What’s it to you, Charlie?

The news yesterday that HMRC would appeal the decision by the First Tier Tribunal (FTT) to reject the part of their tax demand against former club Rangers which was still open to dispute was received by most with passing interest.  The FTT returned a split decision, with the minority view giving HMRC substantial grounds for an appeal, and as we have heard often in recent years, HMRC always pursue tax under various circumstances.  Reasons include when they believe wrongdoing has occurred.

As such, it seemed strange that The Rangers chief executive, Charles Green, issued a statement on the subject yesterday as the on-going tax dispute “will have no affect (sic.) on us”.  He also wrote “in the strongest possible terms to HMRC pointing out the futility of such an appeal”.

If Green expects HMRC to read this letter and to countenance a change of tact he has a regard for his own abilities which are, frankly, a little curious.  No mere mortal could write a letter and bring about any change in such a dispute, which leads us to another question, is Charles Green a mere mortal, or does his aim occasionally stretch beyond his reach?  I’m sure we’re not dealing with a Self-Certified-Superman.

The point to this exercise is that while Green’s newco is not liable for another company’s taxes, his football club inherited the SFA place vacated by Rangers, including pesky football liabilities.  Fifa and SFA rules on paying social taxes are clear – avoid them illegally and face disciplinary action.

As the matter is on-going, the football authorities have yet to issue any disciplinary action for the non-payment of taxes for the five players Rangers conceded to the FTT.  Should the courts ultimately decide in favour of HMRC for the balance of players still being disputed, a fresh wave of disciplinary measures would be due against Green’s club.

Last summer we discussed how the toxicity which was attached to the club Craig Whyte inherited, and then relinquished in a worse state, would make going forward as a Newco with any connection whatsoever to the SFA membership of Oldco very difficult.  Many, including the Blue Knights consortium, concluded it didn’t look viable.

It still doesn’t. Scottish football needs to consider how to deal with the long term consequences of these matters.

    The run you allude to he did play well but this is very much the exception. Sadly.

    He is the kind of player, becoming an endangered species, who gets the fans onto their feet. Those who are sitting anyway.

     

     

    Unfortunately, he is the type of player who is becoming anachronistic in modern football.

     

     

    Certainly at the top level.

     

     

    The game today is played to a formula, which favours percentages.

     

     

    The day of the maverick has, moreor less gone.

     

     

    Even Barca playto a formula,albeit with a team of highly skilled players, who know what each other are doing and where to find them on the park.

     

     

    It takes a high level of fitness to achieve this.

     

     

    Paddy’s game is a throw back to the 50s and 60s.

     

     

    However, today, this kind of “off the cuff” player is not “trusted” in a team formation, where keeping possession in midfield is vital.

     

     

    Players like Paddy, who run with the ball, have a high percentage of losing it; and in midfield, it can cost you on the break.

     

     

    I think Aiden is/was a similar player and that is the reason that successive managers, at home, abroad and at International level, don’t play him in his favoured position.

     

     

    In short, (thank God, I hear you say), Neil doesn’t “trust” Paddy in a central role,and his talent is minimised out on the wing.

     

     

    Wrong era Paddy, I’m afraid.

  7. Regarding the harrasment of supporters buses and the gb by the polis.

     

    Could this not be construed as interference of trade against cfc?

     

    Could (are) the supporters not buying from celtic, i.e. customers and if they get really anoyed would or could give up on going to matches ?

     

    Therefore celtic would theoretically lose out on trade.

     

    Just a thought , maybe some one on here could take this on board and explain it better.

  11. A couple of questions that came to me a in a dream.

     

     

    What happens if you put the attractive tax treatment in a prospectus of a holding company’s IPO of the purchase of another trading company. International investors sign up and the tax treatment perhaps proves a little more difficult in getting?

     

     

    What if loans become more attractive than shares as the loans can be secured against assets but then a shadowy figure rustles some security paperwork already held on these assets from a wee while back that have never been relinquished?

     

     

    What if you’d pledged money under either of these circumstances and decided that as neither are immediately realisable you’ll hold on to you cash for a wee while?

     

     

    As I said, this is based on nothing but a very strange dream. May not even relate to football.

    Been arguing the “club” definition in the articles of association is definitive and that for a “club” to become an associate license holder it must become a legal entity to protect the SFA from liability.

     

    Problem is legal minds read the LNS decision about 15 times for it to make sense then refuse to accept the simple truth because they managed to find an argument in LNS philosophical acrobatics, after reading his decision a couple of time I came the conclusion he was talking about Tinkerbell :o)

  17. In the club last night. Ordered my usual Budweiser. Normally takes me about 15 minutes to finish the first. Last night it took me 40 minutes. Why? I hear you ask. Wel…….got talking to a friend who also happens to be of the Sevconian persuasion.

     

    Out of the blue (no pun intended) he started talking about their performance against Dundee Utd. Straight from the off the whole team got a roasting….one by one he slaughtered them. This did not only make me smile….it made me laugh. The more I laughed at his comments….the worse they became….making me laugh even more…making him slaughter them even more. My sides were literally aching when he moved on to “that fat bassa McOist, then MacDowall, and, saving the best to last, “that useless lump of shoite Durrant” It was heaven….he was saying to me what I would normally say to him.

     

    Sides splitting and jaws aching it took me 40 minutes to finish that first pint. If I stick with him he’ll save me an absolute fortune.

    My job deals with a varirty of complicated clinical issues and so I often find myself in the middle of issues I don’t ( and never will) fully understand. A bit like the Hun/ Sevco/ HMRC scenario. My coping mechanism at work is to strip the issue down as far I can and apply common sense and gut feeling.

     

     

    I suspect the SFA and HMRC will need to do likewise. If Rangers emerge unpunished we will quickly see several more liquidation/ reemerged clubs… The St Mirren, The Aberdeen, The Motherwell , etc.

     

    After all changing a few letterheads and club signs doesn’t cost millions???

    If you have never been to the rugby let me recommend getting to a boozer after the match before heading back to the city centre. There aren’t many to shout about around that area but I usually head to the Gorgie Road area to let the traffic die down a bit and get a pint.

     

    There are busses at the Western Approach road coming out of the ground but unless you make a sharp exit from the rugby you can wait ages. I was in the Horseshoe formally Luckies after the last Scotland v England at Murrayfield. Plenty room and a half decent pint.

    Was it not part of the agreement with the SFA that in order to get the ‘associate’ license, SevcoFC had to agree to pay any debts owed by RangersFC? Whether monies owed to the taxman was part of the deal I would sincerely doubt.

    I’m sure this referred to footballing debt only, so transfer fee, gate receipts etc had to be paid (though I’m not sure if they paid for Jellylegs).

     

     

    So I’m pretty sure they were not liable to the tax debt, however as many have said on here already it’s the selling on of the oldco’s assets that could come back to haunt them if this is deemed illegal as it was grossly undervalued by D&F to the benefit of Sevco.
