someone like Whyte could have spun this out to, and beyond,the 30 June 2011, and in doing so, could have told the SFA that “all was in the process of being resolved”

    Why did you think today was the day ?

     

    This has been a slow burner from the off, why would that change because an ad was stuck in a foreign or even local national press, the fact it is an ad should tell you something.

     

    As I have been bleating on about, the IFAB is a very powerful organisation in world football and the SFA are a fundamental component of that organisation, do you honestly think they are going to give up that place without every possible means at their disposal, calling in favours and markers to protect their place and authority is being used to kill res12, make no mistake it’s not just Scottish football we are up against here it’s the people who sold out Sept Blatter to the yanks to protect their own little fiefdoms. It is a much harder task than bringing in the FBI, there is no Russian World Cup to try and destabilise. So the yanks don’t care about or even want justice, it’s about control and transparency kills nefarious control, how could they possibly pull the strings if every decision is recorded and transparent.

    You sign off your post as if I was having a pop at you. I was only posting that in my opinion your cryptic posts thus far have come as anti-climax to me personally. I had no idea that it only came to light last night and understand why it was too late to pull the plug.

     

    I thank the Resolution 12 Team and yourself and many others for the sterling work you have done.

     

    I sincerely hope you are not inferring that I am a Celtic hater, I most certainly am not and I take umbrage to you inferring that I am or anyone else that posts here for that matter is a Celtic hater.

     

    Like you I am entitled within the rules of the blog to post my opinions. How you can take the inference from my last post that I was decrying you or the Board I simply can’t get mead around.

     

    If you are inferring by…you won’t be troubled in future, so that will cheer you up… That you have thrown the rattle out the Pram because of my most, more fool you and childish in my opinion. Just because someone disagrees with you or you don’t get your own way, you don’t give up, you stand your ground.

     

    Sometimes in my opinion it is better to say nothing, especially if you cannot say too much. As I posted earlier, Paul67 in my opinion said as much as needed to be said…he simply marked our cards, nothing cryptic in that.

     

    I found some of your posts boring and teasing, unnecessary in my opinion and posted my thoughts at the time. The wording of your posts has resulted in an anticlimax for me today personally. If you had not posted the way you did and today he unfolded the way it did, including James’s blog I would have been more enthused.

     

    Don’t apologise to me or anyone for what you post or opinion, it’s a free country post what you want within the rules.

    I agree with you beware the Celtic haters, for the record I am most certainly not one of those, nor in my opinion are the majority of those that lurk here or post here. Some may not agree with the Board’s direction and decision but that does not make us Celtic hater. Your beware warning has me fuming…first time in my life I have been called a Celtic hater. To qualify as one I guess I simply have to disagree with you. In my previous post I recognised the great work in Resolution 12, reserve my judgement for 48 hours and record as I had done previously about a few cryptic posts you made and all of a sudden your not going to post or do things in order to cheer me up, I thought you were a better man than that.

    It seems to me that you do not understand the simplicity of the arguments set out in the public domain.

     

    Between competing for CL and EL competitions an SFA licensed club had HMRC breaking down the door to collect “undue payables” why would sheriffs officers turn up at a company headquarters demanding payment for debts if they were not overdue ?

     

    Keep it simple please I don’t want to miss anything

    There was a delay in getting the finalised submission to CFC as it was posted by solicitors and not emailed at the end of last week.

     

     

     

    Monday was a Bank Holiday and therefore no post.

     

     

     

    The submission arrived yesterday not Friday as anticipated. Thus the delay.

    No matter what finally transpires, the ONLY reason this is still a public topic of conversation – the ONLY reason – is that a small bunch of Celtic fans didn’t just sit on their arses – they tried to do something about it.

     

     

    It might not yield the final results we would love to see, but it has a chance – and the guys who have given it that chance deserve better than some Celtic people are prepared to give them on here.

     

     

    Look at yourselves in the mirror – have any of you done a fraction of the work that these guys have done?

     

    Are you busy away in the background yourself tackling these issues?

     

    Are you about to reveal that you have brought the SFA and Sevco to book for their misdeeds?

     

    Have you lifted a finger, other than to criticise other Celtic fans who are trying to do the right thing?

    HMRC gave MIH until 16 May 2011to have directors of RFC sign acceptance of the £2.8 offer (DOS debt) – thereafter a further 30 days (to 15 June 2011) to settle it, or interest and formal/legal collection would commence.

     

     

    The Sheriff Officers did not call until 10 August 2011 after Rangers had played in the CL.

     

     

    All I am saying is, is it not feasable that Whyte strung along the SFA and UEFA from the 15 June until the 10 August?

     

     

    The wrongdoing was down to MIH, RFC and Whyte, in that they sought to mislead the SFA and UEFA in order to get their hands on CL money

    philosophically, this is another Schrodinger’s cat scenario …. until we open the box, and know for sure, the cat is simultaneously dead and alive …. similarly, unless and until we know what the Board have and haven’t done, they are simultaneously supporting the resolution and not supporting it ….

    4 years later …. and barely a peep from the Board about any of it ….to think that the Board are genuinely interested in any of this strains belief.

     

     

    As Canam suggests, the Board seems to think they are better off with Sevco in place. I tend to agree with Canam on that point.; Personally, I believe that to be a false economy, but I suspect that is the belief held by the muckety-mucks at Celtic Park… even if they will never admit so to you and I.

     

     

    Some may argue that, if more money is to be made with Sevco involved, the Board has a fiduciary obligation to do what it can to get Sevco back. But that is a discussion for a different day ….

    To answer your question, I thought today would be the day by reading certain posts over the last week or so that the advertisement would coincide with the Board finally making their move…boom if they had done I would be walking about like a…can’t post the rest due to kids on the site but I am sure you get my point.

     

    I genuinely understand these things take time, slowly, slowly catchy monkey. I genuinely do appreciate your and the others efforts, including Winning Captains but I don’t have to agree with everything and make no apology for airing my opinion.

     

    God only knows how I understand the frustration of the length of time it takes to bring together a case, it’s what I have been doing in my working capacity for the last 25 years. Don’t want to say too much about timescales but trust me some take longer than others. If you ever speak with Blantyretim or Paul67, they will give you my background.

     

    One thing is clear I seem to be the Villain tonight by the support that has been posted for Winning Captains, I only referred to one small thing I disagreed with on how he put things out there. Still fuming about the Celtic hater reference. WC knows as do others that know me what Celtic mean to me both in supporting the Team and the wider Family.

     

    Maybe time for me to say Au Revoir instead of Winning Captains; this town ain’t big enough for the both of us and all that…two chances of me beating it and two chances of Winning Captains doing so, we are both Celtic lovers and both will continue to do what we can in supporting Celtic and the Celtic Family.

     

    I actually believe the Board will step up to the plate, really do but I get told by so many these days, you have blind faith, maybe I do but the older I get the harder it gets. Today was I thought, going to be the day that your efforts would come together when the Board would fire the Cannons. Winning Captains earlier clarified why that was not the case.

    Another fundamental truth that might help you understand,

     

     

    HMRC were not in negotiations prior to 31st of March 2011, they were processing recovery procedures for evaded tax, get it, criminal avoision of tax. Regardless of how the SFA of anyone else wants to portray it, Regulation 80 is the process by which HMRC dictate to offenders of evasion how much is owed.

     

    Get that clear in your head, Regulation 80 is only used for evasion.

    I love this blog. I’ve come here to lurk for a long time. I lurk. I have posted a few times, but I’m more comfortable lurking. I love this blog and the characters here… especially the ones who keep the peace and clear the air and hoover the floor afterwards :)

     

     

    It’s a special place and always will be. It’s just difficult to witness the ‘fighting’ and personal arguments. I understand it… I just don’t like it.

     

     

    Each to their own, of course. I hope everyone can do the best for themselves and for the others who feel at home here. That means different things to different folks but it’s essentially the decent thing we good folks want.

  26. Massive well done to those guys who followed their belief and got off of their asses and did something rather than just whinging and moaning on a blog.

     

     

    Whether it achieves its aims or not great respect to you all.

     

     

    It is all too easy to sit on the sidelines and be armchair quarter back on these things. As with many others, such as running a football club, it is all too easy to do it on ‘FIFA’ compared to the real world. Even easier when you just sit on the side and look to blame in an issue in isolation.

     

     

    How many folk out there have tried to get a controversial and complicated advert put into a national newspaper ? Never mind in a foreign country ? I for one cannot imagine that is all that easy for starters !

     

     

    The stress of the energy and effort put into this must have been huge these past few days. Great credit to you all for following your heart with this.
