SFA Judicial Panel opens on Res 12 issue

The SFA Judicial Panel Disciplinary Tribunal sit for the first time today to examine Rangers Uefa licence application in 2011, the subject of which was picked up by the ‘Res 12’ group of Celtic shareholders.  This application was made under Craig Whyte’s memorable tenure which saw the club withhold tax payments before the eventual appointment of liquidators.

Evidence of what took place was eventually heard in open court, at Whyte’s trial in Glasgow last year.  Rangers did not declare to the SFA they failed to make tax payments and should not have been granted a Uefa licence.  As a consequence, Celtic, who finished second in the league that year, were denied a chance to participate  in the Champions League qualifiers.

So far, so clear, but then the matter becomes subject to issues not heard in court, specifically the Five Way Agreement between the SFA, the (now defunct) Scottish Football League, the Scottish Premier League (now the Scottish Professional Football League), oldco Rangers (now also defunct) and Sevco Scotland (now newco Rangers).

This Agreement gave Sevco Scotland associate membership of the SFA and a place in the Scottish Football League in return for accepting some, though not all, of Rangers football penalties.  Newco When the SFA announced this Tribunal, Newco did not contest the guilt of Oldco, instead suggesting they had agreement of immunity on this matter.  The SFA clearly believe differently.

The Judicial Panel will first decide on its competency to hear the matter, based on whatever partial immunity Charles Green secured for Newco in 2012.  If the terms of the immunity is not sufficient to exempt the worst excesses of Craig Whyte, the panel’s punishment of Oldco will apply to Newco.

The extent of this one is significant, effectively cheating to gain entry to the Champions League.  I expect nothing less than a multi-year ban from European competition.

You will notice people switch seats of the Newco/Oldco debate with this subject.

Craig Whyte appointed administrators who would release the name ‘Rangers’ and associated intellectual property to Newco, unlike administrators at Airdrieonians in 2002, who refused the then Clydebank to rename themselves Airdrieonians.  The name was subsequently changed to Airdrieonians in 2013.

Whyte’s plan was to buy the brand name from Rangers administrators and put the Scottish football authorities on the spot.  In buying the assets from the administrators, Green had control of the name by the time of the Five Way Agreement, and he accepted some liabilities as a price for entry on the nod into Scottish football.

This resulted in a debate that will never end.  Newco claim continuity with Oldco when selling tickets, but not so much at times like this.  No ‘Say No to liquidation’ banners were noted in the asset register.

Green claimed Sevco Scotland “bought the history” from administrators Duff and Phelps (you will not be surprised to learn ‘the history’ was not on the asset list purchased).  Now lawyers for Green’s one-time rival for Oldco’s assets will try to fortify his work.

We’ll see if Dave King’s recent sabre-rattling has been effective.

    Jim Baxter got a broken leg in a euro game – show-boating once to often. I dont think he was quite the same player after.

     

     

    *I recall that day well, it had been an afternoon ko and deidco were over in Vienna with a slender 1-0 lead from the 1st leg.

     

     

    I was on the train home when a punter got on at Dumbarton Central, he had one of the evening papers with him and just as the train crossed the bridge of the River Leven he enlightened us all with the news they had won 2-0 over there, a very credible results, a lot of heids went down until he read the stop press, baxter had broken his leg, a huge roar went up, it was the only solace us young Tims could find and a pre-Christmas present tae.

     

     

    As you say in the last minute he tried tae extract the urine, the offending player wisnae even cautioned as far as I can recall.

     

     

    It seems he hit the bottle hard after that allegedly drinking 3 bottles of laurel and hardy a day although that seems highly unlikely.

    I think the finest British footballer was George Best.

     

     

    *I didnae like Georgie, let me qualify this first, he was a terrific player no doubt about that however he was of the same generation as me just a wee bit oulder, a really good looking guy and could play fitba, wisnae too bad looking masell but had more desire than talent, oh and he was seen dancing on TOTP with some wee dolly burd. So perhaps I was a tad jealous.

     

     

    Oh and he was also quoted in the Sunday People as saying if he wisnae a fitba player he would be back in Belfast throwing stones at Catholics. I wisnae the only Tim that now had no time for him.

     

     

    When we beat manure in the friendly of ’66 he was about the only reds player tae turn up even though he was just back fae injury.

     

     

    I saw him on Parkinson and he was disgusting, talking about all the sha88in he had done and how lassies would say as they were climbing intae bed “I’m not doing this just because you’re George Best”, Parkie loved it and so did the audience.

     

     

    Just after that I read his biography which was co-written by Parkie, pretty much the same and went as far as naming some of the underhand things he got up to with his team mates when on NI duty, caused a bit of consternation with the players and spouses there.

     

     

    Juts after that I left the country and a couple of years later I’m wandering through the local library and saw a Bestie book on display, my first thought was it was THAT book, however I had a glimpsed at the inside cover and right off the bat he said he wrote this one as an apology over the one that Parkie wrote with him while he was hammering the don revie.

     

     

    It was a fascinating book written with a lot of humility which I didnae think he had. He mentioned that quote in the People and said he had been misquoted, what he had really said was if it wisnae for fitba and given where he came from and the fact his da was in the lol (as a boy he had carried the strings of the banner in his local ludge) he more than likely would be throwing stones with his mates at Catholics.

     

     

    He also mentioned his mentor Paddy Crerand, he of Donegal Catholic stock, who Sir Matt KCSG put in charge of George when he went wayward one time too many and had him living in Pats home to keep him away fae the night clubs,

     

     

    As I said a fascinating book but one segment that stuck with me was he was out one night and fed up with the clubs went tae this old fashioned pub, the kind with ¾ blacked out opaque windaes. The landlord, a good friend, would often let him sleep in the backroom on a couch.

     

     

    He was woken one morning by the sound of traffic, looking up through the clear part of the widnae he could see men sitting on the upstairs of a bus complete with working jaiket and cloth cap, his first thought was they’re going tae work tae help pay my wages.

     

     

    He was a truly gifted player who single handily won the EC for manure in a breath taking extra time against Benfica.

     

     

    One other game that sticks out was an FA Cup match at the old County Ground against Northampton, he had just returned from a four-week ban for kicking the ball out of the ref’s hands, the media was all over this and he returned their curiosity with a 6 goal performance.

     

     

    His sixth goal was the coup de grace, it saw him go one on one with the home goalie, he made a feint to go right which put the keeper on his backside before he went left and walked the ball into the net.

     

     

    On one other occasion down at the Dell he scored one from around the half way line which went in off the underside of the bar, when being interviewed after the commentator remarked he had been quite fortunate there, Georgie rebuked him by saying nae chance as he had been practicing that move all week

    I think the studio crowd are being a wee bit sanctimonious about Maradona.

     

     

    He is an Argentinian who has just seen his team score a great winner when he, and the rest of Argentina, thought they were heading for a humiliating exit.

     

     

    When Celtic have delivered such moments for me, I would hate my reaction to be plastered all over the (anti) social media. Unless we are prepared to call out 90% of our own fans who react with offensive delight towards opposition fans, then we should see wee Diego as just another Argentine fan. I find him very human and very entertaining.

    Mags, I expect Senegal will go out and Nigeria were odds on to lose to a poorish Argentina team but still put up a great show. I canot see where footballers from Islamic countries have been cheated (Nigeria got one of the softer “holding” pens this evening). They are just not good enough yet. The teams with enough players playing in European leagues (Morroco, Egypt, Nigeria) have a fighting chance. Those that play in their own insular leagues (Saudi and, to some extent, Iran) are entering very challenging territory when they get out of their safe qualifying zones.

    Anyone expecting Sevco / Rangers to be punished by anything more than a wee slap on the wrist is going to be disappointed.

    Surely it depends on what they told SFA to be granted a licence and if they complied with the rules after licence granted but before UEFA notified, not to mention after UEFA began monitoring in June 2011.

     

     

    If they did Celtic shareholders need an explanation that satisfies, if they didn’t then Celtic shareholders had a right to raise Res12 and if appetite is there, pursue compensation from all those involved unless Celtic disagree and it goes to a vote at next AGM?.

     

     

    However if it is shown licence was obtained dishonestly, that would be significant in terms of relationships between clubs if one is officially known to be dishonest but no corrective action is taken.

     

     

    It also begs the question how can clubs expect their supporters to pay to watch a game the clubs themselves have no faith in the way it is governed or should STS carry a cautionary warning? Caveat emptor.

     

     

    I know principles like these are not normally top of a supporters agenda but when results stop being favourable the importance of fair play principles rises.

    Seems we hold on to our scouting dossiers even when managers change.

     

     

    My worry with young Moses is the same as with Danny Ings whom Liverpool are ready to let go at a cut price value. Both have had serious injuries and, in Ing’s case, have only recovered to be half the player they were before. Big risk but also big rewards if they truly have overcome their problems.

  12. General consensus is that the lad from Hull, Odubajo, was a right good player before he got injured. This is from Hull fans. Two years out with serious knee injuries (plural) though.

    I didnt claim that the muslim countries were cheated(even though some of them were) but if we could now have a jihad on Latino cheating whining “God is on our side” thug teams?

     

    On a positive note when Portugal beat Uruguay and Argentina beat France Ronaldo and Messi will get to meet in the quarter finals. Its what the officials want. Its good for the game all this corruption as we know in Scotland.

    firing the raptors coach was the right decision….

     

     

    Casey was brought in to be a defensive coach … with a team full of offensive players who didn’t like to play defence … and they never did …

     

     

    so, they won a boat load of games in the regular season… but crapped out every year in the playoffs (when defence is at a premium)…

     

     

    so, either fire all the players, and bring in players to suit the coach …. or fire the coach, and bring in someone who can get the most of the players they have …

     

     

    the argument can be made that the coach’s job was to get the players to buy into his system, and he failed in that regard …

     

     

    but with players who are a bit more defensive minded to begin with, Casey will do very well …

     

     

    personally, I think the real culprit is the president Masia Ujiri (the president) who over saw the hiring of the coach, and the drafting of the players who dont fit with each other …. but, the president is never likely to fire himself, even if he should bear a lot of the responsibility, is he?

     

     

    If presidents did that, PL wouldn’t still be in situ

  17. SETTING FREE THE BEARS FOR RES. 12 & OSCAR KNOX we could sign a player with no history of injury tomorrow and he could get bad injuried the next day, if scans etc… Show up ok and he is able to train, play games and Show sign that he is good to go, why not!!!

     

     

    Injury is occupational hazard FOR footballers and FOR every player that has had a bad injury and fell away there are many who have come back stronger than every.
