Legal term of the day: uttering

751

Since Corinthians FC gave up the good fight football has largely been a brutish game.  Even those supporters, who are unable to raise a limb with anything approaching athletic guile, often talk a brutish game.  Now, in Scotland, the accountancy geeks are having their day.

The mere mention of the word ‘taxation’ has ears pricking up while the entire corporate accountancy system is now as much of the daily lexicon of football fans as the Laws of the Game.  I reckon the law geeks will have their day soon.

I’d never heard of the crime ‘uttering’ until yesterday, now it’s all I hear from my Edinburgh sources.  Uttering can broadly be defined as using a document you know to be forged.  Don’t worry, it has nothing to do with Our Hero, just an observation for you.

On other matters, still no word from the SFA on the scope of their investigation into Rangers, or the position of their president relating to this matter.  When respected mainstream journalists are making unchallenged assertions about improper registration of players, the SFA cannot choose to ignore these events.  We know they are aware of the allegations, we know the allegations relate to the period when the SFA president was involved with Rangers.  We just don’t know if the SFA are doing anything about them.  A statement confirming that no one is immune from investigation would be a start.

  1. Steviebhoy66 , Auld Neil Lennon heid , greenjedi , SuperSutton , RobertTressell , Half Time Tombola – Thanks for your thoughts chaps.

I did think it was a bit of a flyer, but nothing about Rangers or the colourful people associated with it comes as a big shock these days.

The simplest explanation is probably the correct one, so jock steins celtic may be closer to the truth.

I, for one, would welcome Rangers leaving Scottish football, the Scottish game and Scottish society would be healthier as a result. If they can’t get into the English leagues, maybe the IFA would welcome them? (thumbsup)

  2. TBB – Corporate Cryostorage! Brilliant term. There is more pain in the post for the Orcs. I think this debacle will be getting lectured on for years. Even after the red backsides they have had over this story the MSM are still doing them a dis-service by not reporting to them the likely scenario’s they may be facing. They have trotted out various insolvency and financial experts, each to a man say they are shafted, yet they leave the story there. It is curious the only people giving out positive noises on this are the one’s with a vested financial interest.

The only thing certain is we will need a bigger bowl…..

Can anybody remember a poster on this site talking about a Surrey connection to the takeover before the whyte knight took over?

I can remember the poster having a tenuous link to one of the interested party, a parent of one of his son’s team mates or something along those lines. I wonder if that poster has any more information?

  4. Just finished watching Helicopter Heroes on BBC2, about the air ambulance service. Somebody should point out to Tax Evaders FC (in administration) and all who support them, SNP Eck, etc that failing to pay your due tax causes a shortfall in finances for these services and ultimately causes lives to be lost. Hang your head in shame anybody who thinks RFC 1872 (in admin) are being treated unfairly!!!

  10. Banstead Athletic are currently in the Combined Counties Football League (Premier Division) which is a regional English football league currently comprising teams from southwestern Greater London, Surrey, small parts of Hampshire and Berkshire, and Guernsey (Channel Islands).

Its top division sits at Step 5 of the National League System (or level 9 of the overall English football league system).

Banstead are currently a point off the relegation zone which would take them to effectively the 10th division.

Ignoring the geographical implications, whether a team based in Scotland could compete in a league for southern English teams, it would make no sense at all to join this league as it would take at least 8 years (and that’s very optimistic) for them to get promotion to Premier League.

In that time, revenues will shrink drastically, ain’t no chance of 50,000 huns paying £30 a game to see 9th division football. even a £10 a ticket would be pushing it.

If that’s the plan, why doesn’t the MBB just buy Porstmouth and relocate them to Ibrox.

  11. Hi,

I may not be up to speed here but, if a large number of cream buns club together to try to save their club before the big tax bill hits by ploughing money in, will it all not be wiped out when the big tax bill does materialise anyway? I mean to say wouldn’t they be better to keep their powder dry? Maybe I just dont understand the possible scenarios but it occurs to me that they could end up blowing any future hopes of a competitive club in a few short months.

Sorry for delay in replying, work got in the way.

If used correctly an EBT is perfectly legal, a little suspect morally but legal all the same. If the EBT pays out “loans” that you do not have to pay back then everything is hunky dory, but footballers and their agents being a suspicious lot wanted it in writing that they would be paid a certain amount per week via normal “wages” which are liable for tax and NI contributions and the balance by a non repayable loan, which would not be liable for tax or NI. This second written contract is what makes the EBT ILLEGAL. Once you pay wages via an EBT that is when Tax Avoidance becomes Tax Evasion.

Hopefully I have picked up other, far more financially literate, posters explanations of this correctly. Any mistakes are mine.

Rangers offering a settlement doesn’t indicate that they have lost the case. It shows that they have considered both that they may lose the case and what would be affordable in terms of payment.

On the other hand, the fact that HMRC have refused to even enter negotiations is instructive. It can only mean that they believe themselves to be in a virtually unassailable position; relations between the parties have broken down completely; HMRC are not really concerned about the money; or all or some of the above.

However, as RTC told us that Whyte does not have the authority to negotiate with HMRC on this issue, to my mind, this talk of negotiated settlement and CVA is just another pile of craig whyte.

At this moment if I had to bet I would be backing HMRC. But stranger things have happened…
