Illegal EBTs and Sporting Advantage question remains

Sir David Murray, Campbell Ogilvie, Dave King, as directors of a football club, you presided over tax evasion. While ordinary men and women have no choice, or criminal urge, to avoid paying for public services, you directed a deception on an industrial scale.

Sir David Murray and Campbell Ogilvie have their influence and signatures all over this act. The SFA was quick to discipline and sine die Craig Whyte after he was out of the game, it must now charge Murray and Ogilvie with bringing the game into disrepute. The stale influence of cronyism at Hampden must be routed and seen to be so.

The SPFL instructed an inquiry three years ago but with this verdict in, the SFA must appoint their own inquiry.

Why did the processes at Hampden allow this to happen and continue without check?

Why did Rangers get their European licence in 2011 despite being in arrears to HMRC, in contravention of that licence?  Who was responsible for this decision?

Why was a director and signatory of Rangers illegal tax schemes elected and reappointed president of the SFA?

How transparent were the SFA and the SPL in their handling of these tax evasion charges?

Was the SPL inquiry commissioned to uncover the facts, or to meet a desired objective?  Who prepared the inquiry remit and who signed off on that remit?

Lord Nimmo Smith found that legally executed Employee Benefit Trusts did not confer a significant sporting advantage.  In light of what I have already read of the verdict, we must now discover if such widespread illegal Employee Benefit Trusts conferred a sporting advantage.  This question has not been asked yet.

It’s time for football to shake off the shackles of corruption in Scotland, as elsewhere.

    The ebt recipidents will not have to pay tax on their loans. Its an insignificant ruling it would seem. And Rangers emerge with their glorious reputation untarnished.

In the heat of the blowback from this decision (today’s judgement in favour of HMRC vs ‘Murray Group Holdings and Others’), I have a strong feeling that if there aren’t major consequences, including (amongst other things) a potent mixture of sackings, sine dies, title stripping, and vicarious shaming, then there will be a massively detrimental effect on season ticket sales (right across the country) next season …

    At both the original FTT and the appeal heard by Lord Doherty it always seemed that there was a serious disconnect around it all. A disconnect that fed all the conspiracy theories.

     

     

    To say that an EBT was either not income or if it was it was unrelated to the employees main work was ridiculous. Then the bombshell today..

     

     

    “The judges ruled that if income was derived from an employee’s services, in their capacity as an employee, it was an emolument or earnings and “thus assessable to income tax”

     

     

    Lord Drummond Young’s comment then nailed it. “That (rationale) accords with common sense.”

    B) RFC Administrators failed to provide the specified evidence to Harper MacLeod that would have made it clear DOS ebts were illegal and

     

     

     

     

     

     

     

     

    C) Campbell Ogilvie who was Secretary to the Remuneration Board that instigated the DOS ebts in 1999 made no mention to LNS of the difference in ebt types in spite of being a later recipient of the BTC type.

    To be fair, John Beattie ( who I’ve found to be quite impartial) is now discussing it and mentioning possibly more than 90M being owed – to put in perspective, that could be around 19/gbp for every person in Scotland. I do realise that tax is a UK issue.
