“Giant punishments” on Rangers were illusory, you were punished instead

Malcolm Murray, the newly appointed chairman of the Newco club Charles Green hopes to establish, yesterday entertained us with his comments on punishments served on a football team suspected of cheating you for over a decade.  He said:

“We’ve had giant punishments already – a European ban, a 10-point deduction, the emotional trauma everyone has suffered. I think, for the good of Scottish football, it’s much better Rangers in the SPL.”

There has been no European ban.  Newco will not be eligible for European competition because it is a Newco and Uefa requires three years accounts from participating clubs.  They are simply not eligible, they have not and will not achieve the qualification criteria for European football for three years.

The 10-point penalty imposed on Rangers last season for seeking protection from creditors by going into administration is hardly a “giant” punishment.  It changed nothing.  Rangers were second in the league when it was imposed and remained so.  They released no players and went on to defeat Motherwell twice, ensuring they finished the league in second place, earning £900k in additional prize money.

As a punishment, it is the equivalent of banning Ally McCoist from this year’s 100m Olympic competition.  Pointless.

Which leaves us with “the emotional trauma everyone has suffered”.  Compared to the emotional trauma suffered by Dundee, Motherwell, Gretna, Third Lanark fans, recent events have been nothing more than a focus for some robust rallying calls.

Don’t even start me on the emotional cost of losing the league in 2003, 2005, 2009, 2010 and 2011, all to a team of cheats.  How do you measure that?  Think back to each day we lost those titles and tell me how you felt about them then and how you feel now, knowing you were cheated.

    If ever an entity fitted that description it is Dodo FC. The problem is the bird might be dead but its psychopath spirit is still alive and unwell. I think we have been labouring under the impression we are dealing with sane people, that rationale is possible, what is the treatment for psychopaths?

    I can’t speak for anyone else but I can assure Mr. Murray that I have suffered no emotional trauma of any kind over Rangers demise.

If the sfa knew about dual contracts and EBTs through their office bearers like Ogilvie ,Smith ,Peat, McLennan and McIntyre then is it not possible for a Celtic shareholder to sue the sfa or the above names for denying Celtic the tens of millions of pounds that has fraudulently been acquired by the club formerly known as Glasgow Rangers ?

    I posted at length here and on RTC yesterday on that very subject, and I won’t rehash it now, but I’ll ask a few questions:

     

     

    There are two corporate identities holding bits of Rangers now. One has all the structures of a football club, or most of them, but holds not league place or license, and this has been freely admitted by Charles Green.

     

     

    The other is an empty shell.

     

     

    My questions is these; Is my understanding of this correct when I say that the licenses that empty shell holds are invalid, by virtue of them having no infrastructure of any kind? They would not meet even the minimum criteria in any area of the licensing documents … ANY of those areas, everything from the number of trained medical people they have employed to the requirements over directors, stadium and everything else ….

     

     

    Isn’t it a fact that as of Charles Green’s taking over the structure of Dead Club and moving it into New Club, the SPL and SFA are now minus one team? That we are, in fact, in an eleven team league right now … and that the regulations for that, as laid down, give the next league place to Dundee?

     

     

    Furthermore, doesn’t this fact now expressly destroy the assertion that this is a simple “transfer of share”, making this, instead, an “allocation of share”, which brings with it an 11 – 1 requirement to pass?

     

     

    Oh yes, and with Dead Club no longer meeting the criteria for holding a share, and New Club not having one yet, doesn’t that rule them out of the vote?

  15. Let’s say that they hadn’t cheated with EBTs.

     

     

    We would have won in 2003,2005 and 2009 (just looking at the cliffhangers).

     

     

    We got into the Champions League in 03/04 anyway thru qualification.

     

     

    In 05/06 we would have avoided Artmedia and got into the group stages.

     

     

    In 09/10 we would have avoided Arsenal and also got into the groups.

     

     

    So we missed out 2 years CL money.

     

     

    It’s hard to guess what would have happened with Mowbray’s team if things were fair.

    The working solidarity of this principle has now been eroded both by government and by individuals who now care not a jot for another worker in dispute with their employer.

  18. Any plans for the Supporters Trusts/Representatives of all the SPL clubs standing side by side in a galvanised show of support against brand new club. After all, the recent SPL poll showed around 95% of supporters say no to a brand new club getting direct entry into Scotlands top flight.

     

    A unified message of “NO” from all clubs might carry a bit of weight.

    No vote could take place in the SPL as RFC is still occupying a spot in the SPL and the process of liquidation has not been completed.

  24. Rangers FC PLC (in administration) no longer qualifies to hold a share in the SPL. That fact should be noted at the SPL Board Meeting on Monday. The club should take no further part in any SPL governance.

     

     

    The Board should then call a General Meeting so that other 11 clubs can then decide how to allocate the vacant share, in accordance with the Articles of Association of the SPL.

    At this juncture, we need to consider one other important aspect. The admission of a NewCo into the SPL, may create compelling legal arguments for other clubs, who would have a legal interest against admission of a NewCo in the SPL. Without mentioning names, for personal reasons, it is a fact that, with the liquidation of Rangers FC, a vacant spot in the SPL would become available. Subject to the appropriate regulations of the SFA and the SPL, several legal interests may arise. The two governing bodies may decide to leave the vacant spot intact and continue into the next season with 11 teams. Such option may cause sporting disarray, but it is possible and it is viable. However, I have advised that other clubs with legal interest may wish to challenge any decision to accept a NewCo in the SPL. Given that such NewCo has not won the sporting right to participate in the SPL, in terms of equity and natural justice, those affected from such decision, may argue that, in the absence of a sporting right won on the pitch by the NewCo, they have an equal right to file for participation in the SPL too. Whether this could happen via a new status or their current status, it is a different matter. But the option is there and could be exercised.

    It is important to understand that BOTH companies are still in existence. The INTENTION is to liquidate oldco. It has NOT actually been processed.

     

     

    It won’t be processed until AFTER the SPL consider an application for a share from Sevco. This approach ALLOWS the TRANSFER of the share and the 8:4 vote.

     

     

    If the administrators/liquidators process the paperwork before the vote then it is NOT A TRANSFER.

     

     

    This is why D+D need to have hard cash in the oldco at this time. It allows them not to IMMEDIATELY file for liquidation. Oldco will liquidate, but not before Green has had his day in the SPL bearpit.

    Wee green man same thing happened to me recently though not at Greenock ,I am self employed so I started writing back to them with an invoice to them for my time in writing to them and an admin charge of £40 per letter..strangely enough they stopped writing to me…
