SFA lawyers examine illegal registration responses

BBC today revealed that the SFA’s legal team are examining responses from the Associations 93 clubs to a letter dated 9 March, which reminded clubs of their responsibility to record financial records with the SFA and asking them to declare they have complied over the last 10 years.

The inquiry was established after reports that Rangers had illegally registered players for over a decade, excluding payments which were not taxed.  We can presume that as the legal team are investigating, there was at least one response which returned a noncompliance.

The SFA issued a deadline for responses of 6 April and under Article 86.1 any club not responding in a timely manner would be in breach, so it’s unclear why it has taken over two months to get to this stage, so why the legal team are only “examining responses”.

We look forward to hearing an early comment on this crucial matter from the executive.  It is enormously unfortunate that the SFA were unable to inform their AGM of the findings on Wednesday. BBC report that the Association legal team have yet to report to the Compliance Officer, which is the next step.

  1. The fact is nothing would surprise you if rangers do get a CVA however if finances don’t get them they will rip themselves apart with an all out civil war.

     

     

    And who is really going to buy a season ticket knowing that half their players will be away by August to fund the CVA?

     

     

    The old rangers directors are not going to stand around doing nothing watching some Englishman nobody make a quick buck at their expense.

    Cheers for the reply. However, although your assertion that the SFA’s decision is supported by their rulebook, it was contradicted by their own QC, Aidan O’Neill, who claimed in the CoS that Rangers had had the option of going to the CAS – so which is it?

     

     

    My fear is that Rangers are spinning things out so they can launch an appeal to CAS at the last minute, therby suspending the transfer embargo until the appeal is heard, which would take several months, giving them 2 transfer windows in which to sign players.

    As I hear more about Mr Green and his intentions, and much a I want them dead as soon as, there’s a little voice at the back of my head trying to tell me that it might be worth having the CVA accepted and/or newco back in SPL just to watch the carnage

    The big news is that an unblemished Red Heifer has been found, these creatures are incredibly rare and not been around since the destruction of the last Temple, this, if it is accurate, is highly significant. This apparently is only the 10th RH. I am turning up no google links for this news which says to me it is being hidden from people.

    Some time ago I read a book, a diary by Mouloud Feraoun about the Algerian Civil War. I found it shocking and depressing and I can’t believe how naïve I was beforehand. :(

    My understanding is that Arbitration (under CAS) can only happen when both sides agree to it.

     

     

    The SFA rulebook was written so as the Appeal Tribunal was the second and final stage of the process. As I understand it had the original panel, say suspended them (one of the listed punishments) and this had then been upheld by the Appeal that would have been the end of the matter. There could have been no court case.

     

     

    Paul McConville knows much more about the legalities than me. He said:

     

     

    “If, following upon a decision, Rangers wanted to appeal, it could ask the SFA to agree to send the matter to the Court of Arbitration for Sport. If both parties agree, then a case can be referred there. However, as one of the purposes of the creation of the JPP, JP and AT was to keep these matters self-contained in Scotland, by providing a robust appeals structure, it might seem odd for the SFA to agree to do so. Mr O’Neill QC, in appearing for the SFA before Lord Glennie, argued that the court had no jurisdiction and that any appeal should go to CAS.”

     

     

    My reading is that if Rangers had asked for the matter to go to the CAS the SFA may well have agreed forsome reason – but they would have had the right to say no.

     

     

    If there was to be a request for referral to CAS from Rangers following a second Appeal Tribunal, surely this time the SFA would definitely say no?

    I’m currently watching Season 4. Looks like the Netflix thing covers Seasons 1 – 3. I’ve never used it myself but see that you can get a month’s free trial – an even cheaper way to access Breaking Bad for those who haven’t yet had the pleasure!

    Your post has got me thinking there. perhaps the best outcome might just be –

     

    1. CVA accepted due to HMRC not opposing this – company and club carry on ‘as normal’. HMRC effectively givingup on the £18M or whatever they are currently owed

     

    2. A mixture of season ticket sale, investment(?) and player sales flow into the club leaving it temprarilly ‘cash rich’.

     

    3. HMRC win the Big Tax Case, and immediately instigate proceedings to get their full settlement of mega-millions forcing them into liquidation?

     

    4. Overall, HMRC collect more than they would by opposing the CVA?

  23. Jobo, the BTC is included in the CVA. If HMRC win the BTC it will reduce the p in a £ to about 1p. Nothing will be paid out to creditors until the BTC is known. Effectively creditors are voting on a deal that they know nothing about.

    Dave King will mount a legal challenge to block any attempted transfer of Craig Whyte’s 85% shareholding in Rangers to Charles Green.

     

    The club director has been a vocal critic in recent days of what he believes to be the lack of transparency surrounding Green’s bid for the club.

     

    King has previously stated that Whyte had verbally agreed to give him first refusal on his shares.

     

    He has since told Rangers’ administrators that he can prove this.

     

    “You have been aware for some time that I have the first right of refusal on Craig Whyte’s shares and that I will legally contest any transfer to Mr Green, if such a transfer is attempted,” King has told the club’s administrators Duff & Phelps.

     

    “[Fellow director] Mr [Andrew] Ellis has confirmed to me by email that Mr Whyte advised him, during negotiations with Mr Ellis, of his agreement with me. The agreement is therefore not contentious and I have no doubt will be upheld before a Scottish Court.”

     

    Green, who is leading a consortium in place to buy Rangers, has been frustrated by King’s criticism and told BBC Scotland: “We are buying this club on Thursday whether Mr King likes it or not.”

     

    Duff & Phelps informed King on Friday that his directorship of the club was being terminated.

     

    “There are regulatory requirements laid down by the Scottish Football Association which require confirmations to be given by the club in respect of all directors of the Company,” said Duff & Phelps in an email seen by BBC Scotland.

     

    “As the company is currently in administration, it is not possible for such confirmations to be given to the SFA.

     

    “This is not a reflection on any individual’s status merely a reality of the company’s position. Accordingly, where such confirmations cannot be given by a club it is pertinent to remove directors of the company.

     

    “Given the above-noted expected change in the board of directors of the company, the removal of the present directors has now been effected at this time.”

     

    But King responded: “Does this power extend to a director who has an agreement, such as myself, that I am entitled to a board position as long as I remain a shareholder?

     

    “Craig Whyte and Gary Withey previously tried to remove me and were ultimately thwarted by that legal undertaking given at the time, and as a condition of, my initial investment.”

     

    In May, Whyte told BBC Scotland that King’s claim to have first option on his shares was “categorically untrue” .

     

    Amid King’s criticism of Green, he also backed the Blue Knights consortium, who lost out in the bidding process.

     

    The leader of the Blue Knights, Paul Murray, told BBC Scotland: “Why are we Rangers supporters allowing a guy with no Rangers affinity and who will not disclose any proper details of his bid to buy the club?

     

    “The fact that he has been brought to the table by Duff & Phelps, who have a lot to answer for and have chosen not to so far, should make every Rangers fan very concerned.

     

    “The whole process needs a full investigation. It stinks and everyone knows it.”

  26. SFFS – I’ve watched the first 6 episodes. Won’t say too much on here as I know that many are behind me on that. But fantastic watching how every single character has develioped / changed over the 4 seasons. Saul’s patter is fantastic and some day I’ll rewatch his scenes and pay more attention to all that he comes away with. Loved his first meeting with Skyler when he talked across her to Walter and referred to her as Yoko Ono!
